Mill Street Permit Information: Permit Number: 0012.2019.ACBK Parcel Number: 2737-073-30-002 Owner: Cantina Building LLC Permit Coordinator: Phil Lehue The design documents have been reviewed for conformance with the Land Use Code and the Historic Preservation Design Guidelines as adopted and amended by the City of Aspen. You can find a copy of the Land Use Code and the Historic Preservation Design Guidelines on our website. Attached are the comments for Historic Preservation and Zoning. All comments must be addressed. Please revise and redraw the plans to clearly respond to the comments. Revised drawings must clearly show code compliance. Please resubmit the attached comment letters with your written response to each comment. Your response should indicate which detail or specific page shows the required information. Responses such as “will comply with code” are not adequate. Historic Preservation and Zoning plan check is only one part of the review process by which projects are reviewed for approval. If you choose to begin updating plans prior to receiving comments from all review agencies, you assume the risk of needing to update or otherwise redo your plans. If you have any questions regarding the Historic Preservation comments, please contact Historic Preservation staff. If you have any questions regarding the Zoning comments, please contact Zoning staff. Re-submittal: When all comments from all agencies have been addressed, contact your Permit Coordinator. If all comments have not been addressed, the resubmittal will be deemed incomplete, and will not be accepted. Historic Preservation and Zoning Comments: 1) HP Comment, Plan Sheet A1.0: Blackout film cannot be applied to the windows. Please remove this from the permit. The historic preservation guidelines requires clear glass. The painted gypsum interior wall is permitted. 2) Zoning Comment, Plan Sheet A1.0: The track system door is not equivalent to the existing unit entry door and demising wall. As such, removal of the existing unit entry door and demising wall to accommodate a track door system will convert the entire common hallway into net leasable space. Increase in the net leasable area requires land use approval as set forth in the Pre-application Summary Letter dated January 16, 2019, provided to Leandra Pszeniczny by Sarah Yoon. Alternatively, retain the existing unit entry door, the existing demising wall, and revise the plan accordingly. Please be aware that the land use code language (Reference Section 26.470.090.E.) pertaining to minor enlargement of an historic landmark for commercial, lodge or mixed-use development is anticipated to change in June 2019. For additional information regarding the pending land use code amendment, please contact Historic Preservation Staff. 3) Zoning Comment, Plan Sheet A1.0: Please specify what type of light fixture is proposed in the three windows on the northwest corner of Suite 201, and provide manufacturer cut sheets. 4) Zoning Comment, Plan Sheet MP3.0: Per the City of Aspen Land Use Code Section 26.575.020.F.4, Allowed Exceptions to Height Limitations, "Chimneys, flues, vents, and similar venting apparatus may extend no more than ten (10) feet above the height of the building at the point the device connects". "On structures other than a single-family or duplex residential building or an accessory building, all chimneys, flues, vents, and similar venting apparatus should be set back from any Street facing facade of the building a minimum of twenty (20) feet and the footprint should be minimized to the greatest extent practicable". Any new roof top venting apparatus being introduced as part of this permit must meet this requirement. Please provide detail showing that minimum setbacks are being met, and cross-section renderings with dimensions of new proposed rooftop venting apparatus. Thank you, Amy Simon and Bob Narracci
