Hopkins) of the Aspen Townsite, creating Lots 1 and 2 Block 46; and WHEREAS, Section 7-1003 A.2.a. The ADU requirement for each lot is a condition of approval for a Lot Split granted by City Council in April 1990. Planning Staff recommends approval of these Conditional Use requests with conditions. APPLICANT: Linda Eller, represented by Bob Schnautz and Fred Alderfer. LOCATION: Lots 1 and 2 Block 46 (s.w. corner of W. Hopkins and S. 2nd St.) ZONING: R-6 APPLICANT'S REQUEST: Conditional Use approval for two accessory dwelling units in two single family residences. PROPOSAL: Lot 1: (West House) Construction of a 530 s.f. (approx.) employee unit in the basement level of a 3 bedroom residence. (Attachment "A") The square footage of the residence will be reviewed at Zoning Check. Lot 2: (East House, corner lot) Building Plans are currently being reviewed for construction of an approximately 3,415 sq.ft. home. The applicant wishes to include a accessory dwelling unit of approximately 525 sq. ft. in the basement level. (Attachment "B" ) REFERRAL COMMENTS: The Housing Authority recommends approval of the Conditional Use and forwards the following comments: 1. The accessory dwelling unit shall contain not less than 300 and not more than 850 square feet of net livable area and be located within or attached to a principal residence. It shall meet the housing designee's guidelines for such units, is required to be deed restricted by Owner, is to meet the definition of a Resident Occupied Unit and be rented for period of six months or longer. The Owner of the principal residence shall have the right to place a qualified employee or employees of his or her choosing in the accessory dwelling unit. Occupancy of the accessory dwelling unit is not mandatory. The tenant shall meet the definition of a working resident and is qualified by the Aspen/Pitkin County Housing Authority prior to occupancy. For purpose of this provision, a unit shall be considered rented if it is occupied pursuant to a lease or rental agreement which requires a payment by the tenant of more than a nominal amount of rent. 2. A plan check to verify the net livable square feet of the unit shall be approved prior to issuance of a building permit and the accessory dwelling unit must meet the definition of "dwelling unit" as per City Code. 3. A deed restriction shall be submitted by the Owner to the Housing Authority for approval prior to issuance of a building permit for the property. This approved deed restriction must be recorded by the Pitkin County Clerk and Recorder's Office prior to the issuance of any Building Permits. STAFF COMMENTS: An accessory dwelling unit is a conditional use in the R-6 zoning district. The Commission has the authority to review and approve development applications for conditional uses pursuant to the standards of Section 7-304: A. The conditional use is consistent with the purposes, goals, objectives and standards of the Aspen Area Comprehensive Plan, and with the intent of the Zone District in which it is proposed to be located. RESPONSE: These proposed deed restricted units will allow the property to house a local employee in a residential area, which complies with the zoning and Aspen Comprehensive Plan. ADU's are encouraged by City Council. B. The conditional use is consistent and compatible with the character of the immediate vicinity of the parcel proposed for development and surrounding land uses, or enhances the mixture of complimentary uses and activities in the immediate vicinity of the parcel proposed for development. RESPONSE: This use is compatible with the other residential uses in the surrounding neighborhood. As they are contained within the principal residences, the units are not visible as separate structures. C. The location, size, design and operating characteristics of the proposed conditional use minimizes adverse effects, including visual impacts, impacts on pedestrian and vehicular circulation, parking, trash, service delivery, noise, vibrations and odor on surrounding properties. RESPONSE: A one bedroom accessory unit carries no parking requirement. No other impacts above that of the main residence Ll 1 should result. D. There are adequate public facilities and services to serve the conditional use including but not limited to roads, potable water, sewer, solid waste, parks, police, fire protection, emergency medical services, hospital and medical services, drainage systems, and schools. RESPONSE: All public facilities are all ready in place for the existing neighborhood. E. The applicant commits to supply affordable housing to meet the incremental need for increased employees generated by the conditional use. RESPONSE: As proposed, and in compliance with rental stipulations. F. The proposed conditional use complies with all additional standards imposed on it by the Aspen Area Comprehensive Plan and by all other applicable requirements of this chapter. RESPONSE: This use complies with the Aspen Area comprehensive Plan and any other applicable conditional use standards. No F.A.R. bonuses are granted to thess parcels as the accessory dwelling units are not 100% above grade. Each unit is approximately 525 to 530 s.f. Four parking spaces are provided on each site, for each 3 bdrm/1 ADU structure. The conditions of issuance are: 1. Hopkins Street Dear Ms. Johnson, Thank you for your assistance in the preparation of the Condi- tional Use Application for the above referenced project. My recollection of the details of our discussion follows: 1. The Conditional Use Permit process predates the enactment of Ordinance 1. It is not possible to avoid this process on the basis that the Lot Split began prior to enactment of Ordin- ance 1. 2. You have stated that Bill Druding will begin the Zoning Review Process concurrent with the Conditional Use Permit Process. Following Bill's review the permit drawings will be forwarded to the Building Department. Depending on the timing of these reviews, a Building Permit may be issued immediately following approval of the Conditional Use. 3. The Conditional Use Application may incorporate a request for both Lot 1 and 2. We are advised that the preliminary design drawings for Lot 2 (west house) will be adequate for this review. We understand that the approval will be speci- fic to this configuration of Employee Unit, ie. Lower Level - 530sf approx. 4. No additional drawings are required for Lot 1 (east house), since complete permit drawings have been provided previously. 5. The requirements for posting a notice on the site, and mailing notices to property owners within 300' of the site will be clarified by Linda Eller. We understand that a 10 day notice prior to the hearing is required. 6. According to current Ordinances it is not required that the accessory dwelling / employee unit be rented out. A deed restriction is necessary, however, providing that if the unit is rented it must be to a qualified resident as defined by the Housing Board. Linda Eller Fred Alderfer • Attachment 2.5 DESCRIPTION OF THE PROPOSED DEVELOPMENT The proposed development consists of two single-family residences which recreate the scale and qualities of a 19th century Victor- ian neighborhood. As directed by Ordinance 1, we propose to provide an accessory dwelling / employee unit within each resi- dence. Our design solution provides each employee unit with separate, private access through a sunken, landscaped courtyard. Abundant daylight and outdoor space are provided with this unit, without adding additional bulk or height to the houses, thus respecting the existing neighborhood and complying with applicable Land Use guidelines. The enclosed schematic design drawings for the West House, and the previously submitted permit documents for the East House indicate a level of quality and character that we believe will compliment and enhance the neighboring properties. It is complete and is now being logged in by the secretary. The only thing I still need is further information on the building setbacks for the "west house." We will continue processing the file, but ask that this information be forwarded to me within a week or two. I am copying the site plan and floor plan for the "east house" from the permit documents already in the Zoning Office. I have scheduled this before the Planning and Zoning Commission on October 2. This is the first date available as the Commission's schedule is extremely full at this time. As I told Bob Schnautz, I have asked Bill Drueding to finish the Zoning plans examination for the "east house." He will then forward the plans to the Building Department so they can also proceed with their reviews. Although this is not normal procedure, we wish to save as much time as possible. After the October 2 hearing, the permit should be ready for issuance upon approval of the conditional use. Bob's letter acknowledged the posting and mailing requirements for the public hearing. The departmental secretary will prepare the letter and send it for you to copy and mail out, just like the lot split notices. We have posters in the department for the applicant to display on the property. I assume Fred will be your local contact for this. Hopkins Street Dear Ms. Johnson, As the architect for the above referenced project I have assisted the Owner, Linda Eller, and the General Contractor, Fred Alderfer in addressing the Building, Planning and Zoning Department re- quirements for construction of two single family residences on this site. In my experience with numerous municipalities I have found that a thorough understanding of the requirements prior to developing design concepts, and open communication with the municipal offi- cials during the design phase can avert delays or cost-overuns. The Owner, Contractor and I have attempted to keep informed of the ordinances and requirements for submission through review of the Aspen Land Use Regulations, and frequent meetings and discus- sions with you and Bill Druding, of your office. Construction Documents for Lot 1 were completed and delivered to the Contractor for submission to Municipal agencies on June 14, 1990. I recognize the additional complexities that the process of a "Lot Split" have incurred, and I understand that the Owner and Contractor have now completed their necessary responsibilities to that end. Based on discussions with Mr. Druding last week I believe that we are well prepared to respond to his concerns, leading to a timely review and release of Building Permit. I am prompted to write this letter to convey my concern regarding an additional review process for Zoning acceptance of the Em- ployee Housing Unit, which was brought to my attention in discus- sions with you August 1, 1990. I am frankly bewildered that this review and public hearing was not identified in your Land Use Regulations or brought to our attention in our many discussions with you and Mr. Druding. Linda Eller is extremely upset concerning the latest zoning disclosure. After each process of the lot split was completed, new requirements, previously unmentioned nor outlined in the written lot split guidlines set out by the city , were disclosed.
