An Ordinance to Prevent Interference With
Radio Reception,
The Council of the Cityof Aspen do ordain
as follows;
Section 1. It shall be unlawful for any
person to operate within the limits of the
city of Aspen, any electrical device
machine, or equipment which needlessly and
unnecessarily causes interference with Radio
reception, when such interference can be
reasonably prevented by meansof repairs,
adjustments, the installation of connective
applicances or other practicable alterations.
Section 2, The administation and enforcement
of this ordinance shall be entrusted to
and imposed on radio inspector (electric
inspector) or other designated municipal
official whose duty it shall be to investigate
complaints of radio interference to locate
the sources of such interference, to advise and
make recommendations as to its elimination, and
who is hereby authorized to issue orders for
such repairs, adjustments, or alterations to
be complied with within a reasonable length of
time, as shall be practicable and reasonably necessary
to prevent the continuance of such interference
Section 3. The radio inspector shall upon
presentation of his badge or other evidence
of his authority, have the right to access
to any premises at any reasonable hour for the
purpose of the inspecting the installation and
operation of any devise or equipment coming
within the provisions of this ordinance, and
it, shall be unlawful for any person to interfere
with such inspector or hinder him in the dischage
of his duties.
Section 4 (1) there is hereby created a Radio
commission, composed of three members appointed
by the Mayor and confirmed by the council for
terms of three years, the term of one commissioner
to expire each year. At least two
members of such commission shall be especially
qualified by their knowledge and familiarity
with electric or radio principles and practices.
(2) It shall be function of the Radio
Commission to serve in an advisory and
general supervisory capacity to the radio inspector in matters
concerning the determination of scientific
facts and reasonableness of judgement
Section 5, Any person violating the provisions
of this ordinance or who shall fail to comply
with the orders of the radio inspector within
the time specified therein shall upon conviction
be punished by fine of not less than $1.00 nor
more than $10.00 each day which such violation
or failure to comply continues shall constitute
a separate offense.
Section 6, This ordinance shall take effect
upon passage and publication, read, passed
and ordered published in the
Aspen Times this 1st day of February A. D. 1941.
