433 W Bleeker St Drywell Variance Request

Jack,
I am requesting a variance for 433 West Bleeker Street regarding setbacks for the proposed drywell. Due
to limitations of the site, the drywell is located within 10’ of the residence and within 10’ of the Alley
Block 37 Right-of-Way. Locations on the site that have potential to meet these requirements are limited
by existing trees. The drywell will not impact the proposed structure on 433 West Bleeker Street.
Criteria from which the applicant seeks a variance.
On page 8-116 of the Urban Runoff Management Plan, it is stated that “drywells must be located at least
10 feet from building foundations.” The center of the proposed drywell is 8’ off the building, however the
edge of the drywell is 5’ away from the foundation wall.
The City of Aspen Engineering Department has also requested that the drywell be located at least 10’
from the Right-of-Way. The edge of the drywell has been placed 5’ from the Right-of-Way to maintain a
larger distance between foundation wall and the drywell.
Justification for not complying with the criteria
The site under development is confined by existing trees to the north of the building and utilities to the
south. The southwest side of the property is uphill of the residence, making the northeast section
preferable for depth. However, the drywell would require removal of existing trees in the northeast. Due
to these limitations, the drywell can only be placed southeast of the residence. The area surrounding the
foundation has been analyzed with a 1:1 slope from drywell perforations. The drywell will not impact the
structure’s foundation.

The neighboring property has an existing house setback 5’ from the property line. The drywell will not
affect the existing structure.

on construction documents and other data shall
not prevent the City of Aspen from requiring the
correction of errors in the construction
documents and other data.
