The subject Lot is situated in the R-6 Residential District which requires a mlnlmum
lot area of 6,000 sq.ft. and a minimum lot width of 60 feet; _ile this lot conforms
UT the 60 feet frontage and/or lot width it is however lacking 420 sq. ft. below the
6~OOO sq.ft. minimum inasmuch as the depth only measures 93 feet. The lot adjoining
the subject property on the north is in separate ownership and no additional depth
can be acquired by purchase. -
A Variance is therefore respectfully requested whereby Lot # 1. in Block # 4: Okla-
homa Flats, City of Aspen, County of Pitkin, State of Colorado. is declared a Non-
Conforming building site under the R-6-Residential District and its permitted uses
as per the Zoning Code of the City of Aspen Title XI, Section 11-1-5, Subsection (e).

Oklahoma Flats within the Zoning District R-6-Residential. This District has a
minimum square area requirement of 6,000 sq.ft. and a minimum lot width of 60 feet.

The subject lot measures in excess of 7,500 sq.ft. and has a frontage of approximat:ly
60 feet but its actual width measured 900 to its eastern and Mestern side lines is only

Meeting was called to order at 3:00 p.m. by Chairman John Dukes with
Bob Cline, Charles Paterson, Fred Smith and building inspector ~a Clayton
Meyring.
CASE NO. 72 - 14 - RICHARD E. HOLMES
Chairman Dukes read the particulars of the case. Request for variance
of 420 square feet, lot size requirement 6,000 square feet.
Realtor Hans Gramiger was present representing the client. Property in
the R-6 zone, located at 9ka Oklahoma FlatfS. Area served by axaHRX
Na~xRKxHHK one street, which dead ends, and is a narrow street.
Subdivision was platted many years ago and the lots are not the trad-
itional size as the rest of the City. Property would front on Francis
Street. ~ot' meets the 60' frontage requirement, lot ~ 'j 93' in
depth. Mr. Holmes should have the same enjoyment as~roperty ownerR
as the rest of the property owners in the area.
Paula Meyer was present and stated she objected to the request. She
reported that prior to the meeting she received a call from Mr. Mans-
field who stated he would like to see this request tabled at this time
until theiremaining property owners are available and could meet with
Mr. Holmes. Mrs. Meyer stated she would also like to make this request.
This area is unique in that it is still the way it was 60 years ago,
lots of open space and all but one property owner (Mr. Mansfield) have
more than the required lot size for their homes. It is a quiet residential
area. 2~aixpxapHxK~xiHxKkHxaXHaXHKRHHXR~XHxpxapHXK~XaNHHXR. Mr. Holmes
owns 6 lo;ts and question if he intends to build on all the lots? Against
the applitation since no hardship seems to be shown, since Mr. Holmes
has six lots.
~RaixmaH Mr. Cline read the following telegram received by the board.

Mr. Gramiger stated he did not see why the meeti ng should be postponeJ
as all the requirements have been met by the applkant. As relates to
Mr. Mansfiled's telegram, any dwelling built would RXH have to meet the
rear yard setback. The property is zoned R-6 and any property owner
in the netghborhood has the right to build one or two family dwellings.
In considering traffic ciruclation, the only traffic there would be
w_ . I ~ the property owners since it is not a thru street. A deed
restriction could be drafted that would cover the landscaping and
preservation of the trees. Did talk to Mr. MansfiiHd this date and
he stated he would retract the wire if he could buy the lot under
consideration or get together on the architectual control.
Suggestion was made the applicant consider PUD for his property.
Board request to know what the applicant NaRx~HiHg is going to do with
the land.' It was pointed out Gibson Avenue in the area is 20' and
Francis S~reet is IS' wide. Suggestion was made land be deeded to the
RXXHHK City in order to bring the street up to code. Board stated a
plot plan needs to be submitted prior to consideration of this case.
Mr. Gramiger stated a survey is now being conducted of all of Mr. Holmes
land, req~est the case be tabled in order to bring in a plot plan.

Smith moved that the request for variance be denied as no hardship has
been shown. aH in this case. Seconded by Cline. Roll call vote -
Paterson aye; Cline aye; Smith aye; Dukes.aye. Motion carried.
CASE NO. 72 - IS RICHARD E. HOLMES
particulars of the case were read by Chairman Dukes. Request for
variance on frontage on Francis Street.
Mr. Meyring reported he cannot really tell what the frontage is until
the survey is completed. It may meet the requirements.
Mr. Meeker, was present and stated he was concerned about 51 Francis W
Street if this is granted.
Mr. Smith stated the buildable part of the lot is small because of the
steepness of the lot and there presently is no access to the property.
Mr. Gramiger pointed out this is a dead end street.
Suggestionuas made by the Board Mr. Holmes take all of his property, lump
it together and have three building sites,
Chairman pukes stated to the applicant he did not feel the applicant
had investigated all avenues.open to him.
Applicant stated he would withdraw the case.
STAN JOHNSON
Mr. Johnson was present and stated he had been XHHHH recently before
the board of adjustment, now wishes tomove the project 2S' up the
mountain.' Case No. 72 - 11. By moving the project, HixHHxaxiaH
Snark Street could go through for better traffic ciruclation and
skiers easement could be provided.
Commission questioned whether this could be considered without add-
itional notification to surrounding prrperty owners. To be referred
to the City Attorney.
Cline moved to approve the minutes of June 8th as prepared and mailed
by the Secretary. Seconded by Smith. All in favor, motion carried.
Cline moved to adjourn at i 4:S0 p.m., seconded by Paterson. All in
favor, meeting adjourned.
