Answering roll call were Ron Erickson , Rick Head, Charlie Paterson and Remo Lavagnino. Anne Austin and Josephine Mann were excused. CASE #88-11 CITY OF ASPEN ENVIRONMENTAL HEALTH DEPARTMENT CONTINUED PUBLIC HEARING Remo read into the record variance request . ( attached in records) Lee Cassin of the Aspen/Pitkin County Environmental Health Department presented affidavit of posting. She also presented pictures of the project tower. (attached in record) Lee made presentation. (attached in record) There was discussion as to exactly what the height variance was that was being requested. Rick read into record a letter from Elyse Elliott and Jeremy Bernstein, 717 Cemetery Lane stating their support of this project. (attached in record) Charlie read into the record a message from John Carter, 800 Bonita Drive stating his support of the project. (attached in record) Remo read into record letter from Bill Sharp, 595 Cemetery Lane in support of the project. (attached in record) Remo: You might give Bill Sharp a phone call and inform him of what transpired at this meeting. We understand his concern and we are glad that there are citizens out there monitoring all aspects of regulations. Lee said she and Cindy had already done this but would report to Mr. Sharp on the meeting. Also presented into the record was a notation from Bob Anderson stating that he has no objections to the pollution monitoring device. BAM12 .9 .88 NOTION Ron: I make a motion that we approve a 15ft variance above the underlying PUD for a period not to go beyond April 15, 1989 . Rick seconded the motion with all in favor. Carney, ity Deputy lerk 2 The Colorado Health Department and Environmental Protection Agency are requiring that this tower be installed in this location as part of their requirements under the new federal PM-10 regulations. These agencies are requiring that we operate the thermometer and wind vane on this antenna for four and one-half months. This location for the thermometer and wind vane is necessary and this location is the only one that meets the requirements of the EPA and Colorado Health Department, which include the following: these weather sensors cannot be in the City where there are tall trees and buildings. It requires open space to prevent interference with wind measurements. they cannot be on top of a normal building which is heated, since the heat from the building would interfere with the temperature readings. they cannot be farther downvalley because wind speeds and direction would be changed by winds draining down from Maroon Creek, and because the valley opens up so much that winds characteristic of locations near downtown would not be measured. they cannot be away from the center of the valley. Even a location as close as the Marolt property failed to meet EPA standards and be approved because it was too close to Shadow Mountain, where draining winds would interfere with wind measurements. In summary, the EPA and Colorado Health Department have such lengthy requirements about distance toclosest trees, heights of nearby trees, distances to buildings and hills and other obstructions, distance from downtown, location relative to side valleys, etc. , that the thermometer and wind vane are limited to this specific site. It was not possible to find another site either in town or in a more remote location that would be an acceptable site. The Environmental Health Department commits to removing the thermometer and wind vane as well as the, antenna they are on, by April 1, 1989. We have spoken to the most-impacted neighbor and explained to him both the temporary nature of the antenna, and the reasons requiring it to be located here. Galena Aspen, CO 81611 Dear Tom, We will not be able to attend the meeting on December 8 , 1988 regarding the variance for you department ' s monitoring tower . However , we would like you to know that we fully support this request. We have seen the tower and do not find it obtrusive or unsightly. You have explained the reason for its presence, and we support any devices to aid the City' s struggle to comply with federal PM-10 regulations. We hope that you are successful in convincing the Board of Adjustments of the City' s contribution to this essential device.
