CASE #88-8 (Continued) LEONARD M. & CHERIE G. OATES RECORD OF PROCEEDINGS BOARD OF ADJUSTMENTS AUGUST 25, 1988 Chairman Remo Lavagnino called meeting to order at 4 : 28pm following an on-site inspection at the home of Leonard and Cherie Oates. Answering roll call were Francis Whitaker , Rick Head , Anne Austin, Ron Erickson and Remo Lavagnino. Charlie Paterson and Josephine Mann were excused. MINUTES JUNE 9, 1988 Rick moved that the minutes be approved. Ron seconded the motion with all in favor. CASE #88-8 LEONARD M. & CHERIE G. OATES (Continued) Russell Penning, Architect: We would state at this time that the practical hardship here is that the bathroom is a hallway. I know for a fact that the Oates' s are always having ski club kids staying for days at a time in order to attend the races. Remo: The applicant last week came in with a proposal for enlarging their square foot area to include on their plans what was shown as a porch which, in fact, is the deck. And what they showed as existing is what we are really giving them a variance for. They may need a variance but it is not the variance that they have requested. What they have listed as a 1 story wood frame house with basement is already existing. All they are asking us now, I believe, is to take what they have from their foundation and shown as an existing house to go straight up with walls . I don ' t know whether they need a variance for that. All they are doing, they are taking their existing footprint--what they claim is a 1-story and using it as part of their building. Fred: What I heard is that what they are asking for is to go a little further out . And they are asking you to give them a variance for that. Remo : I would deny that request for a variance on the deck portion. This allows them to do what they really want to do in this portion without having to come to us again for a variance . BAM8 .2 5 .8 8 Ron: The applicant can do this without coming to us for anything. Architect : Bill Drueding said it is increasing the non- conformity. Fred: If you have no opposition to this then I would go ahead and approve a variance for this on that basis. Remo : And it is only non-conforming because it is in an area that is within a setback. Fred: This is the minimum variance that you can give. You are mandated to give that . And you are denying the initial application. You are approving the application subject to modification. MOTION Ron: I move that we grant a minimum variance based on the revised plans presented this week on case #88-8 from the existing foundation up. Francis seconded the motion. Roll call vote: Ron, yes, Anne, yes, Rick, yes, Francis, yes, Remo, yes. MOTION Francis: I make a motion that the Board requests the Planning Director to follow the procedure outlined in Section 10-105 in the new code . The Planning Agency staff shall, as mandatory, review the application, determine its completeness and shall refer its written comments to the Board of Adjustments. Rick seconded the motion. Fred: The reason behind that is so that you don ' t have an application like this where you have less than what you want or need in order to make a determination at the first reading. It is a check-off that could save the Board the inconvenience of having to request additional information. Ron: One of the reasons that we are sitting on this Board is to keep our government in a fairly reasonable size. I would rather make a decision on my own in the future as we have for the last 30 years than force them to do this and then have them say "We need 2 more guys to do this" . 2 BAM8 .25 .88 All voted in f avor of the motion except Ron.
