Description of proposed exception showing justifications: A variance
of one unit in zoning density is requested to allow the continued
occupancy of a home purchased in reliance upon all public records of the
Clerk & Recorder of Pitkin County, title insurance, and representations
of a licensed real estate broker. Records of the City Building Inspector
affecting the use of this condominium project were not picked up in the
condominium filings with the County. Ignoring the defect in the
reporting procedures which made the problem possible while strictly
enforcing zoning density would deny the applicant any and all use of the
home she purchased and for which she is obligated on financing and
would constitute an unnecessary hardship.

to forward this application to the Board of Adjustment and reason
for not granting permit:
Application is made for a building permit to install a window in the
kitchen of a dwelling unit that has been changed from a laundry and
proposed future sauna to a limited dwelling unit without a permit
from the city of Aspen.
The building where the above unit is located is on a 9000 square foot
lot and has 12 unlimited units (750 sq. ft. of lot area per unlimited
unit at the time the building was built.). The addition of a limited
unit would have required a minimum lot area of 9,375 sq. ft.
(375 sq. ft. of lot area per limited unit).

BEFORE THE CITY OF ASPEN BOARD OF ADJUSTMENT
TO ALL PROPERTY OWNERS AFFECTED BY THE REQUESTED ZONING OR USE VARIANCE
DESCRIBED BELOW:
Pursuant to the Official Code of Aspen of June 25, 1962, as amended, a
public hearing will be held in the Council-Room, City Hall, Aspen, Colo-
rado, (or at such other place as the meeting may be then adjourned) to
consider an application filed with the said Board of Adjustment requesting
authority for variance from the provisions of the Zoning Ordinance, Chapter
24, Official Code of Aspen. All persons affected by the proposed variance
are invited to appear and state their views, protests or objections. If
you cannot appear personally at such meeting, then you are urged to state.
yo~views by letter, particularly if you have objection to such variance,
as the Board of Adjustment will give serious consideration to the opinions
of surrounding property owners and others affected in deciding whether to
grant or deny the request for variance.

Dear Janet,
Your application for a building permit to install a
window in the kitchen of your studio unit cannot be
approved for the following reasons:
1) The unit is over the density requirements of
the zoning ordinance. Only twelve units were
permiteed at the time the Midland Condominium
was built, and under the then existing density
requirements of the zoning ordinance.~he
Building Department files show that your unit
was to be a laundry and future sauna.
2) The building code does not permit habitable
rooms in a cellar.
3) The building code requires windows with an area
of not less than IjlOth of the floor area of the
room served. Your proposed 3'x4' window and your
existing 3'x4' window is less than 10% of the
360 8q.ft. floor area.
