I received this date a notice of hearing
September the 13th in connection with appeal of Rob Roy,
architect, for a variance at ~32 East Hyman.
In view of the limited time and lack of
knowledge of this request, I hereby respectfully request
of the Board of Adjustment to deny this variance.

Dear Mr. Chairman:
Re: Case 73-26
I would like to object to the granting of a variance on the
property at ~32 E. Hyman. I own the property adjacent and directly
north of ~32 E. Hyman. My property, in which Jake's Restaurant
is located, is 209 S. Galena Street and shares a common wall with
~32 E. Hyman.
I was notified by mail today, Saturday, September 8, 1973
of your hearing, September 13, 1973. I am leaving tomorrow,
Sunday, September 9, 1973 on a long planned vacation for two weeks.
Therefore, I am unable to appear at your hearing. Also, due to
the short notice, on a week-end, I am unable to contact my attorney
before leaving. Therefore, I am writing this letter. I hope it
will adequately state my objections. I would be happy to discuss
these objections in person upon my return if the hearing is delayed.
General Objections:
1. The town is tall enough.
2. Presently there appears to be ample office space unrented.
3. The general feeling of the downtown atmosphere would be
further eroded and darkened.
Specific Objections:
1. I have planned to construct windows on our second floor
(southern exposure) which would look out "on the mountain".
Obviously with this variance there would be no view. I came
to this town to enjoy the mountains, not to look at a brick
wall. Also, monetarily my property loses value by closing
off its present open surroundings.

2. To allow a dominant, non-conforming, non - needed
use to a building and bring injury to an innocent
party does not seem fair.
I appreciate your consideration of this letter.
