Gentlemen:
I>'e, Mr. and Mrs. William Goodnough, do bareby petition
the Board of Adjustment for tbe City of Aspen for a variance in
set-back requirements under the Zoning Ordinance of Aspen as
follows:
1. A variance to permit the "est wall of the
strocture shown on the attached Exhibit itA" to extend
within three feet siz inches of' the West lot line.
2. A varianee to permit the North line of the
structure shown on said Exhibit It}," to extend to eleven
feet seven inChes of the North property line.
3. J\ veriance to permit an overhang at the eaves
to extend into said set-back area, but not beyond the
property lines in any inltance.
The grounds for this Petition are as follows:
1. We are the owners of Lots A Qnd B, Block 77, City
of Aspen.
2. Said property 11 in the Trou1st Zone and the
varianc.requested are not variances in use. That we
propose the construction of an apertment building upon
said Lots A and B, Block 77.
3. We plan to r..ove the existing building and
utili.e tbe existing foundation for construction of a
new building. Harmony of construction shall be designed
to cCllllplement the uisting structure. on our lots and
tbe ~provements of adjoining property owners. Utili.a-
tion of the extating foundation 11 of condderable econo-
mical benefit to u. and does not adversely affect adjoin-
ing property owners or create traffic ha.ards. Since we
conteaplate ~rov_ent of tbe area, undue bardship will
result if - are not permitted to use the existing founda-
tion which has been approved by our architect, Samuel J.
Caudill, Jr.
The extension of the eaves into a set-back area will
not create public ha.ard or increase fire ha.ard with
respect to adjoining buildings. As to the North lot line,

~rov8lllents on not more than fifty per cent of the North
one-half of the block utend into the fifteen-foot set-
back to the North of our proposed building and except for
the eave over-hang, it is now authorlaed and provided for
in Section 7(B) of the Zoning Ordiunce.

foregoing Petition and bave examined the plot plan attached thereto
as Exhibit 'tA", and we do hereby consent that the proposed ~prove-
ments may be constructed as shown upon the plot plan including the
encroachment into the set-back area of the primary structure and
tbe eaves as may be constructed thereon, and we do hereby waive
notice and consent that the Board of Adjustment may hear said
matter at any time without further notice to us.

Gentlemen:
We, the undersigned, do bereby petition the Board of Adjustment
to permit us to construct fmprovements within the fifteen-foot
set-back area on the front of our lots which are described as
follows:
Lot8~'.i.Qpll and S, in Block 118, in and to the
City and Townsite of Aspen, together with an eighteen-
foot strip of land lying easterly of Lot S.
Tbe grounds for th's petition are as follows:
1. That said construction and extension into the set-
back area will not adversely affect property values within the
area or adjoining said above described property.
2. That due to the manner of construction of the existing
house, it is necessary to extend the additional construction toward
the front ,md that said bouse, as now constructed, was built long
p.ior to the passing of the existing Zoning Ordmnce or any prior
zoning ordinances.
3. Tbat tbe petitioners shall comply with all other pro-
visions of the zoning ordinance. That a hardship exists by virtue
of creation of unusual conditions existing prior to the ownership
of said property by petitioners.
4. That said property lies within the Tourist Zone
and is subject to a fifteen-foot set-back.

Petition for moving building by Bill Goodnough read
by Gene Mason.
Robert Greene read his objections and submitted copies to
members of Board. Greene stated size of structure over-sized
for lot.
Goodnough presented his plans tor Dr. Baxter but not to
Mr. Greene.
Markalumas clarified his original permit subject to
conditions, and approval of adjoining property owners.
Dr. Baxter clarified his position.
Letter of F. D. Glidden read.
Goodnough did preparatory work subject to Markalumas verbal
statements.
After hearing and examining all
permit denied, by F. Kalmes and Paul Ebstrup, quorum.
Next order of business Johnson renovating barn for living
quarters, question of setback, due to no accurate survey on said
lots, Section of nonconforming use read. Clint Stewart consulted,
no immediate objections pending adjoining property owners. Stewart
to give final word. Board approval granted. Ebstrup and Kal.mes
quorum.

for the City of Aspen shall conduct a hearing upon the

1, \OllLLlAM OOODNOUCH, petition the! Board of
Adjustment to grant a variance permitting me to moVe! a
building twenty-four (24) feet in width onto lot C,
Block 119, allowing a projection of t1IO (2) feet into
the setback area on each side line of said Lot C. The
ground. for this petition are as fGUowa:
1. I _ the owner of Lot C, Block 119, City
and Townsite of Aspen, which was platted and in separate
ownership prior to the effective date of Ordinance No.6,
Sede. of 1956, providing for zoning regulations.
2. Said Lot C, Block 119, 1& situate in the
tourist zone and the setback regulations provided by
Section IV of said Ordinance No. 6 provide for a minimum
side yard setback at five (5) feet from the side line for
principal buildings.
3. The owner of lots D and E is J. Sterling
Baxter and the owner of It>ts A and B 18 Robert Green,
and improvements are set upon each of said adjoining
property. No other property owners are required to be
notified as provided in Section X, subparagraph B(2).
That this 18 not a use variance.
4. That the dwelling hou..s set upon the adjoin-
ing property are a substantial distance from the locatIon
of the proposed building I plan to move onto Lot C, and
that therefore 110 unusual fire hazard lIiOuld result by
granting this variance. That I 110W own the building I
plan to move onto said Lot C and that I have incurred
considerable expense in providing for the moving of said
building, and that by reason of these exceptional c1rcun-
stance. and practical difficulty, unnecessary hardship

Hr. Green, the owner of said Lots A and B, extends beyond

Gentlemen:
Terese David respectfully petitions the Board of Adjustment
for the City of Aspen for a variance to permit the within described
property to be used for business purposes and to permit the construc-
tion of additional improvements thereon.
In support of this request, the petitioner respectfully submits
the followinz information:
1. Tha t petitioner is the owner of Lot}', flock 73,
Aspen, and that said property lies within the Tourist
Zone.
2. That petitioner has operated a portion of her
business on said property for a period of time preceding
the passage of the Zoning Ordinance.
3. That petitioner now desires to expand the
improvements upon said property ,in order that her
business, knol>m as 'Terese DaviQil> of ,"spen' may be moved
to the within described location.
4. Tnat the Buildin~ Inspector Eor the City of
Aspen nas denied petitioner a Building Permit on tne
ground tnat the proposed use and expansion of facilities
is a non-conforming use. That there exists within said
block other businesses and that petitioner's business
would not constitute objectionable nuisance and would not
be out of harmony wit" improvements situate within said
block.
j. That a hardsnip exists since petitioner would

P.spen for a variance to pemlit it to use the tract of land on
the Rio Grande Railroad Depot site for a warehouse. In support
of this request, the petitioners respectfully submits the follov-
in[i; informatiun:
1. That the Buildinz Inspector has refused to issue
a buildin3 permit since the land concerned is in the p-6
Zone"
2. That the land involved is across Mill Street
from the present location of the United Lumber Company
buildings, which land is under lease to the petitioner from
the Rio Grande Railroad Company. That the petitioner cannot
submit at this time accurate description, since its leases
have been returned to the Railroad Company for revision in
description, but such revision in description will not
affect the land to be used for the warehouse.
3. That it is necessary that the warehouse be cons-
t~~cted near the railroad trac~s to facilitate unloading
and that a hardship exists and that said area already has
constructed upon it warehouses similar to the proposed
w~rehouse of petitioner.
4. That petitioner will construct its building in
such a manner as to comply with all set-back and safety
requirements and that its proposed building \vill be
substantially constructed in accordance with the attached
Exhibit 'A", which by this reference is incorporated herein
and made a part hereof.

Gentlemen:
With reference to the application of James Moore for a
variance in the zoning laws, so that a filling station can be
built on the northwest corner of Second and Main streets,
I wish to state that I am opposed to the granting of such a
variance.
I am the owner of property on the corner of Center and Main
streets, property in the middle of the block between Center and
First on Main street, property on the corner of Second and
Hyman, and have mortgage interests on property on Second
and Hopkins streets, and also Second and Hyman.
It is my considered opinion that a filling station or any other
type of commercial establislnnent on the northwest corner of
Second and Main street would reduce the land values in the
immediate neighborhood. Furthermore, the granting of a
variance on this corner might open up the residential and tourist
area to other types of commercial establislnnents; and this would
change the whole character of our zoning in this section.

FOR PITKIN COUNTY, STATE OF COLORADO
ORDER GRANTING VARIANCE
The Board of Adjustment of the City of Aspen, Colorado,
at a public meeting held by the Board on June 6, 1958, upon
notice did conduct a hearing to consider the petition of Bob
Lockwood requesting a variance to permit Tourist uses on the
East one-half (E~) of Lot E and all of Lots F, G, H and I,
_Block 58, and to permit off-street parking space for twenty-two

(22) cars in lieu of space for thirty (30) cars as required by
the Zoning Ordinances of said City;
And after hearing testimony, the Board DOTH FIND:
1. That a quorum of the Board was present at said
meeting;
2. That due and proper notice of said meeting was
given to all property owners;
3. That all protestants present were given oppor-
tunity to be heard and written protests were read;
4. That petitioner presented drawings of his pro-
posed improvements upon said lands, all of which have
been filed with the Board.
5. That off-street parking on the westerly portion
of said land substantially complies with the purpose of
the Zoning Ordinances, however, the use of such area for
off-street parking would be detrimental to the owner or
owners of lots to the west thereof, and such use should be
denied; that Center Street is 100 feet in width and can
properly accommodate an adequate number of cars of
persons staying at petitioner's proposed motel or lodge,
if angle parking is used on Center Street without creating
traffic hazards.
6. That petitioner's improvements as shown on the
drawings on file with the Board indicate that only Lots H
and I, Block 58, are necessary for the construction of such
improvements and that Tourist uses should be permitted only
upon said Lots H and I for the reasons following:
A. That the Tourist use of Lots H and I, if
constructed substantially in accordance with
the plans submitted will not adversely affect
property values in said area.
B. That petitioner also owns the East one-
half (E~) of Lot 0 and Lots P, Q, Rand S, Block 58,
which is zoned Tourist and that all of said property
is adaptable for the utilization as a single unit of
land as outlined by petitioner.
C. That petitioner desires to preserve the
planting as now exists wherever possible.
D. That all members of the City Council favor
angle parking on Center Street.
E. That extreme hardship would result to
Petitioner.
NOW, THEREFORE, IT IS ORDERED:
l. That petitioner shall not be required to provide
off-street parking.
2. That petitioner may construct a motel or lodge
upon Lots H and I, Block 58, Aspen; providing such improvements

substantially conform to the plans submitted by him,
and that said Lots H and I, Block 58, Aspen, may be used
for motel or lodge uses.
3. That this Order shall become permanent providing
petitioner completes his construction in accordance with
said plans within one year from the date hereof.
4. That a copy hereof shall be delivered to the
Building Inspector for the City of Aspen, and that he
is hereby authorized to issue such permit subject to
the terms of the Building Code for the City.

I appreciate your sending me the notice of the hearing set
for Friday, J\Dle 6, and concerning the proposal for a zoning
variation involving some of the lots on Bleeker Street
at the east end of Block 58.
It is my understanding that this property is now zoned
"residential" and that the hearing is for the purpose of
obtaining a variation or deviation to the existing zoning
limitations so as to permit a zoning classification of
"tourist."
If this is the case, I would like to go on record as being
unalterably opposed to this variation in the zoning ordinance.
As you know, I have a residence close to the location in
question and I feel that this proposed variation and zoning
would be detrimental to the already established residential
character of the illllllediate neighborhood.
I say this in full recognition that there are some existing
non-conforming uses, namely, the Chalet properties owned and
operated I believe up to recently by the Hotel Jerome, which
1a on Bleeker Street just east of the property in question,
....... the Quakers, north of the proposed location, and Lou
~lie's property, the Poplars, across the street from us.
If I remember correctly, these non-conforming uses were in
existence prior to the adoption of the zoning and, in any
event, because of their individual capacities, are greatly
limited, and I do not believe they constitute any real
threat to the residential and property values of the
neighborhood - but this proposal for the use of Mrs. Brown' s
property appears to be one of considerable magnitude and it
appears to me that this fine location is much more sui table
for a single or multiple family dwelling rather than tourist
or cOllllllercial classification.
I see no point to the establishment of a bona fide zening
ordinance unless it be observed, particularly where the
character of the neighborhood is already established -
such as in this case.

I think this same question came up about a year ago, as I
had a letter from Mr. Doremus dated March 26, 1957, con-
cerning the proposal of a Mr. A. D. Thomson. I wrote to
Mr. Doremus in reply to his letter, asking some questions
before giving him my view on his request, but I never got
a reply. Subsequently, I was told that Mr. Thomson had
abandoned this project in favor of some other investment
and I presume the new owner is now instigating these
proceedings.
As I understand it, Gene, you are the head of the zoning
commission and I don't know whether you are in a position
to represent me in this hearing. If you are, I would be
very happy to have you read this letter to the assembly
or to express my views to them in your own manner.
I note that Clint Stewart mailed this notice of the hearing,
so I am sending him a copy of this letter asking that he
also express my views, as I understand he is counsel for
the Board.
I hope you and Mrs. Mason are in good health and enjoying
the pleasant weather which I understand you are having
(as I just had a letter on some other subject from Clint).
We have had a most remarkable spring season here -- weather
has been really unbelievably good. The only thing about it
is that our business, which normally responds very
sensitively to the weather, has not likewise improved.
It begins to look like this so-called recession is going
to be the order of the day for some time to come.

I just received a notice of a hearing by the
zoning collllllission which involves the request for
a variation for the zoning of Block 58.
This is very close to my home in Aspen in Block SO,
and I llJI\ unalterably opposed to this variation.
Because Gene Mason signed the notice, I have
written him per copy attached, and I don't know
whether he can represent me at the hearing
but I llJI\ sure you can, and I would like to have
my objection as an involved adjacent property
owner read into the record.
I think the original conception of the city and
county zoning is excellent and I see no point
in having it if variations are permitted such
as this one. There should be plenty of locations
left in the Aspen vicinity for these kind of
ventures and located in conformance with the
existing zoning ordinance.

Dear Mr. Glidden:
As per your telephone conversation with Mr. Jim Snobble, I am enclosing
a site plan and floor plan of our proposed motel at the corner of Main Street and
Center Street, Aspen, Colorado.
As you are aware, the lots facing on Main Street are zoned for tourist
and the lots facing on Bleeker Avenue are zoned residential. The front and the
back lots are separated by a 20 foot alley. The following is what we are request-
ing of the zoning commission:
(1) We request that the lots facing Bleeker Avenue (E 1/2 of Lot a~
and all of Lots P, ~, R,' and ~of Block 58) be re-zoned to tourist.

(2) We request that the alley be closed for access from Center Street
and we will provide access to the alley through our parking lot from Bleeker
Avenue. As you will note from our plan, we do not plan to build any buildings
over the alley but merely to landscape this area, and therefore a power line
and utilities that are in the alley would not be disturbed and would be avail-
able for maintenance work.
(3) I believe we have observed all set back requirements, with the
exception of the 2' minimum rear yard. We would like to put the rear line of
our building on the rear property line, which is coincidental with the alley
line, in order to provide more room at the front of the building. We do not
feel that this particular item is an absolute necessity, however, we do think
it would make the over all plan of the motel better, both from our point of
view and also the City of Aspen.
(4) Your zoning restrictions require one parking space for every
motel unit. I would interpret this to" mean that one parking space be provided
within the property lines for each unit. At the present price of land in Aspen
I believe that this is rather prohibitive. We propose the following for parking
at our motel.
(a) We would provide parking for 22 cars inside the property
lines, with entrance from Bleeker Avenue. We propose to park 15 cars by angle
parking on Center Street. As you probably are aware, Center Street is a 100'
street, thus leaving ample room for angle parking on this street. I believe
that Center Street and Main Street are the only 100' streets in town. We are
also providing on Center Street parking space for 4 cars when they arrive at
the motel, for registration, unloading or baggage, and so forth. Under this

parking plan it would not be necessary for any cars to park on Main Street,
even though the motel might be filled. As we are building 30 units and would
be providing parking for 41 cars, and the national average of motels is gen-
erally .6 car for each unit occupied, we should be providing more than twice
as much parking as would generally be necessary for the motel.
We plan to retain the beautiful Pine trees on the rear of the property
and any of the other landscaping that we possibly can. At the present time we
do not have any elevations or delineations of the motel but you may be assured
that the general architecture will be in keeping with the type of buildings
being built in Aspen. As soon as elevations are available I will forward same
to you. You will note that we have kept all our buildings as far back off
Main Street as possible to keep from having congestion at this area, and I
believe will make a nicer appearance as you drive into town, rather than
pushing the buildings up close to the property line.
Our proposed expenditure on this motel, including the land, buildings,
and other expenses, will be approximately $250,000.00. We have this land under
option until May 29, 1958 and as the re-zoning and other questions we have re-
quested are quite important to us in the purchasing of this property, anything
you might do to expedite the answers to our above requests would be greatly
appreciated. If there are any fees involved in any of the above, if you will
kindly notify me of same I will send a check to you by return mail.

ORDER
The Board of Adjustment for the City of Aspen convened
March 13, 1957, at the City Hall, to consider the Petition of
Robert L. Kopp and Martin J. Cerise requesting permission to
erect a metal building upon Lots K, L, M, Nand 0, Block 100,
City and Townsite of Aspen.
The Board finds:
1. That~. notice was given as required by Ordinance
No.6 (Series of 1956),
2. That Robert L. Kopp and Martin J. Cerise are the
owners of;
All of Lots K, L, M, N and 0, Block 100, City and
Townsite of Aspen, County of Pitkin, State of Colorado,
3. That the petitioners were denied a building permit
by the Building Inspector and the City Council of the City of As-
pen under Section IX of the Building Ordinance for the City of
Aspen and that the above described property lies within the bus-
iness zone of the City of Aspen,
4. That this Petition is before the Board of Adjust-
ment on an Appeal from the findings and orders of the Building
Inspector and the City Council for the City of Aspen,
5. That the Board of Adjustment should deny the issu-
ance of a building permit as requested by the petitioners with
the proviso that the petitioners shall be entitled to submit
additional plans to indicate that the East wall of the metal
building to be constructed by the petitioners can be broken up
in design or architecvure in such a manner as to avoid the ex-
posure of a long, flat and extended East wall,
NOW THEREFORE, the Board of Adjustment does hereby
deny the Petition of the Petitioners requesting the erection
of a metal building upon the within described property for the
reason that the East wall of the proposed structure does not
meet the architectural requirements of Section IX of Ordinance
No.6 (Series of 1956), and that the plans of the new building
do not appear to meet the requirements, intent or purpose of
said Section IX and the erection of said building would not be
for the protection of the health, safety and welfare of the City
of Aspen, providing, however, the petitioners shall have leave
to prepare additional plans to indicate a breaking of design of
the long, flat and extended East wall of said building as shown
on the plans as submitted by the petitioners and that the Board
of Adjustment shall retain jurisdiction over this matter for
further consideration of additional plans, providing the same
are presented to the Board of Adjustment ~thin fourteen (14)
days from the date hereof.

We, the undersigned, being the owners of Lots K, L,
M, Nand 0, Block 100, City and Townsite of Aspen, do hereby
petition the Board of Adjustment to grant us permission to
erect a metal building upon the above described property and to
use the same for the purpose of operating a garage and associat-

The grounds for this petition are as follows:

City and Townsite of Aspen, for the purpose of operating a gar-

The Board finds:
1. That this matter is now before the Board on a re-
hearing pursuant to its Order dated March 13, 1957, which .Order
allowed the petitioners the opportunity to submit further aiIf-
additional plan respecting the breaking up of design of the long,
fat and extended East wall of the proposed structure,
2. That the Board of Adjustment has examined the plans
submitted by the Petitioners and that the Board of Adjustment is
of the opinion that the plans as submitted fully comply with the
architectural requirements of Section IX of Ordinance No.6 (Series
of 1956), in that the East wall shall be broken up in design by a
series of multi-colored plastic panels and that said plans disclose
that they meet with the health, safety and ~elfare requirements of
said Ordinance No.6,
NOW, THEREFORE, the Board of Adjustment does hereby grant
unto the petitioners, Robert L. Kopp and MartiL J. Cerise, permis-
sion to erect a metal building upon the above described property,
providing the same shall comply with the plans and specifications
heretofore submitted by the petitioners and the Board does hereby
direct the Building Inspector to issue a building permit for the
erection of said building and that a copy of this Order shall
be sent to the Building Inspector and the City Council for the
City of Aspen.

applicant to construct an additbn to his existing building situate
on Lots A and B, Block 77, Aspen Townsite in accordance with the
plans prepared and submitted by applicant. That the Building In-
spector refused to issue a permit to erect said building for the
reason that the construction thereof would be contrary to the set-
back requirements under the zoning ordinances for the City of As-
pen. That said lots are located in the tourist zone and the appli-
cant herewith appeals from said refusal for the following reasons;
1. That applicant desires to construct said new building
to the alley property line to conform to existing construction in
the area.
2. That said construction will not impede or affect the
use of the alley in said Block 77.
3. That said construction will provide for the economical
development of the prope rty and will pl rmi t greater air space and
view for existing buildings.
4. That the construction and design of said building will
conform to reasonable requirements established for structures with

Kingsbury Pitcher requesting approval of the Board to extend
within three (3) feet of the adjoining lot line on the west
side of the property described herein.
The Board FINDS:
1. That due notice was given as required by Ordinance
No.6 (Series of 1956),
2. That Kingsbury Pitcher is the owner of:
East one-half of Lot L and all of Lot M,
Block 55, City and Townsite of Aspen, Courty
of Pitkin, State of Colorado,
said property lies in the Tourist Zone.
3. That Mr. Pitcher started construction prior to the
effective date of Ordinance No. 6 (Series of 195~, and that the
structure is less than five (5) feet from the west sideline of his
property,
4. That exceptional conditions exist and unnecessary hard-
ship would result due to the construction heretofore.
NOW, THEREFORE, the Board of Adjustment does hereby grant
the request of Kingsbury Pitcher to construct the building less
than five (5) feet from the west sideline of the above described
property and said variance shall be valid until said structure is

Your Petitioner, Kingsbury Pitcher, pursuant to
Ordinance No.6 (Series of 1956), City of Aspen, hereby requests
that a building permit to remodel, or otherwise add to, his exist-
ing residence located at l26 W. Francis Street, Aspen, Colorado,
in the following manner:
Construct a dining room addition, as is more
specifically described by the attached sketch.
In support of said request, your Petitioner respectfully
states:
l. That said addition requires approval of your Board,
as it will extend to within three feet of the adjoining lot line.
2. That said addition will be constructed in conformity
with the existing dwelling.
3. That the owner of the adjoining property, Walter P.
Paepcke, affected by this proposed construction, has heretofore
indicated no objection to such construction.
4. That said addition is necessary to Petitioner's
home, will materially increase the value of his property, and will
not adversely affect the surrounding neighborhood.
WHEREFORE, your Petitioner requests approval of your
Board of the proposed construction and the issuance of the building
permit.
