The city has requested HOA approval on the items below Approval from Black Birch Estates, as owners of Tract C, to allow the proposed box culvert to extent into Tract C: ln order to accommodate the proposed driveway, which removes thê existing driveway from Tract C as was approved by the HOA, the ditch is required to be relined and culverted. The existing culvert will be replaced with a box culvert underneath the driveway. The proposed culvert is located in the same location as the existing, which straddles the property line of 1 i 30 Black Birch and Tract C of the Black Birch Estates. Any disturbed area around the new culvert will be revegetated as required by the original HOA approval. ?. Approval from Black Birch Estates, as owners of Tagert Ditch, to allow structures and infrastructure within the ditch easement. The previously-approved design includes retaining wall structures within the ditch easement to support the proposed driveway. These retaining walls are required by code for safety and provide fall protection for pedestrians and vehicles into the ditch. The City of Aspen Ëngineering Department is requesting HOA approval for these two items. Please provide written approval for the structures within the ditch easement and the replaced culvert, which are consistent with the original design drawings.
