HomeMy WebLinkAboutFile Documents.211 Cottonwood Ln.0062.2019 (47).ARBK Association Grant of Rights & Responsibilities Individual Lot Parking Easement Specific Use by Necessity Agreement Date: 1 May 2019 Owner: Barney, Sam Address: 211 Cottonwood Avenue Aspen, CO 81611 Dear Sam, The Board of Directors of the Smuggler Home Owners’ Association hereby grants the above owner the temporary additional right to use Association owned land previously granted as the above lot’s individual parking easement for necessary events related to the construction of a new home on the owner’s lot with a maximum term of this individual use expiring no later than 1 December 2019. This right is in conjunction with and subordinate and subject to any supervening terms and conditions set forth in any Association governing documents. By the right granted herein, the Association retains and does not vacate any of its rights associated with the land whether granted previous to, during, or after this agreement. The grantee of this right also accepts the responsibilities previously associated with the use granted by easement and additionally caused by this grant of use, including but not limited to a requirement to remediate any adverse effect caused by the new granted use to leave the area at or better than its previous state.
