Description of proposed exception showing justifications: The applicant
was turned down on preliminary plat review pursuant to Section 20-5 of the
City Code and under conceptual review under Ordinance 19 by the Planning
Commission on the grounds that the site is unsuitable for subdivision as
described in Section 20-7 (5) (i). The applicant received a letter,. a
copy of which is attached hereto, from Clayton Meyring, the building
inspector, which letter the City Attorney construes as a denial of buildin~
permit application. Although we disagree and feel that the board of
adjustment does not act on matters passed on by the planning commission, WE
would ask that this board overturn the denial of approval by the planning
commission and the building inspector on the grounds that:

if the plans etc, meet the Building Code pursuant to
the City Code.
2. By the strict interpretation of Section 20-7 (5) (i)
by the planning commission and the building inspector, this applicant
suffers an undue hardship and the Subdivision Regulations and Ordinance 19
ought to be varied and modified to allow applicant to construct his
project because although difficulties with the terrain may exist, they
have all been satisfactorily dealt with and the public safety and welfare
secured. The spirit of the ordinances will be observed and justice done
pursuant to Section 2-21 (3).

Dear Ron:
Excuse me for not answering your letter of January 25,
1974 regarding Fred Hibberd's Durant Houses, but I was
waiting for the minutes of P&Z January 17,1974 meeting
since I was not present.
The motion ~ade and passed by P&Z was that both the
conceptual presentation and the preliminary plat for
the Hibberd Durant Houses be denied. The minutes in-
dicate the reason for the motion was that the site is
unsuitable under 20-7(i)of the subdivision regulations,
that no land shall be subdivided for residential use
which is held by the Planning Commission to be un-
suitable for such use by reason of, in this case, the
drainage, topography, health, safety and welfare.
Ordinance 19 provides that 75% of the estimated build-
ing permit fee be returned if the development is dis-
approved at or after the conceptual presentation. We
are therefore refunding $1,565.44 to Mr. Hibberd.

INSPECTOR TO FORWARD THIS APPLICATION TO THE BOARD OF
ADJUSTMENT AND REASON FOR NOT GRANTING PERMIT:
Application is made for building permits to build
eleven(ll) one family dwellings.
The Planning & Zoning Commission denied the Hibberd
/Durant Condominium Houses under preliminary
subdivision plat application based on 20-7 5.(i)
Jan. 17, 1974 for the following reasons:
1. Bad drainage inherent on the site that requires
excessive corrective measures subject to failure
in the event proper construction or maintenance
is not observed,
2. Adverse topography, the percentage of slope
for the entire site is 30% with portions
exceeding 100%,
a) affecting soil stability and requiring
protective measures, the adequacy of
which have not been demonstrated to the
satisfaction of the commission.
b) resulting in conditions of inadequate
access and uncertain fire protection,
likely to be harmful to the health,
safety and welfare of future residents.

On 1/17/74 the Aspen Planning and Zoning Commission denied
a preliminary subdivision plat application based on 20-7
5. (i) of the City of Aspen, subdivision regulation requiring
the Planning and Zoning Commission to determine the suitability
of land subdivided for residential use '::'1d sale to the public.
In the case of the Hibberd/Durant Houses the P & Z found
that, despite considerable effort on the part of the applicant,
the land had not been rendered suitable for such use by
reason of:
1. Bad drainage inherent on the site that

Gentlemen:
I have just received the notice of public hearing,
Case No. 74-12, concerning Mr. Fred Hibberd's
request for a variance in Anthony Acres. As an
owner for the past seven years of a condominium
in the Fifth Avenue Complex, I would vehemently
object to the variance being granted.
The Fifth Avenue and Durant complexes, after many
years of promises, have finally become an attractive
addition to Aspen. The parking facilities are
inadequate now, without any additional complexes.
It would also be a shame to in any further way
obstruct the open air space and mountain view of
Aspen. The population density in Anthony Acres
area is great enough without any additions.
I will appreciate your consideration of the above
objections at the hearing on May 30.
