BEFORE THE CITY OF ASPEN BOARD OF ADJUSTMENT
TO ALL PROPERTY OWNERS AFFECTED BY THE REQUESTED ZONING OR USE
VARIANCE DESCRIBED BELOW:
Pursuant to the Offi~ia1 Code of Aspen of June 25, 1962, as amend-
ed, a public hearing will be held in the Council Room, City Hall,
Aspen, Colorado, (or at such other place as the meeting may be
then adjourned) to consider an application filed with the said
Board of Adjustment requesting authority for variance from the
provisions of the Zoning Resolution, Title XI, Official Code of
Aspen. All persons affected by the proposed variance are invited
to appear and state their views, protests or objections. If you
cannot appear personally at such meeting, then you are urged to
state your views by letter, particularly if you have objection to
such variance, as the Board of Adjustment will give serious con-
sideration to the opinions of surrounding property owners and
others affected in deciGing whether to grant or deny the request
for variance.

and its use for emergency vehicles.
I, as Chief of the Aspen Volunteer Fire~ Department, feel that a 14 ft.
right of way may fully suffice to supply ingress and egress for any and
all emergency vehicles through said property.
If you have any further questions or inqu1r1es from concerned parties,
please explain that they can contact me personally and I will be more
than glad to talk with them.

Dear Mr. Gilkey,
Re: Water Service,
C. Maddalone Site.
It is our understanding that the City has agreed to serve the Maddalones
City water through our two-inch water line, if we approve.
It is the intention of this letter to confirm a verbal agreement to allow
the Maddalones to tap our two-inch water service at the point where the
utility easement we have just granted to them crosses our water service.
We understand that a 3/4" water line will be constructed by the Maddalones
to their site at their expense and that the City tap fees will be paid
by the Maddalones.

DEED OF EASEMENT
KNOW ALL MEN BY THESE PRESENTS:
THAT for and in consideration of more than Ten Dollars
($10.00) in hand paid to them, and for other good and valuable
considerations, the receipt and sufficiency of which are hereby
acknowledged, Fredric A. Benedict and Fabienne Benedict (hereinafter
referred to as "Grantors"), do hereby grant, bargain, sell, convey
and confirm unto Patricia E. Maddalone (hereinafter
referred to as "Grantees"), their heirs, representatives and
assigns, a perpetual, non-exclusive easement and right-of-way over
and across the following-described parcel of real property situate in
the Riverside Placer, D.S.M.S. No. 3905, County of Pitkin, State of
Colorado, to wit:
A strip of land lying fifteen (15) feet on either side
of the following described centerline: Beginning at a
point whence Corner No. 9 of said Riverside Placer bears

TO HAVE AND TO HOLD unto Grantees, their heirs, representatives

1. The easement and right-of-way hereby granted and created is
for roadway and utility purposes only, and Grantees shall have no
right to grant to third parties (other than heirs, representatives and
successors in interest) a similar easement and right-of-way over and
across said property or to dedicate said easement as a public road
without the prior authorization or ~onscnt of Grantors.

2. Grantors shall have the right at all times to use said
easement and right-of-way for road and utility purposes, subject to
the approval of Grantees with respect to utility location if such
utilities are installed after a paved road has been constructed over
said easement, and the further right to grant to others a similar
easement and right-of-way over and across said property.
3. Grantees shall have the right at any time (but shall never
be obligated) to construct a paved roadway over and across the
easement and right-of-way granted hereby.
4. Grantors shall not be responsible for any of the costs of
construction, repair or maintenance of said roadway.
THIS Deed of Easement shall be binding upon and inure to parties
hereto and their heirs, representatives and assigns.
IN WITNESS WHEREOF, Grantors have executed and delivered the
