BEFORE THE CITY OF ASPEN BOARD OF ADJUSTMENT
TO ALL PROPERTY OWNERS AFFECTED BY THE REQUESTED ZONING OR USE
VARIANCE DESCRIBED BELOW:
Pursuant to the Offi_ial Code of Aspen of June 25, 1962, as amend-
ed, a public hearing will be held in the Council Room, City Hall,
Aspen, Colorado, (or at such other place as the meeting may be
then adjourned) to consider an application filed with the said
Board of Adjustment requesting authority for variance from the
provisions of the Zoning Resolution, Title XI, Official Code of
Aspen. All persons affected by the proposed variance are invited
to appear and state their views, protests or objections. If you
cannot appear person3lly at such meeting, then you are urged to
state your views by letter, particularly if you have objection to
such variance, as the Board of Adjustment will give serious con-
sideration to the opinions of surrounding property owners and
others affected in deciding whether to grant or deny the request
for variance.

Gentlemen:
I am a property owner in the west residential
area of Aspen. My home is located one block
south of that owned by Go~on Forbes1-who has
applied for a zoning varia~ '(;o"all.ow> a sec')nd
story addition to his house thus converting it
into a duplex used for rental property.
I feel the granting of such a variance to allow
an addition to a building which does not meet
the setback requirements will not only increase
the traffic/street parking problem in that area,
but I feel it is defeating the purpose of
controlling density in that district.

In the event that I cannot attend the meeting
scheduled for March 1, 1973, with regard to
the variance request to increase the size of
the improvements located at 315 North Second
Street, I am hereby voicing my objection to
such variance.
The granting of a variance to allow the proposed
duplex addition to a building which does not
meet setback requirements could set a precedent
for future requests of this nature, and I strongly
feel that the density in the west residential
area should be as strictly controlled as possible.

Lives at Hallam and 2nd Street. Objects on the grounds that the
house is already too close to the alley and already has divided into
a duplex, now wants to build some more units on top. Objects very
strongly, because conforming uses, density problem and parking
problem. Would like to cite the case of Bascom who was turned down
for the same type of variance.

Gen tlemen:
I am not able to attend subject public hearing and am therefore
writing my views as reQuested in notice.
My wife and I are owners of the property on the corner of 2nd
and Francis, namely 306 W. Francis.
We feel strongly that all of the property owners should be
obliged to respect the 10 feet setback. It is an absolute
minimum to maintain the residential atmosphere of this neighbor-
hood.
Others of us in the neighborhood have been limited by this
minimum and have restricted our building projects accordingly.
We oppose the granting of the variance.

I have just received the notice of a hearing on March
1, 1973, to consider the request for a variance from the provisions
of the Zoning Resolution, Title IX, to permit a 2d story addition
to the existing one family dwelling at 315 N. Second, Block 42,
Lot H & I. I am the owner of the one family dwelling at 307 West
Francis, which is next to 315 N. Second, directly to the west,
and the dwelling most affected by the proposed addition. Since
it is not possible for me to attend the hearing, I am writing
this letter to object to the proposed variance.
The present one story dwelling at 315 N. Second does
not interfere with my access to light and air, and is not visible
from my house and yard above the fence separating the two houses,
which affords privacy to each. A second story would block light
and air, obstruct the mountain view, and deny the privacy which
now exists, from my house and yard. On these grounds, I oppose
the proposed variance. The effect of the existing zoning has
been to limit the construction on this entire block to low, one
story houses, which accounts for its attractive open feeling,
with views to the mountains in all directions. Variances to permit
second stories to be added will quickly destroy this.
I regret that I cannot attend the March 1 hearing to
ascertain the exact location and height of the proposed second
story, which is not clear from the notice of hearing. If I could
be satisfied that the location and height would not, as I must
now assume, adversely affect me, I would reconsider my objection.
Perhaps the applicant could be asked to furnish me with more
information about this before a decision is taken.
