DEVELOPMENT ORDER

Community Development Department
This Development Order, hereinafter "Order", is hereby issued pursuant to Section 26.304.070,
"Development Orders", and Section 26.308.010, "Vested Property Rights", of the City of Aspen
Municipal Code. This Order allows development of a site specific development plan pursuant to
the provisions of the land use approvals, described herein. The effective date of this Order shall
also be the initiation date of a three-year vested property right. The vested property right shall
expire on the day after the third anniversary of the effective date of this Order, unless a building
permit is approved pursuant to Section 26.304.075, or unless an exemption, extension,
reinstatement, or a revocation is issued by City Council pursuant to Section 26.308.010, After
Expiration of vested property rights, this Order shall remain in full force and effect, excluding
any growth management allotments granted pursuant to Section 26.470, but shall be subject to
any amendments to the Land Use Code adopted since the effective date of this Order.
This Development Order is associated with the property noted below for the site specific

The property is located in the Medium Density Residential (R-6) zone district with a Planned
Unit Development overlay (R-6/PUD).
SUMMARY: In 1976 the final subdivision plat of Black Swan Hall was approved (Book 5, Page
21) by the city. The plat approved a "4-unit condominium complex," provided a site plan of the
site and included a `Site Data Tabulation' table which provides minimal dimensional
requirement of the project. In 1977, a condominium plat was approved by the city for the
development at Book 5, Page 58. The lack of dimensional requirements for the development is
problematic, as the owners of the property have no baseline to work with if proposing changes to
the property.
The current zoning of the property is R-6/PUD and the underlying zone district does not permit
multi-family residential; however, the city recognizes it as a permitted and approved use for
this property as it was granted approval by the city in 1976 under the R-6/PUD zoning. It
appears, as noted in the application, that few changes to the existing townhomes have occurred
since originally constructed other than an increase in deck size. This approval updates and
defines the dimensional requirements of this property. Any future changes, such as construction
of a deck, shall be required to meet the dimensional standards outlined in this approval and other
applicable sections of the land use code in place at the time of those changes.
STAFF EVALUATION: Staff finds that the request meets the requirements of an Insubstantial
PUD Amendment and that it is in the city's interest to memorialize baseline dimensional
requirements for the townhomes. Developing baseline dimensional requirements will permit the
property to be reviewed under approved dimensions if future development applications are
submitted.
DECISION:
The Community Development Director finds the request to memorialize the dimensional
requirements of Black Swan Hall condominiums is consistent with the review criteria
(Exhibit B) and thereby, APPROVES the amendment as defined below.

Review Criteria and Staff Findings
Insubstantial PUD Amendment.
1. A change in the use or character of the development.
Staff Finding:
Staff does not believe that the proposal will change the character of the development. The approval
memorializes the dimensional standards for 851 Ute Avenue, but the use and character(a fourplex) is
not changing. Staff finds this criterion to be met.
2. An increase by greater than three (3)percent in the overall coverage of structures on the
land.
Staff Finding:
The proposed approval memorializes dimensional requirements for the PUD and does not approve
any development. Staff finds this criterion to be met.
3. Any amendment that substantially increases trip generation rates of the proposed
development, or the demand for public facilities.
Staff Finding:
Trip generation and demand for public infrastructure are not affected by this amendment. Staff finds
this criterion not to be applicable to this request.
4. A reduction by greater than three (3)percent of the approved open space.
Staff Finding:
The amount of open space will not be reduced by this approval which solely memorializes the
dimensional standards applicable to the subject lot. Staff finds this criterion to be met.
5. A reduction by greater than one (])percent of the off-street parking and loading space.

By today's standards the original Black Swan Hall PUD is lacking in important respects.
Specifically, no dimensional accounting was included as a part of the 1976 PUD or recorded Plat.
Dimensional accounting includes an accounting of FAR, building height and setbacks.
As zoning has become more restrictive,four-unit developments are not permitted and
underlying zoning standards within the R6 district provide little guidance for routine requests by owners.
Illustrative examples of this dilemma include, in the context of an interior renovation, locating a new
condensing unit outside platted setbacks(no setbacks exist),or contemplating adding a small amount of
square footage of exterior deck area.
Underlying zoning dimensional standards do not fit this property in a way that makes sense for
their long term maintenance, livability or planning.
FAR
The purpose of the application is to memorialize the existing construction including setbacks,
building height and FAR retroactively while seeking to approve a site specific proposal for modest deck
expansions for three out of four of the units. This application includes an accurate and current
accounting of the existing FAR,and would eliminate the first-come,first-serve approach to managing the
remaining deck area available to the building.
DECKS
This proposal includes a request to add 350 SF of expanded deck area to an existing aggregate
deck area of 628 SF comprising a total of 978 SF of deck area for the Condominium.This site specific
approach to enlarge three out of four decks was done with 100% participation and approval from the
homeowners,designing them individually in all cases. The requested total deck area is 10.8%of the
existing FAR constructed on site. Typically, 15%of the maximum allowable FAR can be built as deck area
and is exempt from FAR calculations. (Ref. City Land Use Code, section 26.575.020)
The current situation has frozen the ability for the owners' of units A,C and D to add exterior
deck area equitably, as the property is considered `non-conforming' with regard to underlying R-6
zoning standards. The maximum exempt deck area of the underlying zone is 15%of max. 5,111 SF of
FAR, or 767 SF of exempt deck area. Additionally,only duplex or single family development is permitted
in R6 with a minimum 6,000 SF of lot area,while the Black Swan is a four unit condominium on a Lot
Area of 17,860 SF.
This application proposes,as well,to limit the total deck area to 978 SF of deck area as part of
the PUD amendment.
Current accounting of the deck areas are as follows:

PUD Plat
Differences that exist today from the original plat include:
a. North facing third floor decks. Although platted,these were never built, and we believe
enclosed during the original construction of the building. No evidence suggests that they were
selectively in-filled over the years without building permits,as no permit records appear for
such work in the building department, nor traces in the skin of the building.
b. South facing Decks. Two of the units, B and D enlarged their decks above and beyond what is
indicated in the original plat, while units A and C retain their original platted deck areas.We
believe these decks were constructed without permits in the 1990's.
Please note these differences have been extant at least since 2005 when WPA first became involved
with the Black Swan Condominiums pursuant to an exterior renovation project that included a new trash
enclosure, landscaping and facade treatments.
Setbacks
This application was initiated by the Owner of Unit A,with approval from 100%of the Homeowner's
Association. The owner of Unit A seeks to add deck area while improving the east side-yard setback
from 2.16'to 5.06' by removing the existing stair into this setback. Maintaining a 5' setback here also
acknowledges public safety access requirements in an emergency. Underlying R6 zoning for a lot area of
17,860sf requires a combined side-yard setback of 50',a requirement that underscores the need for a
PUD Amendment.
Height
The principal building height is 29'-11",while current max height is 25'-0". This non-conformity is offset
by its location on the property effectively mitigating the height issue from the ROW;this application
proposes a front yard setback of 30'which is 20' more than the required underlying R6 zoning minimum
of 10'front yard.
