Agreement for Payment of City of Aspen Development Application Fees
CITY OF ASPEN (hereinafter CITY) and i m icS DG Lt JO W Le.,-t —
(hereinafter APPLICANT) AGREE AS FOLLOWS:
APPLICANT has submitted to CITY an application for a^_ S%A.hSi&^�We— ()UO
(hereinafter, THE PROJECT).
2. APPLICANT understands and agrees that City of Aspen Ordinance No. 57 (Series of 2000)
establishes a fee structure for Land Use applications and the payment of all processing fees is a condition precedent
to a determination of application completeness.
3. APPLICANT and CITY agree that because of the size, nature or scope of the proposed project, it
is not possible at this time to ascertain the full extent of the costs involved in processing the application.
APPLICANT and CITY further agree that it is in the interest of the parties that APPLICANT make payment of an
initial deposit and to thereafter permit additional costs to be billed to APPLICANT on a monthly basis.
APPLICANT agrees additional costs may accrue following their hearings and/or approvals. APPLICANT agrees he
will be benefited by retaining greater cash liquidity and will make additional payments upon notification by the
CITY when they are necessary as costs are incurred. CITY agrees it will be benefited through the greater certainty
of recovering its full costs to process APPLICANT'S application.
4. CITY and APPLICANT further agree that it is impracticable for CITY staff to complete
processing or present sufficient information to the Planning Commission and/or City Council to enable the Planning
Commission and/or City Council to make legally required findings for project consideration, unless current billings
are paid in full prior to decision.
5. Therefore, APPLICANT agrees that in consideration of the CITY's waiver of its right to collect
full fees pn r to a determination of application completeness, APPLICANT shall pay an initial deposit in the
amount of $ which is for 0 hours of Community Development staff time, and if actual
recorded costs exceed the initial deposit, APPLICANT shall pay additional monthly billings to CITY to reimburse
the CITY for the processing of the application mentioned above, including post approval review at a rate of $220.00
per planner hour over the initial deposit. Such periodic payments shall be made within 30 days of the billing date.
APPLICANT further agrees that failure to pay such accrued costs shall be grounds for suspension of processing, and
in no case will building permits be issued until all costs associated with case processing have been paid.

Dear Joyce:
I am writing this letter on behalf of Four Peaks Development, LLC as
well as the Top of Mill Townhomes Homeowner's Association to seek
approval for a driveway redesign and landscaping plan.
The Homeowners have asked Four Peaks (the Developer) to
investigate the potential change from a single driveway with one entrance and
one exit to six (6) individual driveway accesses. We believe that this plan will
create a more efficient means of entry/exit to these townhomes, alleviate
parking concerns between homeowners in the shared driveway as well as
South Mill Street parking, improve safety issues arising from winter
conditions combined with the steep road grade, increase green space and
convey a more inviting aesthetic to the Top of Mill Subdivision in its entirety.
I am attaching two (2) drawings for your review which are as follows:
• Exhibit A —Improved landscape plan
• Exhibit B—Driveway redesign

(h) Special Mapping and Platting Requirements
(1) Prior to the issuance of a development permit for a site plan or
limits or disturbance, the applicant shall be required to prepare
and record with the Pitkin County Clerk and Recorder a map in a
form approved by the Community Development Director
consistent with the submission requirements in [Administrative
Document] and any conditions of approval. [Revised]
(2) Prior to the issuance of a development permit for a correction of
survey errors, a lot line adjustment, or a minor plat amendment,
the applicant shall be required to prepare and record with the
County Clerk and Recorder a final plat approved by the
Community Development Director consistent with the submission
requirements in [Administrative Document] and any conditions of
approval. [Revised]
(i) Referral to Higher Body
In lieu of making an administrative decision, the Community Development
Director may refer any application authorized for administrative approval
to the Hearing Officer for decision pursuant to the criteria in subsection (f)
above if the Community Development Director determines that:
(1) The application raises a significant public controversy on which
numerous parties beyond the owners of adjacent properties may
want to offer testimony; or
(2) The applicant has a disagreement with the Community
Development Department regarding a condition of approval; or
(3) The applicant has exerted significant and undue pressure on the
Community Development Department to interpret this Code in a
novel or ambiguous manner in order to obtain an approval, or has
attempted to influence the decision of the Community
Development Department in an improper manner. [Revised]
(j) Vested Right
A vested right is not available for a decision by administrative review. If
the applicant desires to create a vested right, the application shall instead
be processed as a one-step review by the Board pursuant to Sec. 2-40-
030 and complies with the procedures of Sec. 2-30-170. [Revised]
(k) Appeal
Decisions made pursuant to this administrative review process may be
appealed to those bodies identified in Table 2-3 pursuant to Sec. 2-30-
180. [Revised]

(b) In the case of existing residences, the applicant shall
agree not to request approval to maintain the residence as
a caretaker dwelling unit or an employee dwelling unit,
unless the site and existing unit meets the standards in
Secs. — [3-150-120] or [3-150-130] (GMQS Exemption
for Employee Dwelling Unit or Caretaker Dwelling Unit).
(c) Approval under this section shall be available for only one
single-family dwelling unit on a parcel of land, even if the
parcel contains more than one single-family dwelling unit.

(14) Minor Amendment to a Development Permit
A minor amendment to any development permit (except minor and
major amendments to final plats), including AF-SKI and PUB
master plans and special review approvals, intended to change an
element or condition of a development permit may be approved
subject to compliance with the standards in this section. Refer to
Sec. _ [5-50] for submission contents.
(a) All plat amendments shall be reviewed pursuant to the
standards in Sec. _[3-190-080].
(b) The amendment must not change the use of the proposed
development between residential, commercial and tourist
accommodation uses.
(c) The amendment must be consistent with action taken
during the review of the original development and does not
constitute a new land development activity.
(d) The proposed activity does not change the basic character
of the approved use of land on which the activity occurs
including basic visual appearance and method of
operation.
(e) The proposed activity does not increase off -site impacts in
the surrounding neighborhood.
(f) The proposed activity does not endanger the public health,
safety or welfare.
(g) The proposed activity does not violate any standard of this
Land Use Code standard.
(h) The proposed activity does not substantially increase the
need for on -site parking or utilities, or affect affordable
housing generation; and
(i) The proposed activity does not increase the floor area of
the use by more than two percent (2%) or decrease the
open space on the site by more than three percent (3%).
