It is a 3-story building that contains 13 residential units. The proposed boiler room is 66.5 square feet(7 ft x 9.5 ft). The main mass is one-story with a shed roof, and there will be a 3 foot wide enclosure for exhaust pipes extending approximately 10 feet up the side of the building. All materials will match those on the existing building. STAFF EVALUATION: The proposed structure will have a minimal visual impact due to its small scale and the existing utility boxes located along the southwest wall. The proposed location for the boiler room encroaches on an existing drainage easement. This easement is owned and maintained by the Aspen Highlands Metropolitan District. The District has provided approval for the proposal and Engineering has stated that drainage will not be negatively impacted by the proposed structure. Staff finds that the review criteria, attached as Exhibit A, are met and recommends approval of the proposed boiler room. Amendment of PUD development order. A. PUD Insubstantial Amendments. An insubstantial amendment to an approved development order for a final development plan may be authorized by the Community Development Director. The following shall not be considered an insubstantial amendment: 1. A change in the use or character of the development. Staff Finding: There is no proposed change in use. The character of the PUD shall be retained and not negatively altered by the new boiler room, as the visual impacts are minimal. Staff finds this criterion to be met. 2. An increase by greater than three percent (3%) in the overall coverage of structures on the land. Staff Finding: The boiler room will be adding 66.5 square feet. The overall PUD already includes approximately 389,138 square feet of development, or 10.719% of the PUD. Then new boiler room square footage increases the coverage to 10.721%, significantly less than a 3% increase in coverage. Stafffinds this criterion met. 3. Any amendment that substantially increases trip generation rates of the proposed development or the demand for public facilities. Not applicable. 4. A reduction by greater than three percent (3%) of the approved open space. Staff Finding: The overall PUD already includes approximately 3,241,109 square feet of space that does not include structure. Then 66.5 square foot new boiler room is not significant enough to reduce the open space by 3%. Staff finds this criterion met. 5. A reduction by greater than one percent (1%) of'the off-street parking and loading space. Not applicable. 6. A reduction in required pavement widths or rights-of-way for streets and easements. Staff Finding: The new boiler room is proposed on top of an existing drainage easement. This easement is owned and maintained by the Aspen Highlands Metropolitan District. Approval has been provided by the District. The City Engineer has also reviewed the proposal and noted that the drainage will not be 'negatively affected by the new boiler room. Staff finds this criterion met. 7. An increase of greater than two percent (2%) in the approved gross leasable floor area of commercial buildings. Not applicable. 8. An increase by greater than one percent (1%) in the approved residential density of the development. No new residential units are proposed as part of this application. Staff finds this criterion to be met. 9. Any change which is inconsistent with a condition or representation of the project's original approval or which requires granting a variation from the project's approved use or dimensional requirements. Staff Finding: The approved dimensions for Building 3 are reflected on the PUD plat as the building envelope. The new boiler room will be expanding the building envelope slightly, but does not create a significant negative impact to the overall appearance of the building. The District has reviewed the plans, the easement, and performed an on-site inspection to determine if there will be a conflict between the District's use of the eased area for drainage and the placement of the boiler and appurtenant covering structure. The District has determined that the existing storm water sewer system is sufficiently distanced from the proposed boiler location that the Districtg can agree to permit the boiler and structure to be placed as designed and located on the Wille Residences application. The proposed room would be a 50-100 sq. ft. one-story structure with a shed roof, located at the southwest side of the building. The lot is located in Block D of the PUD and zoned SKI. The applicant would also like to pursue a waiver from permit fees and/or a housing grant to fund the project. For a PUD Amendment to be approved administratively, one criteria states the proposal must not increase the overall coverage of structures in the PUD by more than 3%. The original PUD notes that the acreage of the PUD is 83.339, or 3,630,247 square feet. Due to the extensive size of the Aspen Highlands PUD, and the cost and time it would take to calculate the existing site coverage, staff recommends the following method to be undertaken for evaluating this criterion. Using GIS building footprints, staff has determined the coverage of structures in the PUD is 389,138 square feet, or 10.72% of the overall PUD. Using these area calculations, the applicant can calculate the increase in coverage proposed by the boiler room. Staff believes these changes can be handled administratively through an Insubstantial PUD Amendment. The Applicant will need to respond to the criteria for Insubstantial PUD Amendments, section cited below. Staff recommends the applicant consult with the Engineering Department as soon as possible to discuss the proposal. The Applicant will also be required to provide a letter of HOA/Architectural Committee approval for the intended changes. A fee waiver request is reviewed by the Community Development Director. A fee waiver form must be submitted prior to building permit or land use application to be considered. The existing residential building is three stories tall.
