for not granting permit:
APPLICATION IS MADE FOR A BUILDING PERMIT TO BUILD A STAIRWAY
OF APPROXIMATELY 100 SQUARE FEET INTO THE EXISTING OPEN SPACE.
The existing building has approximately 1000 square feet of
open space when 1500 square feet is required. The open space does not
have one half of the open space fronting\on the street.
Eight and nine tenths front on the street where thirty feet is
required. The proposed stairway will further reduce the required open
space.
A non-conforming building shall not be extended. Sec. 24-(b)
Open Space Requirement. Sec. 24-10(e) Extensions.

At the 2 August 1973 meeting of the Board of Adjustment the Sanderson
Building Remodel was approved; the matter of a proposed open exterior
stair in the finger mall between the Sanderson and Aspen Leaf buildings
was discussed and deferred to the Board of Appeals for approval.
On 18 September 1973 the Board of Appeals unanimously approved the ex-
terior stair for reasons of increased safety to the building inhabitants.
It is requested that the board of adjustment review and approve the pro-
posed stair.

TO ALL PROPERTY O~~ERS AFFECTED BY THE REQUESTED ZONING OR USE
VARIANCE DESCRIBED BELOW:
Pursuant to the Official Code of Aspen of June 25, 1962, as amend-
ed, a public hearing will be held in the Council Room, City Hall,
Aspen, Colorado, (or at such otQcr place as the meeting may be
then adjourned) to consider an application filed with the said
Board of Adjustment requesting authority for variance from the
provisions of the Zoning Resolution, Title XI, Official Code of
Aspen. All persons affected by the proposed variance are invited
to appear and state their views, protests or objections. If you
cannot appear personally at such meeting, then you are urged to
state Y01lr views by letter, particularly if you have objection to
such variance, as the Board of Adjustment will give serious con-
sideration to the opinions of surrounding property ow~ers and
others affected in deciding whether to grant or deny the request
for variance.
