Hi Jeff – I will confirm at our staff meeting tomorrow with the City Attorney, but I think the City’s position remains that if
the County is supportive of the provenance of the TDR, we will be too.

Hi Ben –
We have located a TDR that we believe satisfies the requirements set forth within the 2005 PUD Control Document
(attached), which would allow us to eliminate the ADU. It is my understanding that the TDR came from a property up

Hunter Creek. I have attached the TDR certificate and the deed restriction that was entered into when the TDR was
severed.
I have been in communication with Suzanne Wolff and she believes that this will meet the requirement per the County’s
interpretation of the 2005 PUD Control Document. Therefore, can you please confirm that this TDR is approved by the
City of Aspen to meet the 2005 PUD Control Document as described above, so we can proceed with its purchase?
We are currently under an expedited due diligence timeline, but I copied Suzanne should you have any questions. I also
copied Curt Sanders, the owner’s attorney handling this transaction.
