Description of proposed exception showing justifications:
Intrusion into the open space by an awning (canopy) extending
over t'he sidewalk entrance into that portion of the Cooper
Building occupied by Appellant across the public sidewalk and
onto the area between the curb and public sidewalk. The Aspen
City Council has granted the easement necessary for ,intrusion
over the public sidewalk, etc. A condition of the easement is
its termination upon direction of the City. This Building was
constructed prior to the present Open Space Ordinance. This
canopy will improve the appearance of the building and will
look like that of the Red Onion.

Provisions of the Zoning Ordinance requiring the Building Inspector
to forward this application to the Board of Adjustment and reason
for not grant~ng permit:
APPLICATION IS MADE FOR A BUILDING PERMIT TO ERECT AN
AWNING. The Proposed awning will obstruct approximately 70 square
feet of required 'open space. The existing building has provided
approximately 960 square feet of open~pace. The existing building
is non-conforming since 3000 square feet of open space is required.
A non-conforming use of a building shall not be extended. Sec. 24-7(b)
open space reguirement. Sec. 24-l0(e) Extensions.

Meeting was called to order at 3:15 p.m. by Chairman John Dukes with Remo
Lavagnino, Gilbert Colestock, and Fred Smith. Also present City Building
Inspector Clayton Meyring.
Minutes

Fred Smith moved to approve the minutes of Septem-
ber 18, 1973, seconded by Colestock. All in favor,
motion carried.

Birkwood &
Associates
Chairman Dukes opened the public hearing.
Location of property: 410 Hyman; Block 88, Lots M & N.
Application is made for a building permit to build a
stairway of approximately 100 square feet into the
existing open space. The existing building has ap-
proximately 1000 square feet of open space when 1500
square feet is required. The open space does not
have one half of the open space fronting on the street.
Eight and nine tenths front on the street where thirty
feet is required. The proposed stairway will further
reduce the required open space. A non-conforming
building shall not be extended - Sec. 24-(b) Open
Space Requirement; Sec. 24-l0(e) Extensions.
Mr, Larry Yaw, architect representing Birkwood &
Associates, was present and pointed out that the
Board had previously approved the second story ad-
dition, but had referred the stairway to the Board
of Examiners & Appeals.
Wally Birk, partner in Birkwood & Associates, was
present and explained that the open exterior stair-
way was granted by the Board of Appeals, although
not conforming to the Code.
Birk stated that this Boa~d, on their previous pre-
sentation, had suggested that Birkwood & Associates
consider other alternatives. Birk felt that the
planned staircase now submitted would be an attrac-
tive open space and more in keeping with the es-
thetics of open space.
Smith stated that he felt the stairway in the rear
would be better in order to clear up some of the
debris in the alley.
Bir]~ stated that in the future, there was a possi-
bility of leasing the open space in the center for
possibly an open-air food service area. Stated the
mall area would be attractive, well-lit, with acti-
vity.
Lavagnino stated that he would prefer to see the
stairway in the rear in order to preserve the feel-
ing of open space in the mall area.
Birk pointed out that functionally, he felt the stairs
would be more p~actical in the front, for reasons
of flow and convenience.
There being no further cOlnments, Chairman Dukes
closed the public hearing and the Board went into
executive session.

Regular meeting was then opened.
Lavagnino then moved to grant a variance to con-
struct an open stairway leading up from the alley
to the second story. In granting this variance,
the spirit of the ordinance will be observed by
securing the public safety and welfare and that
practical difficulties would be incurred if the
stairway were to be located in the interior of the
building. Motion was seconded by Colestock. Roll
call vote - Lavagnino, aye; Dukes, aye; Colestock,
aye; Smith, aye. Motion carried.
