APPLICANT: Gorsuch, LTD, Manager Jeff Gorsuch, represented by Tom Frye
SUBJECT & SITE OF APPROVAL: The applicant is requesting approval for an
Insubstantial Amendment to a Planned Development and Minor Expansion of commercial,
lodge, or mixed-use development (26.470.090.F) to add approximately 27 square feet of
net leasable space in a proposed consolidation of existing commercial units.
EXISTING CONDITIONS: The subject site is located on the ground floor of the North
of Nell Condominiums. Currently the space is composed of two separate commercial units
that are separated by a demising wall. The demising wall appears on the most recent Plat
from 2009. Prior to the proposed project, the spaces were occupied by the Gorsuch Cafe
and shop, and a separate bike/ski rental shop.
SUMMARY: The proposed project combines two distinct commercial areas through the
removal of a demising wall. The Gorsuch Cafe will incorporate the new area into their shop
and will be used for ski rental/service. The removal of the demising wall will add
approximately 27 square feet to the commercial net leasable area (the length and width of
the removed wall). No additions to Floor Area are proposed.
STAFF EVALUATION: The important aspect of this review is confirmation that any
additions to the net leasable square footage remain below a cumulative 500 square feet.
The proposed remodel in this application would add approximately 27 square feet to net
leasable space. Staff's review of the building as constructed, the interior changes that have
happened since, and the current use of the building show no other additions to net leasable

area since a redocumentation of floor area occurred as part of a 2009 land use approval.
Additionally, the proposed change meets the review criteria for an Insubstantial
Amendment to the Planned Development. See Exhibit B for further discussion of the
criteria.
As depicted, the removed wall will add 27 square feet of additional net leasable. This
approval assumes that the 27 square feet is an accurate representation, but if actual
calculation of the area occupied by the demising wall varies from this number, this approval
remains in effect and the actual calculation will be documented in the building permit for
the tenant improvements.
DECISION: Staff finds the application for an Insubstantial Amendment to a Planned
Development and Minor Expansion of commercial, lodge, or mixed-use development
(26.470.090.F) meets the review criteria, and hereby APPROVES the applicant's
addition of approximately 27 square feet to the net leasable space to the commercial
building at the North of Nell building, 550 E. Durant Avenue.
