NOTICE OF PUBLIC HEARING

BEFORE THE CITY OF ASPEN BOARD OF ADJUSTMENr
TO ALL PROPERTY OWNERS AFFECTED BY THE REQUESTED ZONING OR USE
VARIANCE DESCRIBED BELOW:
Pursuant to the Offi~ial Code of Aspen of June 25, 1962, as amend-
ed, a public hearing will be held in the Council Room, City Hall,
Aspen, Colorado, (or at such other place as the meeting may be
then adjourned) to consider an application filed with the said
Board of Adjustment requesting authority for variance from the
provisions of the Zoning Resolution, Title XI, Official Code of
Aspen. All persons affected by the proposed variance are invited
to appear and state their views, protests or objections. If you
cannot appear personally at such meeting, then you are urged to
state your views by letter, particularly if you have objection to
such variance, as the Board of Adjustment will give serious con-
sideration to the opinions of surrounding property owners and
others affected in deciding whether to grant or deny the request
for variance.

Elaine C. Hodges has contracted to purchase the East
1/2 of Lot 5 and all of Lots 6 and 7, Block 98, Hallam's Addi-
tion to the City of Aspen, from C. B. Mayshark and Helen L.
Mayshark, the present owners of the property. A house is
presently located on those lots.
A survey shows that the said lots consist of approxi-
mately 5,453.86 square feet. Its front line is approximately
62.52 feet, its rear line is 63.08 feet, its west line is
approximately 83.04 feet, and its east line is approximately
91.43 feet. The location and dimensions of the property and
the location thereon of the dwelling is shown on the plat
attached to the Application made to the City Engineer for a
building permit to build a small addition on the house. That
Application and accompanying papers are submitted with the
Appeal to the Board of Adjustment to which this Exhibit A is
attached.
The said property is located in an R6 residential
area. The proposed addition to the house for which a building
permit was applied for and denied is designed to house an
additional bathroom and closet space. This addition will
comply with all maximum height regulations of the Aspen Zoning
Ordinance referred to and the residence with the said addition
will comply with all minimum side yard, front yard, rear yard,
lot width and maximum height regulations applicable to R6
residential districts under the Aspen Zoning Code.
There is presently located on Lots 3, 4 and the West
1/2 of Lot 5, Block 98, Hallam's Addition to the City of Aspen
(the property immediately to the west of the property involved
here), a house which is substantially identical with the house
on the property involved here except that the front door is on
the east rather than on the west. A bathroom with closet space
substantially identical with the addition proposed to be con-
structed on the property involved here was added as an addi-
tion to the house on the said property pursuant to a 1964
building permit.

It appears that a variance from the minimum lot area
of 6,000 square feet applicable to the lots in question under
Chapter 24 of the Ordinances of the City of Aspen will be re-
qui red so as to permit the Building Inspector to issue a buil-
ding permit for the proposed addition. The purpose of this
Appeal is to obtain such a variance.
The granting of the variance sought will not adversely
affect the general purposes of the comprehensive general plan
of the Aspen Zoning Ordinance, will not unduly increase or
contribute to residential density in the area, and will be
entirely consistent with the present appearance and density
of the area. It is requested that the variance sought be made
valid permanently so that the addition sought to be made can
remain on the property. The variance is the minimum variance
that will make possible the reasonable use of the land and
improvement thereon.

tices of the hearing by first class mail in accordance with that
subparagraph (2) to the persons listed which notice, of course,
must be sent by mail at least 5 days prior to the hearing date.
Of course, Mrs. Hodges is very anxious to have the
hearing before the Board of Adjustment as soon as practicable.
I am sending a copy of this letter direct to Mrs.
Graves.
As you know, I am Mrs. Elaine C. Hodges's husband
and am acting for her.
The original signed copy of the enclosed Appeal is
marked with a pencil "x" in the righthand upper corner. The
other copies are xerox copies and it is the original that is
to go to Mrs. Graves.
I am also enclosing a check for $lO payable to Mrs.
Graves as City Clerk to cover the fee provided for in subpara-
graph (3) of subparagraph (c) of Section 2-22. will you please
deliver that check to Mrs. Graves with the Appeal paper and the

Dear Mr. Meyring:
In accordance with our telephone conversation of
today, I enclose herewith original and two copies of an Appeal
to the Board of Zoning Adjustment signed by Richard Wright,
Contractor, and Elaine C. Hodges, Owner.
This Appeal relates to the application of Richard
wright as Contractor for a building permit to make an addi-
tion on the house located on the above property at 615 Gillespie
Street, Aspen, Colorado, which Mrs. Hodges is purchasing.
I understand from our telephone conversation of today
that you believe it is necessary to deny the proposed building
permit because the lot in question consists of less than 6,000
square feet and that you will deny the proposed building permit.
Mrs. Hodges wishes to appeal to the Board of Adjustment but is
uncertain whether the Appeal paper must be signed by her or by
Wright or both, and consequently both have signed it.
Please fill out the lower part of the original Appeal
paper with the information you are required to put on it, at-
tach to the original Appeal paper the building permit applica-
tion and the prints and other pertinent data, and deliver it

Dear Mrs. Graves:
My wife, Elaine C. Hodges, is purchasing a house
in Aspen and through her contractor has made an application
to the Building Inspector for a permit to put a small addi-
tion on the house. The Building Inspector advises us that
he has had to deny the application because of the size of the
lot and, therefore, Mrs. Hodges wants to appeal to the Board
of Zoning Adjustment.
I expect shortly that Mr. Meyring will deliver to
you the Appeal paper with the necessary attachments together
with a check for $lO.OO.
I enclose for your information a copy of my letter
of today to Mr. Meyring. That letter includes a list of the
