ADDENDUM
The appellant requests a use varience from R-6 to a-office for the
purpose of moving his present office building now located on the
corner of Mill and Main streets to said Lots R+S Block 59, to make
way for a new office building on Mill and Main.
The justification for said varience is based on the following:
The appellant received approval for the new building proposed for
Mill and Main streets too late in 1974 to begin construction in that
current building season. This delay of approval was due to the very
lengthy and time consuming approval process set out by Ordinance 19,
and then further delayed due to indecision on the part of the
planning and zoning department relating to the off-street parking
problems and the employee housing situation. Had the old building
been moved to the corner of Hopkins and Garmisch last spring or early
summer of 1974 as was planned, the zQning current at that time, which
was A-R 1 would have permitted the office use and no hardship would
have existed. The present proposed code, although not actually or
officially adopted, prohibits professional offices on said lots.
Furthermore this proposed use will not detract from the current
neighborhood use, which is predominantly tourist lodging such as
the Smuggler Lodge, the NuggetLodge, the Holiday House, the Molly
Gibson, and the Edelweiss. and the Hearthstone House.

Pursuant to the Official Code of Aspen of June 25, 1962, as amended, a
public hearing will be held in the Council Room, City Hall, Aspen, Colo-
rado, (or at such other place as the meeting may be then adjourned) to
consider an application filed with the said Board of Adjustment requesting
authority for variance from the provisions of the Zoning Ordinance, Chapter
24, Official Code of Aspen. All persons affected by the proposed variance
are invited to appear and state their views, protests or objections. If
you cannot appear personally at such meeting, then you are urged to state.

as the Board of Adjustment will give serious consideration to the opinions
of surrounding property O>VDers and others affected in deciding whether to

Dear Madams:
Per your Air Mail Special Delivery letter in protest of
Case No. 75-5 (Vroom Building), Hr. John Dukes, Chairman
has been forwarded your protest.
The Board members were also especially concerned with
having a business in a residential area, but Mr. Vroom
amended his application at the last moment to read that
it would only be a temporary structure until January 1st,
1976 at which time he would have it converted to a single
family dwelling. Mr. Scott Doughty protested at the meeting
against the variance on the basis that it would generate
more cars and detract from the area. The Board members,
during their deliberations, decided tllC1 t the variance for
a temporary use as a business would not hurt the general
public and after the business was gone would be another
dwelling for employees or residents on a long term basis.
Therefore, the variance was granted conditional upon the
structure either being torn down or reModeled to conform
with the building code for a single family dwelling EY the
first of January, 1976.
The Board appreciates your concerns in regard to this type
of variance.
