Review -Stream Margin Review Standard Variance

CURRENT ZONING & USE
This property is located in the
Residential Multi-Family (R/MF)
zone district and is developed with
an existing 16-unit multi-family
residential building.
PROPOSED LAND USE:
The Applicant is requesting a
Stream Margin Variance to allow
for a deck existing in within the
restricted Top of Slope 15’ Setback
and in the common area of the
condominium association.
SUMMARY:The application was initially heard by the Planning
and Zoning Commission at a properly noticed public hearing June
1, 2021 where the Commission came to a tie-vote. A tie vote on a
motion is a failed motion and is not considered to be action. The
applicant requested a continuance to July 6th and now requests a
hearing date of September 7, 2021. Per land use code section
26.304.060.(c)(5) an applicant shall have the right to request and
be granted one continuance; however, all subsequent
continuances shall be granted at the discretion of the decision-
making body conducting the hearing, only upon good cause
shown. Staff supports a second continuance to allow the applicant
or staff to bring any additional information to assist the Commission
in making a final determination on the request.
STAFF RECOMMENDATION:
Staff recommends the Planning and Zoning Commission approve
a motion to continue the hearing to a date certain of September 7,
2021.
