Planning Staff recommends approval of this Conditional Use with conditions. APPLICANT: Ernie Fyrwald, represented by Michael Pines LOCATION: 1265 Mountain View Drive, Lot 7, Blk.3 West Meadows Subdivision ZONING: R-15 APPLICANT'S REQUEST: Conditional Use approval for an accessory dwelling unit. PROPOSAL: The proposed residence is a 4 bedroom 3,838 sq.ft. home. The applicant wishes to include a garden level caretakers unit of approximately 440 sq. ft. REFERRAL COMMENTS: Engineering: Chuck Roth made the following comment: 1. It appears from the site plan that the driveway is wider that permitted by code. An 18' wide drive is permitted in this zone district for a lot with this frontage length. The applicant must reconfigure the driveway curb cut to 18' width at the street. (site plan has been amended to reflect this concern - 4/9/90) STAFF COMMENTS: An accessory dwelling unit is a conditional use in the R-6 zoning district. The Commission has the authority to review and approve development applications for conditional uses pursuant to the standards of Section 7-304: A. The conditional use is consistent with the purposes, goals, objectives and standards of the Aspen Area Comprehensive Plan, and with the intent of the Zone District in which it is proposed to be located. RESPONSE: This proposed unit will allow the property to house a a local employee in a residential area, which complies with the • • zoning and Aspen Comprehensive Plan. City Council. ADU's are encouraged by B. The conditional use is consistent and compatible with the character of the immediate vicinity of the parcel proposed for development and surrounding land uses, or enhances the mixture of complimentary uses and activities in the immediate vicinity of the parcel proposed for development. RESPONSE: This use is compatible with the other residential uses in the surrounding neighborhood. The unit is not visible as a separate unit. C. The location, size, design and operating characteristics of the proposed conditional use minimizes adverse effects, including visual impacts, impacts on pedestrian and vehicular circulation, parking, trash, service delivery, noise, vibrations and odor on surrounding properties. RESPONSE: The proposed accessory unit is completely contained within the existing structure. Additional parking spaces will not be needed because one bedroom or studio accessory units carry no parking requirement. The only impacts will be those normally associated with the construction of the house. The applicant has amended the driveway width to comply with the Engineering Department's requirement. D. There are adequate public facilities and services to serve the conditional use including but not limited to roads, potable water, sewer, solid waste, parks, police, fire protection, emergency medical services, hospital and medical services, drainage systems, and schools. RESPONSE: All public facilities are all ready in place for the existing neighborhood. E. The applicant commits to supply affordable housing to meet the incremental need for increased employees generated by the conditional use. RESPONSE: As proposed, and in compliance with rental stipulations. F. The proposed conditional use complies with all additional standards imposed on it by the Aspen Area Comprehensive Plan and by all other applicable requirements of this chapter.
