FOR FOX CROSSING SUBDIVISION,LOT 12
THIS INSUBSTANTIAL AMENDMENT TO FOX CROSSING POND 2 GRADING/DRAINAGE PLAN FOR
FOX CROSSING SUBDIVISION,LOT 12,PARCEL ID 273707392012 (this"Amendment")is entered into as of
this day of December,2013 by and between the City of Aspen, Colorado,a home rule Colorado municipality,
and Barry G.Porter and Suzanne T Porter("Owner").
RECITALS
A. The City entered into a Subdivision Improvement Agreement(SIA)for FOX CROSSING SUBDIVISION,
in May 2005. Section 3.11(h) of the SIA required the submission of a "Grading/Drainage Plan" to be
prepared by a Colorado licensed Civil Engineer.
B. A Plan for Lot 12 FOX CROSSING SUBDIVISION, entitled "Fox Crossing Pond 2," dated 25 January
2010 was submitted by J.R. Engineering and stamped received by the City of Aspen Engineering
Department on 7 June 2011 ("the Plan"). The Plan provided for a regional detention pond to serve the
FOX CROSSING SUBDIVISION in the context of approved residential development to occur on Lot 12.
C. Owner is requesting modifications to the Plan based on the intention to have a private park in lieu of
residential development on Lot 12. The private park would result in considerably less impermeable surface
von Lot 12,allowing modifications to the Plan.
X D. The City of Aspen Engineering Department supports these modifications provided that no future residential
development occurs on Lot 12.
w, NOW, THEREFORE, for a good and valuable consideration, the receipt whereof is hereby acknowledged by the
a City,the parties hereto hereby agree to amend the Plan as follows:
A. The Fox Crossing Pond 2 Plan,dated 25 January 2010, is hereby replaced by the following document:
JR Engineering, LLC. Drainage Report for Fox Crossing Lot 12, dated 18 November 2013. The report is
stamped "Reviewed by Engineering December 12, 2013." A copy of this document is attached to this
Insubstantial Amendment. - ,

B. Lot 12 has modified the regional detention to achieve a park-like setting. If Lot 12 is developed in the
future, it will need to restore the detention as approved in the 2010 drainage plan and comply with all other
requirements of the Aspen Municipal Code regarding drainage in effect at the time of the issuance of a
building permit.
