BEFORE THE CITY OF ASPEN BOARD OF ADJUSTMENT
TO ALL PROPERTY OWNERS AFFECTED BY THE REQUESTED ZONING OR USE VARIANCE
DESCRIBED BELOW:
Pursuant to the Official Code of Aspen of June 25, 1962, as amended, a
public hearing will be held in the Council. Room, City Hall, Aspen, Colo-
rado, (or at such other place as the meeting ~ay be then adjourned) to
consider an application filed with the said Board of Adjustment requesting
authority for variance from the provisions of the Zoning Ordinance, Chapter
24, Official Code of Aspen. All persons affected by the proposed variance
are invited to appear and state their views, protests or objections. If
you cannot appear personally at such meeting, then you are urged to statee.
yo~views by letter, particularly if you have objection to such variance,
as the Board of Adjustment will give serious consideration to the opinions
of surrounding property owners and others affected in deciding whether to
grant or deny the request for variance.

Dear Sirs:
we would like to request a hearing for a variance in regard to the
maximum height of building section under the C-l Commercial Zoning
classification in the Aspen Municiple Code. The code states "The
37t foot maximum height limitation shall still be observed in this
latter instance; and further proVided that no building or structure
shall be constructed higher than 25 feet above grade within 10 feet
of the front or rear lot line." W9 are requesting a varis,nce with
regard to the 25 foot height limitation within 10 feet of the front
and rear lo~ lines. You will note that both stair towers are within
6" of their 'respective front and rear lot lines and both go the full
heighth of the building. Also, the rear wall of the building is 5 ft.
from the rear lot line. It was our understanding that in going through
the Ordinance 19 review process we were essentially going through
a P.U.D. process in which there is a give and take with regard to
existing ordinances; but it now appears that this is not the case.
we have been going through the review process since January and are
now preparing to undergo final review and, hence, would like this
matter clarified. As you will remember, I questioned you regarding
this process at our last meeting with you and I might add the new
proposed zoning code has eliminated this setback.
This setback does not afford any additional light or air, and
th efore, in our estimation, is useless.

MEMORANDUM

SUBJECT: RBH Building Setback
DATE: August 26, 1974
The present Aspen Municipal Code, in Section 24-7, requires that in
the C-1 zone, "No building or structure shall be constructed higher
than 25 feet above grade within 10 feet of the front or rear line."
This requirement has been deleted from the proposed new zoning code
currently under our consideration.
It is the unanimous opinion of the commission that this requirement
is unnecessary and in some cases detrimental to the architectual
harmony of the community. The commission, therefore supports the
applicants in their request for a variance from this setback re-
quirement.

REF: Variance for the RBH Joint Venture Office Building
After extensive analysis of the Historic Characterisitics of the
entire block where the RBH Building is to be located, by the HPC,
it was determined that this block of Main St. is one of the most
historic sections of Aspen which remains intact. Of historic
significance was the fact that most of the uses were governmental or
religious, and the character of the building was large and rectangular
and surrouned by open space.
HPC approval of the building was given on March 29, 1974, as it met
the criteria of maintaining the architectural integrity of the historic
character of the block, in that it is compatible in materials and in
mass and proportion with the existing buildings, and respects the open
space of the area. It was further felt the feature of the area in
questions offered a visual anchor to the historic block, with nothing
of historic significance on Main St. to the east of this anchor.
Therefore, the HPC recommends the approval of this variance since we
feel it would be a definite hardship to the Owners to be delayed even
further by having to redesign the building and go through the process
of HPC approval only to meet a requirement of the zoning code which is
due to be dropped from the new zoning code now being prepared.
