NOTICE IS HEREBY GIVEN that a public hearing will be held on
Tuesday, April 17, 1990 at a meeting to begin at 4:30 pm before
the Aspen Planning and Zoning Commission, 2nd Floor Meeting Room,
130 South Galena Street, Aspen, Colorado to consider an
application submitted Ernie Fyrwald requesting Conditional Use

Aspen Area Comprehension Flan. the conditional use is
consistent with the proposed goals, objectives, and
standards of the Aspen Hrea Lomprehensive Plan, and with
the intent of the Zone District in which it is proposed
to be located; and AUU are encouraged by the laity
Council.

the conditional use is consistent and compatible with the
character of the immediate vicinity of the parcel
proposed for development and surrounding land uses. H11
criterion's have been met and reviewed by the planning
office and checked and approved for compliance.

MEMORANDUM

RE: Fyrwald Accessory Dwelling Unit - Conditional Use
DATE: April 17, 1990
SUMMARY: The applicant seeks a Conditional Use approval in order
to construct a single family residence with an accessory dwelling
unit of approximately 440 square feet. Planning Staff recommends
approval of this Conditional Use with conditions.
APPLICANT: Ernie Fyrwald, represented by Michael Pines
LOCATION: 1265 Mountain View Drive, Lot 7, Blk.3 West Meadows
Subdivision
ZONING: R-15
APPLICANT'S REQUEST: Conditional Use approval for an accessory
dwelling unit.
PROPOSAL: The proposed residence is a 4 bedroom 3,838 sq.ft.
home. The applicant wishes to include a garden level caretakers
unit of approximately 440 sq. ft.
REFERRAL COMMENTS:
Engineering: Chuck Roth made the following comment:
1. It appears from the site plan that the driveway is wider that
permitted by code. An 18' wide drive is permitted in this zone
district for a lot with this frontage length. The applicant must
reconfigure the driveway curb cut to 18' width at the street.
(site plan has been amended to reflect this concern - 4/9/90)
STAFF COMMENTS: An accessory dwelling unit is a conditional use
in the R-6 zoning district. The Commission has the authority to
review and approve development applications for conditional uses
pursuant to the standards of Section 7-304:
A. The conditional use is consistent with the purposes, goals,
objectives and standards of the Aspen Area Comprehensive
Plan, and with the intent of the Zone District in which it
is proposed to be located.
RESPONSE: This proposed unit will allow the property to house a
a local employee in a residential area, which complies with the

zoning and Aspen Comprehensive Plan.
City Council.
ADU's are encouraged by
B. The conditional use is consistent and compatible with the
character of the immediate vicinity of the parcel proposed
for development and surrounding land uses, or enhances the
mixture of complimentary uses and activities in the
immediate vicinity of the parcel proposed for development.
RESPONSE: This use is compatible with the other residential uses
in the surrounding neighborhood. The unit is not visible as a
separate unit.
C. The location, size, design and operating characteristics of
the proposed conditional use minimizes adverse effects,
including visual impacts, impacts on pedestrian and
vehicular circulation, parking, trash, service delivery,
noise, vibrations and odor on surrounding properties.
RESPONSE: The proposed accessory unit is completely contained
within the existing structure. Additional parking spaces will
not be needed because one bedroom or studio accessory units carry
no parking requirement. The only impacts will be those normally
associated with the construction of the house. The applicant
has amended the driveway width to comply with the Engineering
Department's requirement.
D. There are adequate public facilities and services to serve
the conditional use including but not limited to roads,
potable water, sewer, solid waste, parks, police, fire
protection, emergency medical services, hospital and medical
services, drainage systems, and schools.
RESPONSE: All public facilities are all ready in place for the
existing neighborhood.
E. The applicant commits to supply affordable housing to meet
the incremental need for increased employees generated by
the conditional use.
RESPONSE: As proposed, and in compliance with rental
stipulations.
F. The proposed conditional use complies with all additional
standards imposed on it by the Aspen Area Comprehensive Plan
and by all other applicable requirements of this chapter.
RESPONSE: .This use complies with the Aspen Area comprehensive
Plan and any other applicable conditional use standards.
STAFF RECOM ENDATION: Planning recommends approval of this
conditional use with the following condition:

Re: Frywald Conditional Use Review
Having reviewed the above referenced application, the engineering
department has the following comments:
1. It appears from the site plan which was submitted that the
driveway is wider than permitted by code. Section 19-101(e)(1)
permits an 18 foot driveway for this zone district and street
frontage length. Curb cuts are controlled in size in order to
preserve on -street parking. Therefore the applicant must
reconfigure the driveway to an eighteen foot width at the street.
2. All other conditions appear to be satisfactory.

1. Design is based on the 1988 edition of the Uniform

2. The Contractor shall be responsible for the temporary
shoring and bracing of all systems and protection of
all adjacent structures.
3. The Contractor shall confirm dimensions and elevations
shown with architectural drawings; notify Engineer
immediately of discrepancies.
4. Notify Engineer if any openings are to be cut in
structural systems for mechanical or electrical items.
FOUNDA`i'IO14S
1. Foundation Design is based on assumed soil properties
as follows:
Maximum Bearing Capacity = 2,000 PSF.
Active Soil Pressure = 45 PCF.
Passive Soil Pressure - 300 PCF.
Soils are presumed non -expansive, non -soluble, and not
prone to excessive consolidation. Specific soil
properties shall 1x- verified by the Soils Engineer upon
excavation and prior to footing placc:m.ant.
CONCRETE AND REINFORCING STEEL
1. All concrete shall dttain 3,000 PSI compressive
strength within 23 days. Use Type II cement with 4
air entrainment. Concre2tc: aggregate shall ix normal
weight (stone).
2. Perform all cast -in -place concrete work in accordance
with "Specifications For Structural Concrete For
Buildings," ACI 301-84, unless noted otherwise. Pro-
vide cold or hot weather protection per ACI 305 & 306.
3. Reinforcing steel shall conform to ASTrn A615.
#4 and smaller - Grade 40
#5 and larder - Grade 60
4. horizontal reinforcing steel shall be made continuous
by lapping bars minimu;i 3,2 diameters at all splices
and providing corner dowels. Fabrication and instal-
lation of reinforcing steel shall conform to ACI 315.
5. Provide accessories necessary to properly support
reinforcing at positions shown on plans.
6. Place 2-#5's with 2'-0" proj-_:ctions each side of all
wall openings.
FASTENERS AND CON"CTORS �
1. All timber nailing and connections shall conform to the j
UBC and AITC. Reference UBC "Table No. 25-Q - Nailing
Schedule." (All nails shown signify common wire nails -
unless noted otherwise.)
2. Bolts for wood member connections shall he ASTM A307
with minimum 1 -1 /.2." washer each end, unless otherwise 1
noted.
3. All metal connectors for wood` framing (e.g. Joist l
Hangers, Hold-down Anchors, Framing Angles, etc.) shall
be as manufactured by Simpson Strong -Tie Company. j
Install all connectors according to manufacturer's j
recommendations. Contractor may install connectors
with nails shorter than common as follows: fad x 1-1/4" _f
for 8d, 10d x 1-1/2" for 10d, 16d x 2-1/2" for 16d.
4. Powder -actuated fasteners for attachment of various
materials to structural steel.or concrete shall be
"Ramset" fasteners oas manufactpred by Ramset Fastening
Systems. l
5. Alternate connectors and fasteners to those: listed
above, which h,#vc I.C.B.0. approval, may tx used with
approval by the Engineer.•
INTERIOR SLABS -ON -GROUND (S.O.G.) ry
1. Unless noted otherwise, interior S.O.G.'s shall be 4"
thick concrete :dabs placed on a minimum 4" thick layer
of free -draining gravel.
2. All interior S.O.G.'s shall be reinforced with 6x6-
V11.4xl-11.4 welded wire fabric unless noted otherwise.
Option: Replace mesh with synthetic fiber additive per
manufacturer's recommendations and Engineer's approval.
3. Provide free -draining gravels and compacted fill (where
necessary) according to Soils Engineer's recommendations.
4. Compactive effort for gravels, structural fill and
existing subgrades which support S.O.G.'s shall be in
accordance with Soils Engineer's recommendations.

TIMBER AND SNOOD PRODUCTS
1. All tir:rber construction ( light & heavy) shall conform
to American Institute of Timber Construction (AITC)
and National Design Specification (NDS) standards.
2. Structural framing lumbar shall be Douglas Fir/Larch,
with the following minimum grades:
Plates and Studs: I;2
Joists and Raf tors: r'i2
Beams, Posts and Timbers: P1
3. Glu-lam framing members shell be Douglas Fir/Larch as
follows:
1. For beams, provide members conforming to AI`i'C
symbol 24F-V3 or better (Fb=2,400 PSI, �--
Fv=1G5 PSI, I,=1,800,000 PSI), unless noted
otherwise.
2. Where noted on plan "24I'-V8", .rovidc leams
conforming to AITC symbol 24F-V3.
4. All sill plates in contact with concreto or masonry
foundations shall be Foundation Grade Redwood or
Pressure -treated Hem -Fir 02 or lx�tter, designated %
for "Above: Ground" usage as defined by the American
Wood Preserver's Institute.
5. Trus-Joist products shown shall be as manufactured by
the Trus-Joist Corporation, Boise, Idaho. Any alter-
nate systems shall be evaluated and approved by the
Engineer prior to construction. Installation details,
blocking, bridgincl, bracing and connections shall
conform to the requirements of the manufacturer.
6. Micro=lams shall be as rnanufacturcd by the Trus-Joist
Corporation and shall have the following minimum
workin(j stresses:
Fb=2,800 PSI, Fv=285 PSI, E=2,000,000 PSI. s
7. Mood manufactured l:)roducts other than those noted, �-
