TO ALL PROPERTY OWNERS AFFECTED BY THE REQUESTED ZONING OR USE
DESCRIBED BELOW:
Pursuant to the Official Code of Aspen of June 25, 1962, as amended, a
public hearing will be held in the Council Room, City Hall, Aspen, Colo-
rado, (or at such other place as the meeting ma:: be then adjourned) to
consider an application filed with the said Board of Adjustment requesting
authority for variance f;com the provisions of the Zoning Ordinance, Chapter
24, Official Code of Aspen. All persons affected by the proposed variance
are invited to appear and s tate their vie,vs, protes ts or obj ections. If
you cannot appear personally at such meeting, then you are urged to state.
YOlLvlews by letter, particularly if you have objection to such variance,
as the Board of Adjustment ,viII give serious' consideration to the opinions
of surrounding property owners and others affected in deciding whether to
grant or deny the request for variance.

Description of proposed exception showing justifications:
Brewer, Inc. is request}ng a variance to construct 16 townhouse units on the above
mentioned property. The present R-6 zoning requires 4,500 square feet of land per
unit.. The property has 70,872 square feet, which when divided by 4500'is 15.75 units.
Brewer, Inc. has received concept subdivision and P.U.D. approvals for 16 units from,
,paZ and City Council. At the preliminary plat hearing Brewer was told that only 15
units were permitted. We are requesting that the Board of Adjustment intergret the
zoning code in this matter. Is rounding and, therefore, 16 units appropriate, or
should one t;runcate and, therefore, only. 15 units, be permitted? '

APPLICATION IS ~ffiDE FOR A BUILDING PERMIT TO BUILD 16 TOWNHOUSE
UNITS. The proposed townhouse units is on a lot that has an
area of 70,872.square feet.' Sixteen ,units would require a lot"
area of 72,000 square feet (4500 sq.ft. per dwelling unit) .

Brewer, Inc. has substantially relied upon the 16 unit density
approved at concept level. Last spring (1974) when the R-6
zoning was proposed and adopted, the planning office informed
Brewer, Inc. that 16 units would be permitted. Also during the
Mountain Edge - Clarendon - Ute Avenue density transfer proposal
last summer (1974), Brewer was informed that 16 units was the
allowable density. Recently, both City Council and City P&Z
approved concept subdivision and concept P.U.D. plan showing 16
units. After receiving this approval, Brewer expended sums on
planning and architecture for a 16 unit project. Because of this
reliance, Brewer will face a hardship if they must replan for a
15 unit project.
