HomeMy WebLinkAboutresolution.council.053-13 RESOLUTION #53 (Series of 2013) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ASPEN, COLORADO, APPROVING A CONTRACT BETWEEN THE CITY OF ASPEN, PITKIN COUNTY, AND HOLY CROSS ELECTRIC AUTHORIZING THE CITY MANAGER TO EXECUTE SAID CONTRACT ON BEHALF OF THE CITY OF ASPEN, COLORADO. WHEREAS, there has been submitted to the City Council a contract for the joint trench installation of electric conduit and the reuse waterline along AABC 200 Road extended to the Holy Cross Substation site, between the City of Aspen, Pitkin County and Holy Cross Electric, a true and accurate copy of which is attached hereto as Exhibit "A"; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ASPEN, COLORADO, That the City Council of the City of Aspen hereby approves that Contract for the joint trench installation of electric conduit and the reuse waterline along AABC 200 Road extended to the Holy Cross Substation site, between the City of Aspen, Pitkin County and Holy Cross Electric, a copy of which is annexed hereto and incorporated herein, and does hereby authorize the City Manager to execute said agreement on behalf of the City of Aspen. Koch, City Clerk CONSTRUCTION AGREEMENT This Construction Agreement is made this 15th day of May, 2013 between HOLY CROSS ENERGY ("HCE"), whose mailing address is P.O. Box 2150, Glenwood Springs, CO 81602 and Pitkin County ("County"), whose mailing address is 530 E. Main St. 3rd Floor, Aspen, CO 81611 and City of Aspen ("COA"), whose mailing address is 130 S. Galena St., Aspen, CO 81611. WHEREAS, County has initiated a storm water drainage project, which requires HCE to relocate a portion of its underground electric facilities, which are installed in private property near the Aspen Airport Business Center Subdivision as shown in Exhibit A; WHEREAS, COA has initiated a project to install a new underground electric conduit system along the same alignment as the relocated HCE facilities; NOW, THEREFORE, in consideration of the obligations stated herein, HCE, County and COA agree as follows: 1. HCE and COA will work jointly to produce a bid document that meets COA standards and is acceptable to HCE. 2. HCE and COA agree to share the cost as shown in the cost breakdown attached; Exhibit B. HCE and COA to furnish their own conduit respectively. 3. HCE, County and COA will evenly(1/3 to each entity) share the cost of the trench excavation, backfill and compaction to install said electric conduit system, the trench excavation, backfill and compaction cost shall be listed as a separate bid unit in the project bid document. 4. County shall provide grade stakes for the excavation contractor to base trench depth on. 5. County shall be responsible to resurface the road to meet their needs for the storm water drainage project. If County is unable to complete the storm water drainage project in this portion of the project area in 2013, County will be responsible to resurface the road to acceptable temporary surface for the duration of the winter season.
