The requested variance for inflection is due to the natural slope of the site. The adj acent property contains a one story volume on the west side of the adj acent property. The proposed design contains a form that is one story at the front of the structure and the natural slope of the hill exposes the structure and it slopes from a one story element to a two story element. The natural slope of grade is the reason for this variance. Disturbing the grade to meet the criteria for inflection is not a desirable solution for this situation. 2. The requested variance for the double wide garage door is for practical purposes. The door provides easier vehicular access and is designed to appear as two single stall garage doors. Also, the garage is side loaded with respect to the street. This will prevent the door from being viewed directly from the street fagade and will lessen the impact that the door has when viewed from the street. 3. The requested variance for windows located between 9-12 feet is for purpose of design. Since the proposed structure is reacting to the natural slope of the hill, the design has a split level appearance from the street fagade. This approach led to the window locations and helps balance the overall appearance of the street fagade. Without the windows in the proposed locations the design would appear too tall and out of balance when viewed from the street. ATTACHMENT 5 REVIEW STANDARDS B. The proposed design more effectively addresses the issue or problem a given standard or provision responds to. The variances being requested all address the problem a given standard responds to. The variance for inflection is needed due to the natural slope of the site. As drawn, the design appears to meet the criteria for inflection when viewed directly from the street. It is only when the proposed design is viewed from the side that the structure begins to appear as a two story element due to the natural slope of the grade. The design of the double stall garage door appears as two single stall doors, even though it is a double wide door. Since the garage is side loaded, the design of the door and it being perpendicular to the street both design criteria lessen the impact of the door when viewed from the street. The windows that are located between 9-12 feet address the purpose of the standard because they are located on a spilt level that changes their actual height above grade. Since the design incorporates a split level design, the windows do not appear in the same location from the exterior as they would if they were in violation on a different structure. The split level allows the windows to look as if they are in accordance with the standard because they are in the correct proportion with the massing of the structure. MINUTES Erickson moved to approve the minutes of June 5, 2001; seconded by Tygre. All in favor, motion carried. CONFLICTS OF INTERESTS None were declared COMMISSIONER COMMENTS 1. Erickson asked the status of the right-of-way issues and of the Caribou encroaching in open space. Joyce Ohlson, community development department, told the Commission staff has written a letter to Harley Baldwin, owner of the Caribou, giving him 30 days to submit a land use application or to take the structure down. Ms. Ohlson said there has been an enforcement action on the real estate signs in the right-of-way on East Cooper across from City Market. If the signs are moved back into the right-of-way, owners of signs will be cited into Municipal Court. Erickson said there are more signs in the right-of-way on East Cooper Avenue farther east than City Market. Ms. Ohlson said she would have staff follow up. 2. Roger Haneman brought up the Buttermilk intersection and the lack of a 4-way stoplight. CDOT gave P&Z 8 reasons why they couldn't install a stoplight and their best argument was utility locations running through the hill right next to the road. Haneman noted that hill has been demolished and he would like to know CDOT's problem with a 4-way intersection at Buttermilk. Blaich said part of the issue is the lawsuit with Maroon Creek and the settlement for opening up old Stage Road. CDOT does not want a 4-way intersection at Buttermilk and is not willing to install it. 1 Aspen Planning 3 ming Commission Julv 10, 2001 3. Erickson asked about follow up on the trail easement in the city right-of-way behind the U. S. Post O ffice. The access has been blocked because the Post Office has chained off the back of the parking lot. Ms. Ohlson told the Board she would check into this and report back. 4. Blaich told the Commission he attended the City Council meeting last night when they discussed the floor area ratio and house sizes. Blaich noted he reported to Council the lengthy process and at least 4 public hearings P&Z went through to recommend a code amendment on house sizes to Council. Blaich said Council adopted an ordinance on 1 St reading, which takes the land use code back to what existed before Ordinance #56, 2000, was adopted. Council wants to have a work session with P&Z before adopting this ordinance. P&Z recommended July 31st at 4:30 p.m. for this joint work session with Council. 5. Blaich told the commission there was a discussion on the commercial space at the 7th and Main affordable housing project. The issue is whether the establishment can change the ordinance in order to meet the food requirement and serve delicatessen-type food. Blaich reported the tenants are going to meet with the city attorney to see what can be worked out. Erickson noted the P&Z was not in favor of the commercial space in this project from the beginning. 6. Joyce Ohlson, community development department, noted that 629 West Smuggler should be continued to 8/21/02; 1490 Red Butte Stream Margin should be continued to July 17, 2001; and Mobile Home Park Zone District Code Amendment should be closed. 7. Sven Alstrom told Council the volumetric restrictions in the house size are the problem. Beefing up the neighborhood guidelines may solve the house size issue. Alstrom said he would like to see the city promote solar access easements by height and volumes. 629 W. SMUGGLER LANDMARK DESIGNATION Erickson moved to continue 629 West Smuggler Landmark Designation to August 21, 2001; seconded by Tygre. All in favor, motion carried. 2 Aspen Planning & iing Commission Julv 10, 2001 1490 RED BUTTE STREAM MARGIN REVIEW Erickson moved to continue this public hearing to July 17, 2001; seconded by Tygre. All in favor, motion carried. LOT 15, BLOCK G, ASPEN HIGHLANDS PUD AMENDMENT FOR AN ADDITIONAL ADU James Lindt, community development department, told the Commission this is a PUD amendment in order to construct and ADU at 0265 Exhibition Lane, Aspen Highlands Village. Lindt told the P&Z when the Aspen Highlands Village PUD was approved, it only allowed for 10 ADUs to be constructed on lots where the owners were given the approval from Hines Highlands. Lindt noted this would be the 11th ADU. The property owners were to be given certificates on a 1St come 1St serve basis. Lindt pointed out the city would like a PUD amendment to allow an ADU by administrative review for every lot. However, Hines will not sign off on this ADU amendment. There is a letter of support for this ADU from Hines Highlands. Lindt said 1 more ADU would not make much of an impact and ADUs do meet the guidelines of the AACP. Staff recommends approval of this ADU to be built within the dimensional requirements of the Highlands PUD and to be built according to the city' s ADU design guidelines. Buettow asked if this ADU would require a GMP exemption. Lindt said the GMP allotments have been taken care of. Lindt said Hines did not want every free market unit to have an ADU because of the additional density. Ohlson noted this applicant has a right to make this request, and it is supported by Hines Highlands. Staff does not have the right to initiate a PUD Amendment for Aspen Highlands. Blaich opened the public hearing. John McCormick, applicant, told the Commission none of the houses under construction have requested a PUD amendment for an ADU. McCormick said he supports the argument that a house this size generates a need for employees and he wants to put one in this house. Ericson asked if this unit 3 Aspen Planning 3 )ning Commission Julv 10, 2001 meets the light code. McCormick said it does. It is mostly subterranean and is behind the garage. There is no FAR bonus for this unit Blaich closed the public hearing. Tygre moved to approve Resolution #31, Series of 2001, approving the amendment to the Aspen Highlands Village PUD for the purpose of allowing an 11th ADU to be constructed pursuant to the Land Use Code Section 26.520 on lot 15, Block G, of the Aspen highlands Village PUD; seconded by Ericson. Ericson stated he is only voting for this ADU because it is voluntary and it is within the FAR for the free market structure. Erickson said he does not feel this would meet the ADU guidelines if it were for a FAR bonus. Roll call vote; Councilmembers Cohen, yes; Ericson, yes; Haneman, yes; Buettow, yes; Tygre, yes; Kruger, yes; Blaich, yes. Motion carried. Tygre said she would like staff to look into the Clarendon and whether expansion work is being done without P&Z approval. Lindt said there was an insubstantial amendment to bump out the bay windows, and he will look into this and report back. ELECTION OF OFFICERS Blaich told the Commission his term on P&Z is up in December and he does not intend to reapply for P&Z. Blaich suggested the election of officers might be changed to January so that officers are not changing the same time a new Council is being sworn in. David Hoefer, counsel to the commission, noted the Municipal Code requires election of officers in June. Erickson nominated Jasmine Tygre as Chair; seconded by Buettow. All in favor, motion carried. Erickson nominated Eric Cohen as Vice-chair; seconded by Tygre. All in favor, motion carried. 4 Aspen Planning & Iing Commission July 10, 2001 Blaich suggested P&Z members fill in some of his extra committees, like Infill, Burlingame COWOP. Ericson asked staff check to see if there has been a study done on the DEPP work. Ohlson invited P&Z members to the APA conference to be held in Aspen in September. There is a session for planning commission members and 2 excellent plenary sessions. The city will pay the registration fee for P&Z members. Tygre moved to adjourn at 5:50 p.m.; seconded by Ericson. Review shall encourage development and land uses that preserve and protect existing watercourses as important natural features. 26.435.040 C Stream Margin Review Standards states: No development shall be permitted within the Stream Margin unless the Planning and Zoning Commission makes a determination that the proposed development complies with all requirements set forth below: 1. It can be demonstrated that any proposed development, which is in the Special Flood Hazard Area, will not increase the base flood elevation on the parcel proposed for development. This shall be demonstrated by an engineering study prepared by a professional engineer registered to practice in the State of Colorado which shows that the base flood elevation will not be raised, including, but not limited to, proposing mitigation techniques on or off-site which compensate for any base flood elevation increase caused by the development; and > Staff Finding: There will not be any development in the jloodway for the proposed development. 2. The recommendations of the Aspen Area Community Plan: Parks/Recreation/Open Space/Trails Plan and the Roaring Fork River Greenway Plan are implemented in the proposed plan for development, to the greatest extent practicable. Areas of historic public use or access shall be dedicated via a recorded easement for public use. A fisherman's easement granting public fishing access within the high water boundaries of the river course shall be granted via a recorded "Fisherman' s Easement;" and, > Staff Finding Staff does not foresee any impacts regarding this requirement. The Roaring Fork River Greenway Plan recommendations are being met and implemented to the greatest extent possible and a.fisherman's easement granting publicfishing access within the high water boundaries of the river course shall be granted via a recorded "Fisherman's Easement," per conditions of approval, unless one already exists. 3. There is no vegetation removed or damaged or slope grade changes (cut or fill) made outside of a specifically defined building envelope. A building envelope shall be designated 5 m by this review and said envelope shall be barricaded prior to issuance of any demolition, excavation or building permits. The barricades shall remain in place until the issuance of Certificates of Occupancy; and 9 Staff Finding Per the submitted plans, there will not be any disturbance of vegetation outside of the building envelope. The proposed development does not pollute or interfere with the natural changes of the river, stream or other tributary, including erosion and/or sedimentation during construction. Pools or hot tubs cannot be drained outside of the designated building envelope; and > Staff Finding The proposed development shall not pollute or interfere with the natural changes of the river, stream or other tributary including erosion and/or sedimentation during construction and a silt fence shall be placed along the riverside of the building envelope. A drainage plan shall be submitted to the Engineering Department for review, and approval, prior to issuance of a Building Permit. No construction is proposed for the stream banks. 5. Written notice is given to the Colorado Water Conservation Board prior to any alteration or relocation of a water course, and a copy of said notice is submitted to the Federal Emergency Management Agency; and 9 Staff Finding The alteration or relocation of any portion of the watercourse is not proposed. 6. A guarantee is provided in the event a water course is altered or relocated, that applies to the developer and his heirs, successors and assigns that ensures that the flood carrying capacity on the parcel is not diminished; and > Staff Finding This requirement does not apply to the proposed development because no watercourse will be altered or relocated. 7. Copies are provided of all necessary federal and state permits relating to work within the one-hundred-year floodplain; and 9 Staff Finding The will be no development in the one-hundred-year jloodplain. 6 8. There is no development other than approved native vegetation planting taking place below the top of slope or within fifteen (15) feet of the top of slope or the high waterline, whichever is most restrictive. This is an effort to protect the existing riparian vegetation and bank stability; and + Staff Finding There is no development being proposed within the required 15 feetfrom the top of slope. 9. All development outside the fifteen (15) foot setback from the top of slope does not exceed a height delineated by a line drawn at a forty-five (45) degree angle from ground level at the top of slope. Height shall be measured and determined by the Community Development Director using the definition for height set forth at Section 26.04.100 and method of calculating height set forth at Section 26.575.020; and 9 Staff Finding All development is outside the 15-foot setback from the top of slope and does not exceed the height delineated by a line drawn at a 45-degree angle from the ground level at the top of slope per the submitted plan. 10. A landscape plan is submitted with all development applications. Such plan shall limit new plantings (including trees, shrubs, flowers, and grasses) outside of the designated building envelope on the river side to native riparian vegetation; and > Staff Finding A landscape plan was submitted and staff does notforesee any problems related to the plan, however the applicant shall submit a landscape plan to the Parks Department for review prior to issuance of a Demolition Permit or a Building Permit 11. Variance regarding Residential Design Standards: Staff recommends approval for Inflection variance, 2) Doublewide garage door variance, finding that; 1) The property possesses an irregularity in which a waiver is clearly necessary for reasons of fairness. 2) The proposed design represents a more effective manner to address the particular issue in which the standard is intended. Staff is recommending denial of the variance for the windows located in the 9'-12', "No window zone"; finding that; none of the criteria are met. NOW, THEREFORE, BE IT RESOLVED BY THE PLANNING AND ZONING COMMISSION OF THE CITY OF ASPEN, COLORADO ON THE 17th DAY OF JULY, 2001, THAT: Section 1 Pursuant to the procedures and standards set forth in Title 26 of the Aspen Municipal Code, the Planning and Zoning Commission approved a 1) Stream Margin Review and 2) Variances from the Residential Design Standards for Inflection and Double Wide Garage Doors, subject to the following conditions: 1. No vegetation removed or damaged or slope grade changes (cut or fill) made outside of a specifically defined building envelope. A building envelope shall be designated by this review and said envelope shall be barricaded prior to issuance of any demolition, excavation or building permits. The barricades shall remain in place until the issuance of Certificates of Occupancy; and 2. The proposed development shall not pollute or interfere with the natural changes of the river, stream or other tributary including erosion and/or sedimentation during construction and a silt fence shall be placed along the riverside of the building envelope. A drainage plan shall be submitted to the Engineering Department for review prior to construction. 3. A written notice shall be given to the Colorado Water Conservation Board prior to any alteration or relocation of a watercourse, and a copy of said notice shall be submitted to the Federal Emergency Management Agency. 4. A Landscape Plan shall be submitted to the Parks Department for review. Such plan shall limit new plantings (including trees, shrubs, flowers, and grasses) outside of the designated building envelope on the riverside to native riparian vegetation. 5. All exterior lighting shall be low and downeast with no light(s) directed toward the river or located down the slope and shall be in compliance with section 26.575.150. 6. A lighting plan shall be submitted with the Building Permit application. 7. All foundations must be constructed about the water table; therefore the level of the water table, on the riverside, shall be determined and shown on the survey plat. 8. A statement shall be provided from a Colorado Licensed Engineer stating that the proposed development will not cause flooding in adjacent or downstream properties. Section 2 All material representations and commitments made by the applicant pursuant to the development proposal approvals as herein awarded, whether in public hearing or documentation presented before the Planning and Zoning Commission or City Council, are hereby incorporated in such plan development approvals and the same shall be complied with as if fully set forth herein, unless amended by an authorized entity. Section 3 If any section, subsection, sentence, clause, phrase, or portion of this Resolution is for any reason held invalid or unconstitutional in a court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision and shall not affect the validity of the remaining portions thereo f.
