APPEAL TO BOARD OF ZONING ADJUSTMENT

Application is made for a building permit to build a
commerical building.
The proposed building does not comply with the zoning regulations
in the following areas:
1) The building must be provided with open area that has a
minimum horizontal dimension of 10 feet and a minimum
vertical dimension of 10 feet and equal to 10% of the
total lot area in order to extend to the rear lot line.
The area designated is not open but is closed by two
7~ x 10 overhead garage doors. Sec. 24-7(a) 'Nin Rear
Yard"
2) The 6000 sq.ft. site requires 1500 sq.ft. of open space
and 900 sq.ft. has been provided. Sec. 24-7(a) "Open
Space Requirement"
3) Required off_street parking has not been provided and
cannot be leased or acquired from the City since the
proposed building is in the C-l commercial district.
Only required off_street parking can be leased or
acquired from the City in the C-C Commericia1 district.

BEFORE THE CITY OF ASPEN BOARD OF ADJUSTMENT
TO ALL PROPERTY OWNERS AFFECTED BY THE REQUESTED ZONING OR USE VARIANCE
DESCRIBED BELOW:
Pursuant to the Official Code of Aspen of June 25, 1962, as amended, a
public hearing will be held in the Council. Room, City Hall, Aspen, Colo-
rado, (or at such other place as the meeting may be then adjourned) to
consider an application filed with the said Board of Adjustment requesting
authority for variance f~om the provisions of the Zoning Ordinance, Chapter
24, Official Code of Aspen. All persons affected by the proposed variance
are invited to appear and state their views, protests or objections. If
you cannot appear personally at such meeting, then you are urged to state..
yorrviews by letter, particularly if you have objection to such variance,
as the Board of Adjustment will give serious consideration to the opinions
of surrounding property owners and others affected in deciding whether to
grant or deny the request for variance.

Dear Sirs:
We are unable to a~~end the hearing for
the above case as we will be out of town.
We strongly object to the granting of
this variance.
We object to all the open space in down
town being filled - particularly when it
requires a variance.
We object to the elimination of the parking
space.
We feel strongly that Aspenites should be
able to live within our regulations and
not continually ask for variances.
We object on the past history of Mr.
Bergman who has taken advantage of pre-
vious variances and not lived up to what
he agreed to do.
