Purpose:
The Community Development Director is issuing this Administrative Determination to
specifically enumerate the allowable Floor Area Ratio (FAR) for 212 Lake Avenue
Condominiums, Units A and B, Aspen (the "Property"). The Property was formerly known as
Lot 18, Shaw WPW Subdivision Exemption.
Background:
In 1977, the City Council placed a 0.3:1 FAR limitation on the Property to prevent very large
structures from being built. At that time, the zoning would have allowed for a home of up to
16,000 square feet. In 1981, the owner of the property requested that this FAR limitation be
changed from 0.3:1 to 0.4:1. According to the City Council meeting minutes from June 8,
1981, the planning office recommended approval, and Council granted this request. This
revised FAR limitation is set forth in Note #2 on the First Amendment to the Plat for the
Shaw WPW Subdivision Exemption, which was recorded in Plat Book 11 at Page 97 on
August 31, 1981. A copy of the Plat and the City Council meeting minutes are attached.
Determination:
In accordance with the procedures, standards and limitations of Title 26, this Administrative
Determination acknowledges that the City agrees that the allowable FAR for th Pro er is _
0.4:1, measured and calculated in accordance with current codes, as may be a �
time to time. All other zoning provisions applicable to the property shall be in accordance
