Provisions of the Zoning Ordinance requiring the Building Inspector
to forward this application to the Board of Adjustment and reason
for not granting permit:
Application is made for a variance to be permitted to build
a 2nd. story addition on an existing building,and further to
build a stairway and balcony of approximately 152 square feet
in the existing open space.
The existing building has approximately 1000 square feet of open
space where 1500 square feet is required. The open space does not
have one half of the open space fronting on the street. Ten feet
:Fronts on the street where31J:Feet is required.
A non-conforming bdilding shall not be extended. Sec. 24-7(b) Open

BEFORE THE CITY OF ASPEN BOARD OF ADJUSTMENT
TO ALL PROPERTY OWNERS AFFECTED BY THE REQUESTED ZONING OR USE
VARIANCE DESCRIBED BELOW:
Pursuant to the Offi~ial Code of Aspen of June 25, 1962, as amend-
ed, a p;lblic hearing will be held in the Council Room, City Hall,
Aspen, Colorado, (or at such other place as the meeting may be
then adjourned) to consider an application filed with the said
Board of Adjustment requesting authority for variance from the
provisions of the Zoning Resolution, Title XI, Official Code of
Aspen. All persons affected by the proposed variance are invited
to appear and state their views, protests or objections. If you
cannot appear personally at such meeting, then you are urged to
state your views by letter, particularly if you have objection to
such variance, as the Board of Adjustment will give serious con-
sideration to the opinions of surrounding property owners and
others affected in deciding whether to grant or deny the request
for variance.

DESCRIPTION OF PROPOSED EXCEPTION
SHOWING JUSTIFICATIONS
The existing building, onto which a 925 sq. ft. second story addition
is proposed is a non-conforming building by virtue of the 25% open
space requirement. The open space requirement was made regula-
tory several years after the completed construction of this building
therefore making compliance of this requirement between two exist-
ing buildings a hardship and structurally impossible under present
conditions. Of the 1500 sq. ft. presently required for open space,
the open arcade on the property provides approximately 1000 square
feet.
It is requested that an exterior stairway, which is necessary for
compliance to building code exit requirements for the retail oc-
cupancy of the proposed addition be allowed for construction.
It is further requested that a 45 sq. ft. window be allowed on the
arcade side of the building adjacent to and a continuation of the
second story street front windows. The building code requires a
two hour wall of building walls less than 20 feet from adjacent
buildings to prevent flame spread. At the proposed window area
the distance from the adjacent building is 14 feet. Because of the
proximity of the window to fire fighting access (street) and the near
compliance to separation requirement it is requested the window
be granted variance.
In arriving at a decisions regarding the above proposed variances
it is requested that the Board of Adjustments consider the relation-
ship of the pedestrian malls on which the building fronts and the
pedestrian open space the malls provide.
