BEFORE THE CITY OF ASPEN BOARD OF ADJUSTMENT
TO ALL PROPERTY OWNERS AFFECTED BY THE REQUESTED ZONING OR USE
VARIANCE DESCRIBED BELOW:
Pursuant to the Offi~ial Code of Aspen of June 25, 1962, as amend-
ed, a Pllblic hearing will be held in the Council Room, City Hall,
Aspen, Colorado, (or at such other place as the meeting may be
then adjourned) to consider an application filed with the said
Board of Adjustment requesting authority for variance from the
provisions of the Zoning Resolution, Title XI, Official Code of
Aspen. All persons affected by the proposed variance are invited
to appear and state their views, protests or objections. If you
cannot appear personally at such meeting, then you are urged to
state your views by letter, particularly if you have objection to
such variance, as the Board of Adjustment will give serious con-
sideration to the opinions of surrounding property owners and
others affected in deciding whether to grant or deny the request
for variance.
The particulars of the hearing and of the requested variance are

Description of proposed exception showing justification:
Appellant recently completed construction of the Roaring Fork
building (next to the Paragon Restaurant building). 25% of the
building site is OJen Space area in accordance with City of Aspen
Ordinance No.9 (Series of 1970). "the preponderance of Open Space
is in the form of an open walkway from the street front to the rear
of the property, 10 feet in width and 100 feet in length, which
separates the Roaring Fork building from the Paragon Restaurant
building.

wooden beams (4-mx 6"x 10' in size) running between the two buildings.
The beams are located at a heigth of 8 feet above the walkway floor
and are spaced at 8 foot intervals down the walkway. The beams were
added for purely aesthetic reasons and are non-structural. The Ap-
pellant will hang planted pots of flowers from the beam~, and, be-
cause the building was specifically designed to match and compliment
the adjacent building as to its old Aspen Victorian architectural
style, the beams eliminate the feeling that the Onen Space walkway
bet1o[e'~n the two buildin["s is an "alley1vay" vrhile helping to tie
the bro buildings together in their overall architectural theme.
The CLty of Aspen Building Inspection Department has indicated that
the beams obstruct the Open Space in violation of Section 3 (definitions)
of Ordinance No.9.
The A:Jpellant respectfully requests a variance from the above-refer-
enced Ordinance definition in respect to the beams, on the basis that
while technically in violation ofthewording of the definition of
Open Space, the beams are not odds with the purpose of Ordinance No.
9 (as stated in Section 1 of said ordinance) as the total square feet
of all of the beams, looking up from ground level to the open sky,
is le:3s than 29 square feet in the entire open space walbray of
1000 square feet, which the Appellant feels does not obstruct ad~quate
light, air or space.
