HomeMy WebLinkAboutminutes.boa.19860116 RECORD OF PROCEEDINGS REGULAR MEETING BOARD OF ADJUSTMENT JANUARY 16, 1986 The Chairman and Vice Chairman were absent, therefore, Josephine Mann called the meeting to order at 4: 05 p.m. with members Ron Erickson, Anne Austin and Charlie Paterson present. CASE #86-1 Mrs. Mann read the variance request : "Alteration of sleeping space in a non-conforming structure to make it conform to current building code standards. Property is located in the R-6 zoning category. Rear yard set back is 15 feet, corner lot side yard set back is 6. 6 feet. Applicant appears to be requesting a 1. 67 foot side yard set back and a 12. 45 rear yard set back. Structure is non-conforming as it already extends in to set back. Applicant appears to want to enlarge this non-conformity. Section 24-13. 3 (a) no such non-conforming structure may be enlarged or altered in a way which increases its non-conf ormi ty. " Mrs. Mann opened the public hearing. Don Westerlind was present for the applicant and presented the affidavit of sign posting to the Board. Mr. Westerlind explained the request, to get a better head height and egress windows on the second floor of the back part of the house. The area is being used for sleeping currently. The current head height is 619" at the ridge of the gable roof and they wish to increase that to 7 ' 6" height and install egress windows. Mr. Westerlind outlined the area of the request on the plans. Austin asked if when the building permit was obtained in 1974 for remodeling was there not a set back requirement. Mr. Westerlind replied that it was an existing building that was remodeled. Ron Erickson asked how many square feet the house was now, both with and without the garage. Mr. Westerlind replied the first floor was 2672 sq. ft. , the second floor 897 sq. ft. , and the garage 487 sq. ft. (also included in the first floor total ) . Total square footage is 3082 sq. ft. and the allowed FAR is 3240 sq.ft. Mr. Westerlind added that they will not be increasing the floor area. Erickson asked Bill Drueding, Building Inspector, how a building 1 - - - - - - - - - - - - - - - - - - - - RECORD OF PROCEEDINGS REGULAR MEETING BOARD OF ADJUSTMENT JANUARY 16. 1986 permit could be obtained for a bedroom that does not conform to safety requirements and roof line height. Mr. Drueding was unable to answer. Mr. Westerlind commented that the Uniform Building Code did not call for egress until 1979. Paterson said he did not think what had happened in the past was pertinent to this case. Mr. Westerlind said the practical difficulty in this case was safety, to allow egress windows. Austin asked if the house was a duplex because there was a second kitchen and living room shown on the plans. Mr. Drueding said 2 kitchens could not be allowed. The plans were reviewed in detail. Because there were 2 kitchens shown within the structure Mr. Drueding said the case should be tabled in order to obtain more information as additional variances might be necessary, and have not been noticed for this hearing. Motion- Paterson moved to table Case #86-1 to February 6, 1986, Erickson seconded. All in favor ; motion carried. Motion: Paterson moved to adjourn the meeting at 4: 30 p. m. , Erickson seconded.
