Description of proposed exception showing justifications:
Propose to extend present tennis court complex by constructing two standard
asphalt tennis courts enclosed by chain link fence. The Aspen zoning code
defines this as an open-use recreation site which, according to Sec. 24-5 of
the code, may be constructed in the proposed area (Zone R-15) subject to the
approval of the Board of Adjustment. Copy of Building Permit 242-73 re-
quested 6/18/73 and approved 6/25/73 and amplifying information is appended.

TO ALL PROPERTY O~rnERS AFFECTED BY THE REQUESTED ZONING OR USE
VARIANCE DESCRIBED BELOW:
Pursuant to the Offi~ial Code of Aspen of June 25, 1962, as amend-
ed, a public hearing will be held in the Council Room, City Hall,
Aspen, Colorado, (or at such otiler place as the meeting may be
then adjourned) to consider an application filed with the said
Board of Adjustment requesting authority for variance from the
provisions of the Zoning Resolution, Title XI, Official Code of
Aspen. All persons affected by the proposed variance are invited
to appear and state their views, protests or objections. If you
cannot appear personally at such Iueeting, then you are urged to
state your views by letter, particularly if you have objection to
such variance, as the Board of Adjustment will give serious con-
sideration to the opinions of surrounding property o~~ers and
others affected in deciding whether to grant or deny the request
for variance.

Gentlemen:
This submission is being made to satisfy City of Aspen zoning
requirements that approval of the Board of Adjustment must be
obtained before an open-use recreation site (in this case, two
standard tennis courts) may be constructed in an R-15 zone.
Operating under the authority of Building Permit # 242-73, the
Aspen Institute's contractor has been proceeding with construction
for nearly two months. Approximately $8100 in construction costs
have been incurred to date.
Early this week, an interested citizen called to the attention of
officials of the Aspen Institute and to the Chief Building Inspector
of the City of Aspen the fact that a procedural error had been made.
That is, approval of the Board of Adjustment had not been obtained
for the construction of subject tennis courts before the building per-
mit was issued and construction begun. After discussion with sev-
eral parties, Aspen Institute officials directed the contractor to
stop work until this matter was clarified.
Since we had the building permit, we and our contractor have pro-
ceeded in good faith and have expended considerable time and money
in the project. Should it be halted permanently, we will suffer a
significant financial los s. As a matter of fact, any appreciable
loss in time before resumption of construction might result in
erosion of our sub-grade which is presently ready for the asphalt
overlay. Accordingly, we request that the Board consider our case
at the earliest opportunity.
Presumably, the case for constructing the courts was made in suf-
ficient detail when the building permit was issued, so I will not
elaborate on that part at this time. Neighboring property owners
who mighthave an interest in, this, case include the following:
