FAR (FLOOR AREA RATIO)
1. THESE DRAWINGS AND ANY ACCOMPANYING SPECIFICATIONS, AS
INSTRUMENTS OF SERVICE, ARE THE SOLE PROPERTY OF THE ARCHITECT
REGARDLESS OF WHETHER THE PROJECT FOR WHICH THEY WERE PRODUCED IS
CONSTRUCTED OR NOT. THESE DOCUMENTS ARE NOT TO BE REUSED OR
REPRODUCED IN ANY FORM OUTSIDE OF THE PROJECT CONTRACT WITHOUT
WRITTEN AUTHORIZATION FROM THE ARCHITECT.
2. THE CONTRACTOR SHALL BE RESPONSIBLE TO INSURE THAT CONSTRUCTION
CONFORMS TO ALL FEDERAL, STATE, LOCAL AND RELATED CODES AND
PRACTICES. SKILLED AND QUALIFIED WORKMEN IN THEIR ASSOCIATED TRADES
SHALL PERFORM ALL WORK AT THE HIGHEST STANDARD OF CRAFTSMANSHIP.
3. THE ARCHITECT WILL PROVIDE DETAILS AND/OR DIRECTION FOR DESIGN
INTENT WHERE IT IS NEGLECTED IN THE DOCUMENTS OR ALTERED BY EXISTING
CONDITIONS.
4. THE CONTRACTOR SHALL VERIFY ALL DIMENSIONS AND CONDITIONS
DEPICTED IN THESE DOCUMENTS AND SHALL NOTIFY THE ARCHITECT OF ANY
DISCREPANCIES, OMISSIONS, AND/OR CONFLICTS PRIOR TO PROCEEDING
WITH THE WORK. ALL DIMENSIONS ON STRUCTURAL DRAWINGS SHALL BE
CHECKED AGAINST ARCHITECTURAL DRAWINGS. NOTIFY THE ARCHITECT AND
ENGINEER OF ANY DISCREPANCIES PRIOR TO PROCEEDING WITH THE WORK.
5. DO NOT SCALE DRAWINGS. THE DIMENSIONS SHALL TAKE PRECEDENCE
OVER SCALED DRAWINGS.
6. THE CONTRACTOR SHALL BE RESPONSIBLE FOR PROVIDING ALL TRADES
UNDER THEIR AUTHORITY WITH DRAWINGS AND/OR SPECIFICATIONS.
7. THE OWNER AND/OR ARCHITECT SHALL APPROVE ANY “EQUAL” MATERIALS,
EQUIPMENT, FIXTURES, ETC. PRESENTED BY THE CONTRACTOR. THE
CONTRACTOR SHALL SUPPLY THE ARCHITECT AND/OR OWNER WITH SAMPLES
OF ALL FINISH MATERIALS AND SHALL NOT PROCEED WITH INSTALLATION UNTIL
THE ARCHITECT AND/OR OWNER ISSUES AN APPROVAL. ALL WORK MUST
CONFORM TO THE APPROVED SAMPLE. THE CONTRACTOR SHALL FORWARD
ALL REQUIRED SUBMITTALS AND VERIFICATIONS TO THE ARCHITECT WITH
ADEQUATE TIME FOR REVIEW AS NOT TO DELAY THE WORK IN PROGRESS.
8. IF REQUIRED, THE CONTRACTOR SHALL PROVIDE THE BUILDING DEPARTMENT
WITH A CONSTRUCTION MANAGEMENT PLAN PRIOR TO OBTAINING A
BUILDING PERMIT.
9. THE CONTRACTOR SHALL SUBMIT SHOP DRAWINGS TO THE ARCHITECT FOR
WINDOWS, DOORS, CASEWORK, METAL DETAILING, STAIRS, FIREPLACE, AND
ANY OTHER WORK NOTED IN THE DOCUMENTS. FABRICATION SHALL NOT
PROCEED ON ANY OF THESE ITEMS UNTIL THE CONTRACTOR RECEIVES
APPROVED SHOP DRAWINGS FROM THE ARCHITECT. ALL WORK SHALL
CONFORM TO THE APPROVED SHOP DRAWINGS.
10. THE DESIGN, ADEQUACY, AND SAFETY OF ERECTION BRACING,
TEMPORARY SUPPORTS, SHORING, ETC. SHALL BE THE SOLE RESPONSIBILITY OF
THE CONTRACTOR AND HAS NOT BEEN CONSIDERED BY THE ARCHITECT OR
ENGINEER. THE CONTRACTOR IS RESPONSIBLE FOR THE STABILITY OF THE
STRUCTURE THROUGHOUT THE DURATION OF CONSTRUCTION AND SHALL
CONFORM TO ALL FEDERAL, STATE, AND LOCAL O.S.H.A. REGULATIONS. THE
CONTRACTOR SHALL BE RESPONSIBLE FOR THE SAFETY AND CARE OF
NEIGHBORING PROPERTIES UNTIL THE PROJECT IS COMPLETED.
11. THE CONTRACTOR SHALL BE RESPONSIBLE FOR REQUESTING BUILDING
INSPECTIONS AS APPLICABLE TO THE INTERNATIONAL BUILDING / RESIDENTIAL
CODE AND LOCAL ORDINANCES.
12. THE CONTRACTOR SHALL COORDINATE ALL OPENINGS THROUGH WALLS,
FLOORS, AND CEILINGS WITH THE ARCHITECTURAL, STRUCTURAL,
MECHANICAL, PLUMBING, ELECTRICAL, AND LIGHTING DRAWINGS. REFER TO
THE STRUCTURAL ENGINEER FOR ALLOWABLE OPENING SIZES / REQUIREMENTS
IN STRUCTURAL MEMBERS.
13. THE CONTRACTOR WILL BE ACCOUNTABLE FOR THE STONE MASON’S
TAKE-OFFS AND WILL ASSUME THE RESPONSIBILITY OF COORDINATING ANY
ITEMS THAT REQUIRE CLARIFICATION DURING THE BIDDING PROCESS.
14. THE ARCHITECT WILL VERIFY IN FIELD ALL LIGHTING FIXTURES, SWITCHES,
MECHANICAL GRILLES, REGISTERS, AND THERMOSTAT LOCATIONS PRIOR TO
INSTALLATION. THE CONTRACTOR SHALL ROUGH-IN LIGHTING FIXTURES AND
ILLUSTRATE SWITCH, REGISTER, AND GRILLE LOCATIONS PRIOR TO THE
ARCHITECT WALK-THROUGH.
15. ALL EXTERIOR PENETRATIONS SUCH AS GRILLES, BOILER FLAPS, ETC. TO BE
COPPER OR ENCLOSED BY COPPER FITTINGS.

ASPEN, PITKIN COUNTY, COLORADO.

WHEREAS, the Community Development Department received an application from
Alan Richman of Alan Richman Planning Services, on behalf of 315 E Dean Associates, Inc.
requesting Temporary Use approval to erect dining yurts on site from December 2018 through
April 14, 2019; and
WHEREAS, the applicant received temporary use approval via Resolution #158, Series
of 2017 to erect various temporary use structures on site fora total of forty (40) days per year;
and
WHEREAS, the applicant received approval for five ,(5) annual recurrences through
2022, with the ability to apply for an administrative approval to be granted by the Community
Development Director for five (5) additional years, through 2027; and
WHEREAS, pursuant to Chapter 26.450.050 of the Land Use Code, City Council may
grant a temporary use approval for up to 180 days, and no more than ten (10) annual recurrences;
and
WHEREAS, the City Council reviewed the application and considered the Temporary
Use proposal under the applicable provisions of the Municipal Code as identified herein, has
reviewed and considered the recommendation of the Community Development Director, and has
taken and considered public comment at a duly noticed public hearing;and,
WHEREAS, the City Council approves the dining yurts, allowing for the temporary use
for one-hundred and thirty(135)days during the 2018-2019 winter season; and,
WHEREAS, the City Council finds that this resolution furthers and is necessary for the
promotion of public health, safety and welfare.
NOW, THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
ASPEN, COLORADO, THAT:
Section 1:
Pursuant to the procedures and standards set forth in Title 26 of the Aspen Municipal
Code, the City Council hereby approves a Temporary Use request to allow the erection of
dining yurts on the subject site, in the Chef's Club Courtyard, for 135 days from December 1,
2018-April 14, 2019, with the following conditions:
1. The applicant is required to comply with all outdoor lighting requirements. '
2. The applicant is required to provide adequate accessible seating per building `code

requirements. The applicant will work with the Building Department and Fire
Department to determine all accessibility requirements and submit that plan with the tent
permit application.
3. The applicant is required to comply with all ingress and egress requirements.
Section 2:
Temporary structures that are approved on a site for a period greater than fourteen (14) days are
subject to growth management review, resulting in affordable housing mitigation. The
applicant received temporary use approval via Resolution #158, Series of 2017 and the 14-day
credit toward the affordable housing mitigation was applied to that request, so the applicant will
be required to mitigate for the entire one-hundred and thirty-five (135) day request. Staff has
calculated the affordable housing mitigation due based on the fees in 2018, as $6,704.64. Fees
must be paid prior to the placement of any structures on the site. The methodology is shown in
Exhibit A.
Section 3:
A tent permit approval, including verification from the Aspen Fire Department that the structure
meets all necessary safety requirements, is required prior to the erection of the temporary structure.
Section 4:
All material representations and commitments made by the Applicant pursuant to the
temporary use proposal as herein awarded, whether in public hearing or documentation presented
before the City Council, are hereby incorporated in such plan development approvals and the
same shall be complied with as if fully set forth herein, unless amended by an authorized entity.
Section 5:
This resolution shall not affect any existing litigation and shall not operate as an abatement
of any action or proceeding now pending under or by virtue of the ordinances repealed or
amended as herein provided, and the same shall be conducted and concluded under such prior
ordinances.
Section 6
If.any section, subsection, sentence, clause, phrase, or portion of this resolution is for any
reason held invalid or unconstitutional in a court of competent jurisdiction, such portion shall be
deemed a separate, distinct and independent provision and shall not affect the validity of the
remaining portions thereof.

Architectural and Engineering
Specifications
The carbon monoxide alarm shall be Kidde Unit Number KN-
COB-B-LS (part number 900-0233) or approved equal. It shall be
powered by three (3) AA batteries (included). The temperature
operating range shall be between 40°F and 100°F (4°C and 38°C)
and the humidity operating range shall be 10% - 95% relative
humidity.
The CO sensor shall be of a fuel cell design and shall meet the
sensitivity requirements of Underwriters Laboratories UL2034
Single and Multiple Station Carbon Monoxide Alarms.
The alarm can be installed on the surface of any wall or table
top following the UL/NFPA/Manufacturer’s recommended place-
ment guidelines.
The alarm shall include a battery lockout system that deters
closure of battery door without using three batteries.
The alarm shall include a test button that will electronically
simulate the presence of CO and cause the unit to go into alarm.
This sequence tests the unit’s electronics to ensure proper opera-
tion. Per UL 2034 requirements, the CO sensor will not alarm to
levels of CO below 30 ppm and will alarm in the following time
range when exposed to the corresponding levels of CO.
70 ppm CO concentration 60 – 240 minutes
150 ppm CO concentration 10 – 50 minutes
400 ppm CO concentration 4 – 15 minutes
The unit shall incorporate 2 LED’s. A green LED will flash once
every 30 seconds to indicate the alarm is operating properly when
power is present. A red LED will pulse to indicate carbon monoxide
has been detected until the device is reset or CO is eliminated.
The alarm shall include a piezoelectric horn that is rated at 85
decibels at 10 feet. When the unit detects carbon monoxide,
the alarm pattern will be four (4) short beeps – followed by
five (5) seconds of silence – followed by four (4) short beeps
with a corresponding red LED flash.
It shall also include a 7-year manufacturer’s limited warranty.
