Good afternoon Christie—So I'm just following up on the 1279 Ute Ave case. I need to let you know that per Chapter
26.304.070 (F)Abandonment of application of the Land Use Code, the application that has been submitted for 1279 Ute
Ave will be considered abandoned if no action is undertaken by November 15, 2013. Obviously this is quite a bit of time;
however, I just wanted to do my best to keep on top of deadlines for my cases and keep you informed. Please feel free

Engineering Department DRC Comments
These comments are not intended to be exclusive, but an initial response to the project
packet submitted for purpose of the DRC meeting.
Drainage:
General note: The design for the site must meet the Urban Runoff Management Plan
Requirements. Staff was not able to determine whether or not the site will meet these
requirements. A compliant drainage report and plan must be completed prior to final plat.
A compliant drainage plan must be submitted prior to final plat. This includes detaining
and providing water quality for the entire site. If the site chooses FIL, it can only be
applied to existing-impervious areas all new areas will need to discharge at historic rates.
Staff was unable to determine whether or not the site is able to meet the Drainage
Principals:
1.Consider stormwater quality needs early in the design process
2.Use the entire site when planning for stormwater quality treatment.
3.Avoid unnecessary impervious area.
4.Reduce runoff rates and volumes to more closely match natural conditions.
5.Integrate stormwater quality management and flood control.
6.Develop stormwater quality facilities that enhance the site, the community, and the
environment.
7.Use a treatment train approach.
8.Design sustainable facilities that can be safely maintained.
9. Design and maintain facilities with public safety in mind.
Mudflow /Avalanche:
.The plans did not show compliance with the City's Urban Runoff Management Plan
Mud Flow requirements. Additionally the plans must mitigate for avalanche risks.
It's not enough to indemnify the property from these risks instead an analysis must be
performed which complies with the URMP.
Construction Management—Engineering is concerned about the Construction
Impacts of this site. Please submit a construction management plan prior to
Building permit.
Fee in Lieu—. If this project is classified as a Major project it may opt to pay the Fee in
Lieu for a portion of the detention requirements if it is determined that . Please refer
to Section 2.12.140 of the Municipal Code. Please note: The project will not have
the option to pay a fee-in-lieu of constructing a stormwater detention facility if, in the
opinion of the City Engineer, undetained runoff from the development may materially
adversely exacerbate an existing problem or may adversely impact a downstream
property

Tree Protection:
1. A vegetation protection fence shall be erected at the drip line of each individual tree
or groupings of native vegetation on site. This fence must be inspected by the city
forester or his/her designee (920-5120) before any construction activities are to
commence. No excavation, storage of materials, storage of construction backfill,
storage of equipment, foot or vehicle traffic allowed within the drip line of any tree
on site.There should be a location and standard for this fencing denoted on the plan,
Per City Code 13.20.
Tree Permit:
1. Per City Code 13.20 an approved tree permit will be required before any tree is
removed or impacted under the drip line of a tree. Parks is requiring that the tree
permit be approved prior to approval of building permits. If a permit is necessary,
contact the Parks Department at 920-5120 or download the permit at
www.aspenpitkin.com on the Natural Resource page, click on the 2012 tree permit
tab. Mitigation for removals will be paid cash in lieu or as an on-site planting per
City Code 13.20.

Hi Sara,
I met with our avalanche risk analyst, Art Mears yesterday. He has not done the analysis yet, but upon
reviewing the site yesterday he said the hot tub would require a roof-type structure to protect the users of the hot
tub. The location of the hot tub is outside the building envelope. Going out on a limb here, do you think the
City would grant a variance to build a structure outside the building envelope to protect the hot tub?

The project is a hot tub installation and landscaping proposed in the backyard of the residence.
The following addresses the exemption standards:
1. The development,a self contained hot tub and landscaping,does not add any square footage
to the house.
2. The development does not require the removal of any trees.
3. The proposed hot tub and landscaping are located in an avalanche red zone. The owner
understands the risks of"hot-tubbing"in an avalanche red zone and is willing to sign a hold
harmless agreement with the City of Aspen. The development will not increase erosion and
sedimentation.
