Description of proposed exception showing justifications:
Applicant seeks relief-from open space requirement of the Municipal Code of the City
of Aspen and states in support thereof the following:
(1) The lot on which the proposed building will be erected is an undersized
lot and, therefore, full compliance with the open space requirement will dispro-
portion the scale and bulk of the building;
(2) The design philosophy to which .the building will adh,ere, and with \vhich
the Historic Preservatio~ Committee is concerned, is to maintain the aesthetic .
neutral~ty of the building juxtaposed to the surrounding buildings. Full compliance
with the open space requirement will certainly jeopardize this effort.

Application is made for a building permit to remodel and build an
addition to an existing business building. The existing building

Dear Mr. Duke and Members of the Board:
The C. A. Muer Corporation and its architect, Jim Von Breuer,
have filed an application with the Board of Adjustment asking the
Board to grant relief from the open-space requirement of the
Municipal Code of the City of Aspen. The applicant, C. A. Muer
Corporation, submits the following pragmatic and compelling reasons
for granting the variance herein requested:
1. The proposed building is no more than a remodel-
ing and expansion of the existing structure.
Indeed the contemplated use for the building is
identical to that now made. The current archi-
tectural design (approved by the Historic Preser-
vation Committee on August 26, 1974) will
incorporate many of the existing structural com-
ponents of the building. A requirement that not
less than twenty-five percent (25%) of the build-
ing space be committed to open space would neces-
sitate the demolition of the existing structure
which would cause an undue financial hardship on
the applicant not resulting from its own actions.

2. The current plans for the remodeling and expansion
of the existing structure on the subject property
are not anticipated to interfere with the business
of Fothergill's Outdoor Sportsman shop; however,
if compliance with the open-space requirement is
necessitated, it would render impossible the con-
tinuation of that business, substantially impair-
ing the enjoyment of a property right enjoyed by
other properties in the same vicinity and zone.
Indeed, it would create a substantial impediment
to the continuation of the applicant's entire
business.
3. Compliance with the open-space provision of the
Code would cause a great hardship in the efficien-
cy of the future functioning of the restaurant
operation on the subject property. Again, this
would substantially impair the enjoyment of a
property right enjoyed by properties in the same
vicinity and zone.
In recent years, criticism of the existing structure on the
subject property has increased both in frequency and intensity.
The applicant has now designed a structure which has met with
the resounding approval of the Historic Preservation Committee
as an excellent treatment for a very difficult project. The appli-
cant would point out that it feels the open-space requirement, as
contained in the Municipal Code of the City of Aspen, is certainly
valid and worthwhile, and although it would not try to circumvent
that requirement for any frivolous reasons, strict application
thereof to the existing structure is an imposition of a grave
hardship. The concern of the applicant is only to upgrade the
aesthetic character of the existing structure.

Further, applicant would reiterate that no expansion in the
use of the existing facility is contemplated.
Finally, the applicant has designed the proposed impro'~ent
with twelve and one-half percent (l2~%) open space, whereas
currently there is no open space on the site, because the appli-
cant agrees with the philosophy behind the open-space requirement
and is willing to do everything possible to comply therewith short
of destroying the economic feasibility of the business.
