Description of proposed exception showing justifications:
1. Variance needed i~ Rrder to subdivide 2 existing houses
into 2 separate lots. One lot will be undersized for the
zone district - approximately 4050 sq. ft., the other
will be over 6000 sq. ft.
2. Variance for set back on the larger lot. One corner of
the house is less than 5' from the property line.
Provisions of the zoning Ordinance requ~r~ng the Building Inspector
to forward this application to the Board of Adjustment and reason
for not granting permit:
Application is made for a variance to divide a tract of land
which has two existing dwellings on the tract into two seperate parcels.
One parcel will contain the required 6000 sq.ft. of lot area and the
other will contain approximately 4,050 sq. ft..
The existing dwelling will have less than 5 feet to the property
line. The required minimum lot area is 6000 sq. ft. and the required side
yard is 5 feet, Sec. 24-5(e) "Min Lot Area & Min Side Yard"

BEFORE THE CITY OF ASPEN BOARD OF ADJUSTMENT
TO ALL PROPERTY OWNERS AFFECTED BY THE REQUESTED ZONING OR USE VARIANCE
DESCRIBED BELOW:
Pursuant to the Official Code of Aspen of June 25, 1962, as amended, a
public hearing will be held in the Council. Room, City Hall, Aspen, Colo-
rado, (or at such other place as the meeting may be then adjourned) to
consider an application filed with the said Board of Adjustment requesting
authority for variance f~om the provisions of the Zoning Ordinance, Chapter
24, Official Code of Aspen. All persons affected by the proposed variance
are invited to appear and state their views, protests or objections. If
you cannot appear personally at such meeting, then you are urged to state,.
yo~views by letter, particularly if you have objection to such variance,
as the Board of Adjustment will give serious consideration to the opinions
of surrounding property owners and others affected in deciding whether to
grant or deny the request for variance.

Dear Gentlemen.
In reference to the last meetingfI bag you to please give me the permission
to change my Triplex into <, duplex.De 'fay the 'l'riplex is buill! it is next
to i~ossible to make it into a single Familie-House.The house is much to s.."mall
to built stepS inside "Thich Hould lead upstairs. I had in my mind by selling
the duplex,I could make on the ~riplex the neccesary repairs and make it nice
and attractive for myself,and also for peo,.,le 1falking ~nd driving by. By selling
the duplex I ,'/Culd be financially able to change the '.L'riplex into a duplex
because all Hhat is neccesery is to break trough the wall bet1feen the two
smaller Apartments upstairs. -/or a sinp,le }'am.House it would be neccesary to
build a new house altogether or have a very large remodeling done and I am very
sorry ,but I just dont have the Tooney for th"t . ,"hen I do sell the duplex house
there is no ;\Uch noney left anY'fay ~Jecause the houses have fisst, second and
third = ;orp;ages.
By not havinl; anymoere a, Tryplex or at lea,st a Duplex, I loose monthly on ',ent
i> 270. -- Hhich is very much Hone:!! for me, and I Hould not knoH how I pay bills
and food. Under those circumstances if I consider to sell the front house Tryplex,
so is this also very hard and difficult to do because it can not be sold the
Hay it is t as a single ?2.m. house and not anymore as a tryplex. I "lOuld be forced
to sive the house aHa~ for almost no money.
To consider is also l>~hat r think is very important) by Dividing;the Front-
property Tryplex is not loosibg any thing, it is the opposite. From the present
natural contour-line,the Land is gaining 5 feet all the Hay. At the present,
5 :r,rs ha"e Room for parking on the 'l'ryplex-house in the "ront. All together
my Henters are 4 Persons and only 3 of them have a Cnr, therefore never a ~;ar
is standing outside on the Street and ~..,ould be distu.r1:'ling anybody.
The Tryplex 1<as buill! nbout 9 Years ago 1-lith Building-Permission on a Lot
under 6.000 sq.feet. The fact is nothing changed over all this Yenrs, because
the >my the land is shaped it is and it 1<88 alhlaYs a Property w,der 6.000 sq.f.
One of my Henters upstnirs (,teve) is a lienter of mine already 7 Years and he
is a very nill'e and qu:et2erson . It \"ould hreak my heart to tell him he has to
leave. The some is m;r Renter next door in the J\paztment ,he paid 3 months Rent
in @4vance to have a nice and quiet plnee ~nd 8. place for the linter Time.

This is to inform the Board of events thus far accomplished in the
Cantrup-Hobgood settlement of "lroperty, as directed by the Board.
Three (3) Surveyors have rebarred property lines. FDOn receipt of
t>eir descriptions a lep;al exchange of deeds etc. will be done.
wben this is accomplished and completed I will notify the Board or

Dear 0embers of the Board:
This letter is submitted as a request to the Board to deny the variance
requested at this time. The urcperty in question and to be considered
is in the Widst of a controversy and possible litigation for settlement.
In June of 1970, I bought a strip of ryroperty from ~argaret Cantrup,
contiguous to the southerly portion of my Lots 1 and 2 Block 7. Because
of an erronous plat description, it was discovered in s~~er of 1973
that I owned a strip of property under Es. Cantrup's house, and she still
owned the oroperty to have ~een conveyed to me and is now contending that
she never agreed upon our origional contract:
After unsuccessfully attempting to strike a compror:,ise thru l::s. Cantrup's
lawyer, I ha~e been forced to retain legal advice and litigation may be
the end result.
In the meantime, it is my understanding that when Ms. Cantrup appeared
before the Planning and Zoning Commission to request sub-division of her
property, she was instructed that one of the problems to be resolved
before anything could be decided upon WaS the settlement of our particular
property controversy.
I therefore submit to the Board, that before total square footage of
the nroperty in question can be considered and resultant request decided
upon, :,s. Cantrup and I will have to resolve our problem via compromise
or court litigation.
