NOTICE OF PUBLIC HEARING

BEFORE THE CITY OF ASPEN BOARD OF ADJUSTMENT
TO ALL PROPERTY OWNERS AFFECTED BY THE REQUESTED ZONING OR USE
VARIANCE DESCRIBED BELOW:
Pursuant to the Official Code of Aspen of June 25, 1962, as amend-
ed, a public hearing will be held in the Council Room, City Hall,
Aspen, Colorado, (or at such other place as the meeting may be
then adjourned) to consider an application filed with the said
Board of Adjustment requesting authority for variance from the
provisions of the Zoning Resolution, Title XI, Official Code of
Aspen. All persons affected by the proposed variance are invited
to appear and state their views, protests or objections. If you
cannot appear personally at such meeting, then you are urged to
state your views by letter, particularly if you have objection to
such variance, as the Board of Adjustment will give serious con-
sideration to the opinions of surrounding property owners and
others affected in deciding whether to grant or deny the request
for variance.
The particulars of the hearing and of the requested variance are

Aspen Board of Zoning Ad;ustment
August 26, 1971
Meeting was called to order by Chairman Eleanor Hubbard at 4:05 P. M. with
Jerry Hobgood, Remo Lavagnino and Charles Paterson. Also present Clayton
Meyring, Building Inspector.

Application made for a variance of rear yard setback of 10 feet.
Mr. John Eymere was present and stated he did not know exactly how close to the
alley the addition would be, there appears to be about 2 feet between the
existing walls and the alley. The enclosed area will be used for employee
housing.
Mr. Paterson reported he could remember before the zoning ordinance was passed
buildings were built about 2 feet back from the alleys.
Mr. Meyring reported this request is located in the AR-l zone and there are
no requirements for trash storage etc.
Mr. Eymere stated the trash is now being stored to the west of the building.
Right now the space in question is being used for storage, although part of
the walls and roof have been removed. Area in question would be about 22'.2"
x 9' 7". Will be following the existing line of the building.
Hobgood moved to go into executive session, seconded by Paterson. All in favor,
motion carried.
Meeting reconvened into regular session.
Chairman Hubbard explained the problems involved in a decision on a case where
there are only 4 members present and the requirement of an affirmative vote of
all four members.
Paterson moved to approve the variance as proposed because it would be an un~
necessary hardship not to allow improvement, of this space formally covered by
a roof and presently enclosed on three sides. The Board understands that this
space is to be used for housing employees. I feel the granting of this variance
will not adversely affect the neighborhood or the general purpose of the
comprehensive general plan. Seconded by Hobgood. Roll call vote - Paterson aye;
Lavagnino aye; Hobgood aye; Hubbard aye. Motion carried.

Application to build three additional one bedroom units to a non-conforming
use.
