HomeMy WebLinkAboutresolution.council.004-20 RESOLUTION NO. 4 (SERIES OF 2020) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ASPEN, COLORADO, DESIGNATING THE PUBLIC PLACE FOR POSTING NOTICES OF PUBLIC MEETINGS. WHEREAS, The City Council of the City of Aspen, Colorado, deems it in the public interest to provide full and timely notices of all its meetings; and WHEREAS, the Colorado state legislature amended the Colorado Open Meetings Laws, C.R.S., Section 24-6-401, et seq.,to relieve a local government of the requirement to physically post meeting notices; and WHEREAS, pursuant to such amendment set forth in C.R.S., Section 24-6- 402(2)(c)(111), as of July 1, 2019, a local public body shall be deemed to have given full and timely notice of a public meeting if the local public body posts the notice, with specific agenda information if available, no less than twenty-four hours prior to the holding of the meeting on a public website of the local public body; and WHEREAS, the City of Aspen maintains a website and currently posts within such website, consistent with Section 24-6-402(2)(c)(III), notices of all meetings of the "local public body," which is defined by C.R.S. Section 24-6-402(1)(a)(I), to include "any board, committee, commission, authority, or other advisory,policy-making, rule- making, or formally constituted body of any political subdivision of the state and any public or private entity to which a political subdivision,or an official thereof, has delegated a governmental decision-making function but does not include persons on the administrative staff of local public body;" and WHEREAS, pursuant to C.R.S. Section 24-6-402(2)(c)(III)the local public body shall designate a public place within the boundaries of the local public body at which it may post a notice no less than twenty-four hours prior to a meeting if it is unable to post a notice online in exigent or emergency circumstances such as a power outage or an interruption in internet service that prevents the public from accessing the notice online; and WHEREAS, C.R.S., Section 24-6-402(2)(c)(1) requires "all public bodies" subject to the requirements of the law to annually designate the place for physically posting notices of public hearings, if physical posting is required. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ASPEN,COLORADO,THAT: Section 1. Full and timely notice of a public meeting held by the City Council of the City of Aspen and each meeting of any other board, committee, commission, authority, or other advisory,policy-making, rule-making, or formally constituted body of the City of Aspen, shall be deemed to have been given by posting the notice, with specific agenda information if available, no less than twenty-four hours prior to the holding of the meeting on a public website of the City of Aspen. The notice shall be accessible at no charge to the public. In the event of exigent or emergency circumstances, as defined in C.R.S. Section 24-6-402(2)(c)(III), notice of a public meeting shall be posted by the City Clerk at least twenty-four hours prior to the holding of the meeting in the front vestibule of City Hall, 130 South Galena Street, Aspen,Colorado. Section 2. The City Clerk shall notify each board, committee, commission, authority or other advisory, policy-making, rule-making, or formally constituted body of the City of Aspen of the contents of this resolution and the other general requirements of the Colorado Open Meeting Law, C.R.S., Section 24-6- 401 et seq. INTRODUCED, READ AND ADOPTED by the City Council of the City of Aspen on the 14th day of January 2020.
