BOARD OF ADJUSTMENT JUNE 14, 1990
Chairman Remo Lavagnino called meeting to order at 4 : 05pm.
Answering roll call were Ron Erickson, Josephine Mann, Anne
Austin and Remo Lavagnino. Bill Martin and Charlie Paterson were
excused. Rick Head arrived shortly after roll call.

Doug Alan: Since the meeting of last time I have met with Fred
Gannett the then City Attorney. He has approved the documents
that were required. We needed this time to get proof of the
property line. That has been furnished to the satisfaction of
the past City Attorney and the present City Attorney.
That leaves the issue of the architectural projection. The
architectural projection projects 1/10th of a foot into the
setback--not over the property line.
Remo: Not into City property. But into the setback.
Alan: Right. In fact this adjacent property is Howard Awrey' s.
We have that letter from Howard that he would like it to remain
the same as it was and it is on his side--
Remo: That is already a part of the record.
Alan: Correct. And I have talked to Howard since then and he
re-affirmed that he would like it to so stay the way that it was.
I talked to Bill Drueding a few minutes ago and I will let Bill
speak for himself. But I think we have got a situation here that
is diminimous encroachment--this 1/10th of a foot. We do have an
architectural projection under the old code which is what we are
building under. This building started in 1987 so we are under
the old code and not under the present code.
Bill Drueding: I have made an administrative decision that this
is an architectural projection. But it is still 1/10th of a foot
encroachment. We are not concerned about that. We recommend
that you give the 1/10th of a foot variance.
MOTION
Anne: I move that we grant on Issue #1, case #90-5, a 1/10th of
a foot variance as recommended by the Planning Department.
Rick seconded the motion:

Ron: I have a comment for the record.
If it wasn't for the recommendation from the enforcement officer
that we grant this variance, I would not be in favor of granting
it. I think it is pushing it when we have to get into wasting 10
people's time to come into this meeting to discuss 1. 2 inch
variance and I hold the applicant to blame for that. I don't
want to see this any more.
Roll call vote: Ron Erickson, withhold, Josephine, yes, Rick,
yes, Anne, yes, Remo Lavagnino, yes.
There was one member of the public present. Remo asked if he had
any comment. He had no comment.
Bill Drueding: Submitted for the record a note from Jed Caswall,
City Attorney, Certification of survey and quit claim deed from
Howard Awrey. (Attached in record) .
Remo reminded members of the work session with City Council
regarding powers of the Board.
Anne made a motion meeting be adjourned. Rick seconded the

consideration of Ten and No/100 Dollars ($10. 00) and other good
and valuable consideration, in hand paid, hereby sell and quit

Cantrup: There are some mistakes in the notification. I don't
want to make you type it all over again.
Jan: It is no problem to make corrections on the notification.
It is in the computer and only takes a minute.
He then proceeded to tell me what was wrong in the notification.
I told him I could not change it without direction from Bill
Drueding.
Jan: I just talked to Mr. Drueding 3 minutes ago. I know he is
up in his office right now. You can talk to him about any
changes.
Cantrup then asked regarding when he would be on the agenda. I
told him the agenda was not set at this time. I would talk with
Mr. Drueding about it.
Cantrup: You have to realize Drueding is our adversary. If he
wants us on first, we want to be on last. And if he wants us on
last, we want to be on first.
Cantrup then repeated that "Drueding is our adversary" .
I then asked Cantrup which he would prefer. He talked about
neighbors who would be out of town and be late and he would
prefer to be last.
Walking out of this office he said he would talk to Drueding
later.
