APPLICANT'S REQUEST:
Conditional use approval to operate a restaurant in the Fireside Lodge.
PLANNING OFFICE REVIEW:
The L-3 zone provides for a "restaurant included within a lodge
operation serving guests and others" as a conditional use. When this
provision was included in the L-3 zone, concern was expressed for the
impacts that a restaurant open to the public might have on the surround-
ing neighborhood. Discussion centered on noise, traffic and parking
impacts.
The Fireside Lodge is located at the corner of First and Cooper
Streets. Duplex and multi -family structures are on three sides of the
property, a vacant parcel is the entire block facing the lodge on the
south and the Ice Garden is on the northwest corner diagonally from
this location.
Section 24-3.3 of the Municipal Code sets criteria under which the
Planning and Zoning Commission should determine the suitability of the
conditional use as:
"(1) Whether the proposed use otherwise complies with all require-
ments imposed by the zoning code;
(2) Whether the proposed use is consistent with the objectives
and purposes of this zoning code and the applicable zoning
district; and
(3) If the proposed use is designed to be compatible with surround-
ing land uses and uses in the area."
As mentioned earlier, it was anticipated during the formation of the
L-3 zone that L-3 lodges might want to incorporate restaurant facili-
ties. If the facility is to be open to the public, the traffic,
parking, lighting and noise impacts on the surrounding neighborhood
must be considered.
The restaurant proposed in the Fireside will utilize a downstairs
space which accommodates 60-65 diners and has been used as a restaurant
for over twenty years. The restaurant has been out of operation for
approximately three years and therefore a use permit is needed to
restart the operation. Music will be provided through a taped system
and no live entertainment is proposed. Since this space is located in
the lodge, the applicant recognizes that the noise level must be
maintained at a degree which is not objectionable to guests. The
kitchen will be used for the restaurant and for the preparation of
breakfast for lodge guests.
Hours of operation will begin with apres-ski from 3:30-6:00 P.M. in
the Fireside Lounge, dinner will be served from 6:00-10: 00 P.M. and
the bar will be open from 10 : 00 - 2: 00 A.M. for cocktails. No new

signage or lighting is proposed for the exterior of the building.
The parking available at the Lodge consists of approximately four
spaces in the front, six in the back and on -street parking. Since the
entire block facing the Fireside is vacant, cars could park on the
street without being an inconvenience to residents. The Fireside also
has a drive -through area and entrance canopy where people going to
dinner can be dropped off and picked up. The Fireside is about three
to five blocks from the lifts and downtown. It is anticipated that
many guests at the lodge would not bring cars and many guests coming
for dinner would utilize cab service. Even if twenty to thirty cars
were parking at the lodge and on the street, the relatively light
traffic on these streets and multi -family character of this neighborhood
should be compatible with this use.
PLANNING OFFICE RECOMMENDiATION:
The Planning Office recommends approval of Conditional Use Review and
the issuance of a Conditional Use Permit for the operation of a
restaurant in the Fireside Lodge with the conditions of the Environmental
Health Office (attached memo of 10/21/84) being met prior to opening.

This office has reviewed the above -referenced application and has
no objections to the operation of the Aquitaine Restaurant in an
L-3 zone. However, the following comments are relevant.
Prior to issuance of a Food Service license, the applicant is
required to submit complete plans and specifications to this
office for the areas used for the food service establishment.
Extensive changes are likely to be required. For a seating
capacity of 55, including all bar seating, the following restroom
facilities are required: for women - 2 toilets, I sink, and for
men - toilet, sink and 2 urinals. The applicant is urged to
contact this office as soon as possible to determine what changes
or additions will be required.
The operator will be required to comply with the City of Aspen's
noise ordinance.

Having reviewed the above application, the Engineering
Department has the following comments:
1. The supply of utilities and fire protection to
this site are not a problem.
2. There are no legal provisions for requiring off-
street parking. The previous 20 years of restaurant
operation at the site, clientele will have to find
parking where they can.
3. The Environmental Health Office should be consulted
for requirements such as grease trap and/or air pollution
matters.

The Aquitaine is to be a full -service restaurant and bar
specializing in exotic seafood. The seating capacity is
between 60-65. We plan to be open 6-7 days a week; 7-9 months
a year. The hours of operation will be 3:30 P.M. to 2:OOA.M.
weekdays; and 3:30 P.M. to Midnight Sundays. During the
winter, apres-ski from 3:30 to 6:00 P.M. in the Fireside
lounge; Dinner from 6:00 P.M. to 10:00 P.M. and the bar will
remain available for cocktails until closing.
There is a taped music system presently in place and there
are no plans for live entertainment.
Located at First and Cooper St, approximately three blocks
from the center of town, the restaurant is easily within
walking distance of tourists staying in condos and lodges,
therefore not needing parking. People driving from distances
such as Snowmass, should easily find parking on the street
and not creat an inconvenience for area residents.
Since the restaurant is situated in the Fireside Lodge,
we are very aware of maintaining the noise at a respectable
level and this shall remain a serious consideration for the
duration of the lease.
With the exception of the hanging sign in front of the lodge,
and the sign on the doorway, no exterior changes will be made.
It should be noted that until approximately three years
ago, this location had been a working restaurant for well
over twenty years. At the present time, it is being used for
storage and to cook breakfast for any lodge guests. Our
arrangement with the owners of the lodge allows for the con-
tinuation of joint kitchen use.
The principles in this operation have all of their pro-
fessional lives working in restaurants and are totally qua-
lified to undertake this endevour.
