APPLICATION IS MADE FOR A BUILDING PERMIT TO BUILD A ONE FAMILY
DWELLING. The proposed one family will have a front yard set
back of 20 feet. The required front yard is 25 feet.

Description of proposed exception showing justifications:
Desire a 20 feet front yard set because only a small part of the
front yard is relatively flat. The remaining property is very steep.
A 20 feet front yard would allow the house to be lower with a less
steep driveway and decrease the excavation work.
Existing houses to the east are located with the lesser 20 feet
front yard.
The subdivision developers recognized in the subdivision covenants
that certain sites including the site in question would be utilized
best with 20 feet front yards. These covenants are recorded in the
County Court House. When the subdivision was annexed, these lots
then became subject to the more stringent requirement of the City
for a 25 feet yaRd regardless of topography.
The effect of allowing a 20 feet yard on the neighborhood would be:
1. This house would more nearly conform with its
existing neighbors in terms of height and front
yard.
2. Excavation would be decreased, thereby disturbing
less natural foliage.

BEFORE THE CITY OF ASPEN BOARD OF ADJUSTMENT
TO ALL PROPERTY OWNERS AFFECTED BY THE REQUESTED ZONING OR USE
VARIANCE DESCRIBED BELOW:
Pursuant to the Official Code of Aspen of June 25, 1962, as amend-
ed, a public hearing will be held in the Council Room, City Hall,
Aspen, Colorado, (or at such other place as the meeting may be
then adjourned) to consider an application filed with the said
Board of Adjustment requesting authority for variance from the
provisions of the Zoning Resolution, Title XI, Official Code of
Aspen. All persons affected by the proposed variance are invited
to appear and state their views, protests or objections. If you
cannot appear personally at such meeting, then you are urged to
state your views by letter, particularly if you have objection to
such variance, as the Board of Adjustment will give serious con-
sideration to the opinions of surrounding property owners and
others affected in deciding whether to grant or deny the request
for variance.
The particulars of the hearing and of the requested variance are
