The Aspen Cooperative Housing Partnership (Partner- ship) is a partnership that has been formed by four local residents (William Wesson, Thomas Hughes, Bayard Hovdesven and Richard Ferrell) for the pur- pose of constructing four townhouse-type units near Lift 1.'1. on South Monarch Street. Each of the four resulting units will be conveyed to each of the partners after construction for use as their per- manent residences. . 2. The site is located on the west side of South Monarch Street. Adjacent to the property are the Caribou Condominiums (uphill), the Hearst Apart- ments (downhill), a lodge (to the rear), and the Dolomite Villas Condominiums (across the street). The subject property is 60' by 100', and therefore, consists of 6000 sq. ft. The legal description of the property is South 20' of Lot 14, all of Lot 15, North 10' of Lot 16, Block 1, Conners Addition, City of Aspen. A location map is attached as Exhibit A. , 3. On February 21, 1974, the Partnership presented the proposed fourplex to the Aspen Planning and Zoning Commission (P&Z) for review under City Ordinance 19, Series of 1973. Under this Ordinance all plans for development (with certain exceptions not here rele- vant) must be submitted to P&Z for its review and approval before a building permit may be issued by the City Building Inspector. A copy of the written portion of the presentation is attached as Exhibit B. 4. On February 21, 1974, P&Z voted to disapprove the Aspen Cooperative Housing Partnership under Ordin- ance 19. c '-, '-.._,,./ Memo to The City of Aspen Board of Adjustment April 1, 1974 -2- 5. On March 7, 1974, written reasons for disapproval were stated in a memorandum signed by Bruce Gillis, as Chairman of P&Z. A copy of such memorandum is attached hereto as Exhibit C. 6. On March 13, 1974, the Partnership requested an appeal to the Board of Zoning Adjustment. The Board of Zoning Adjustment is the appropriate appeal body for projects that have been denied under Ordinance 19. Section 2-21 Powers and Duties of the Board of Adjust- ment from the Aspen Municipal Code states: "To hear and decide appeals from and review any order, require- ment, decision, or determination made by any adminis- trative official charged with the enforcement of the regulations established by the zoning laws. "In this case the administrative official is P&Z and the zoning law is Ordinance 19. 7. The Partnership is appealing P&Z's decision because we feel that THERE IS NO LEGITIMATE BASIS IN FACT OR IN LAW FOR THE DISAPPROVAL OF THE PROJECT and the action of P&Z, in so doing, constitutes an abuse of discre- tion, is in excess of its jurisdiction and is arbitrary and capricious. 8. The Project, as proposed, fully complies with all re- quirements of the City's Zoning Ordinances, and the use complies with the Aspen General Land Use Plan which is part of Ordinance 19. The P&Z memo, Exhibit C, states four reasons for dis- approval: The first reason is inadequate access, i.e., road width and grade, visibility and lot entrance. The property has excellent access consisting of 60 feet of frontage on a dedicated city street. The street is not near its capacity and the additional traffic generated by four units is minimal. The lot is relatively flat (less than 10%) which poses no problem in terms of lot en- trance. South Monarch is fairly steep in certain sec- tions, but automobiles seem to easily make it to exist- ing condominium dwellings. Visibility in and out of the subject property is adequate given the traffic pattern and speed on South Monarch. o ~ ,) Memo to The City of Aspen Board of Adjustment April 1, 1974 -3- The second reason is insufficient off-street parking. Our proposed plan shows four off-street parking spaces or one space per unit as required by City Zoning Ordin- anace. It seems strange that paZ this week is consider- ing prohibiting off-street parking in the core area, but finds four spaces for four units inadequate. The third reason is adverse impact on already existing problems of circulation and snow removal. Such a small project has a very minimal incremental impact on the area's problems. The fourth reason is excessive density and lot use for physical conditions of the development site and immediate surroundings. The site is eminently develop- able. It is relatively flat (less than 10%) and is served by all municipal utilities. All surrounding property has all been developed. We committed to pre- serve the site's only tree. We are only asking to be allowed to develop the prop- erty at a density and in a manner similar to that per- mitted on all surrounding properties. 9. The Partnership believes that paz voted to disapprove the Project, not on the basis of the reasons given in Exhibit C and above, but on the basis that at some future date the Partners would sell their units to individuals who may be tourists or who may rent their property to tourists. Thus, the general City Council policy of no additional tourist growth would be violated. We feel that this consideration is beyond the scope of the police power of the City to protect the health, safety and welfare of its residents. 10. And, since ALL SURROUNDING PROPERTIES HAVE BEEN DEVELOPED AT HIGHAR-l TYPE DENSITIES AND ARE TOURIST RELATED USES (See Exhibit A - Location map), the denial of AR-l density of 1500 sq. ft, per unit and a possible future tourist use DENIES ENJOYMENT OF A SUBSTANTIAL PROPERTY RIGHT ENJOYED BY OTHER PROPERTIES IN THE SAME VICINITY AND ZONE. Section 22-2 of the Aspen Municipal Code states that the above is a reason "to reverse any order, requirement, decision or determination of any administrative official, or to decide in favor of the applicant any matter upon which the board is required to pass, or to effect any variation in the provisions of the zoning laws of the City." o "'"", ....~ Memo to The City of As~en Board of Adjustment April 1, 1974 -4- 11. The Partnership seeks a reversal of P&Z's negative decision under the concept review section of Ordinance 19. A reversal would establish that the proposed four townhouse-type condominium units is an appropriate use and density on the subject prop- erty. The Partnership still will be required to proceed under Ordinance 19 for preliminary and final architectural review and to proceed under the Subdivision Ordinance. Each of the four resulting units will be conveyed to the respective partners after construction. By using this method of joint effort, we feel that we can pro- duce reasonable housing that can be afforded by each of the partners. ' The site is located on South Monarch Street downhill from the recently constructed Caribou Condominiums. To the North the property is bounded by the Hirst Apartments, and to the rear is the Skier's Chalet Lodge. It is 60' by 100' and, therefore, consists of 6,000 sq. ft. Under existing zoning and under the Aspen Proposed Land Use Map, the property can accommo- date four units (1500 sq. ft. of land each). The project that we propose would incorporate the following features: 1. Four condominium apartment units approximately 1200 sq. ft. each. two bedroom, two bath units. consisting of They shall be 2. The apartments will be in a four-plex structure with an approximate total square footage of 4800. 3. Two of the apartments will be in a two story section of the four-plex. To minimize site coverage and maximize the limited views, the other two apartments will be three stories. The three story units may require a height variance. It is envisioned that these taller units will re- late to the Caribou which is a very high building to the South. DATE: February 12, 1974 - - - - - - - - The Aspen Cooperative Housing Partnership is a partner- ship that has been formed by four local residents to construct a four-plex near Lift lA on South Monarch. Each of the four resulting units will be conveyed to the respective partners after construction. By using this method of joint effort, we feel that we can pro- duce reasonable housing that can be afforded by each , of the partners. The site is located on South Monarch Street downhill from the recently constructed Caribou Condominiums. To the North the property is bounded by the Hirst Apartments, and to the rear is the Skier's Chalet Lodge. It is 60' by 100' and, therefore, consists of 6,000 sq. ft. Under existing zoning and under the Aspen Proposed Land Use Map, the property can accommo- date four units (1500 sq. ft. of land each). The project that we propose would incorporate the following features: 1. Four condominium apartment units ap'proximately 1200 sq. ft. each. two bedroom, two bath units. consisting of They shall be 2.
