These design documents have been reviewed for conformance with the Land Use Code as adopted and
amended by the City of Aspen. You can find a copy of the Land Use Code on our website.
Attached are the comments Zoning. All comments must be addressed. Please revise and redraw the
plans to clearly respond to the comments. Revised drawings must clearly show code compliance. Please
resubmit the attached comment letters with your written response to each comment. Your response
should indicate which detail or specific page shows the required information. Responses such as “will
comply with code” are not adequate.
Zoning plan check is only one part of the review process by which projects are reviewed for approval. If
you choose to begin updating plans prior to receiving comments from all review agencies, you assume
the risk of needing to update or otherwise redo your plans.
If you have any questions regarding the Zoning comments, please contact Zoning staff.
Re-submittal: When all comments from all agencies have been addressed, contact your Permit
Coordinator. If all comments have not been addressed, the resubmittal will be deemed incomplete, and
will not be accepted.
Zoning Comments:
Following are Zoning comments and questions thus far:
1) Please provide an updated Site Plan (Sheet A-2.1 and A-2.3); which shows all new proposed
patios, decks, walks, exterior stairs, the proposed Fire Pit and the hot tub and hot tub deck that
were not included on the prior provided site plan (the hot tub and hot tub deck are reflected on
the Snowmelt Plan Sheet A-10.11 that was provided with this Change Order applicaton), and
update the FAR Calculations, as may be necessary. Also show minimum setback lines, and new
roof line at entry porch, as it appears to be encroaching into setbacks.
2) It appears that the flatwork on the south and east sides of the residence is proposed to expand.
Please provide detail demonstrating that these features are no more than 6” above finished
grade. If any portion is more than 6” above finished grade, then the entire feature will count
towards deck area.
3) Per Section 26.575.020.E.5.m of the Land Use Code, hot tubs, spas, pools, water features, and
permanently affixed outdoor grills, furniture, seating areas, and similar permanent structures,
such as the proposed plumbed fire pit feature, must comply with the code requirements.
4) Any exterior stairs, and decks, such as the hot tub deck, if more than six inches above finished
grade will count towards the deck calculations. Please provide cross-section detail of these
features demonstrating compliance with the land use code. (Section 26.575.020.E.5.m and
Section 26.575.020.D.4).
5) Please provide cross-section detail of the proposed patio and boulder retaining wall
demonstrating that the proposed patio is no more than 6” above finished grade. If any portion
of the patio(s) are more than 6” above finished grade, then the entire feature counts towards
deck area. If the proposed boulder retaining wall encroaches into the minimum required
setbacks, then the 30” rule will apply (Reference Section 26.575.020.E.5.k).
6) Revisions to Sheet A-4.3 are referenced in the Project Narrative for Change Order Dated 11.8.19;
however, this sheet is not included in the Change Order Plan Set.
7) Please provide an updated RDS approval for the changes proposed to the front façade.
