BUSINESS SUPPORT AND COMMUNITY DEVELOPMENT CODE ENFORCEMENT

(the "Property'). Due to the Declaration of a Local Disaster Emergency

as a result of both state and local public health orders, it has been determined that businesses
operating in Aspen during the 2021 Spring/Summer seasons may qualify for expedited permit
review and land use code exemptions to erect certain temporary enclosures and structures.
Having completely and fully read and understood City Council Resolution No. 86,
Series of 2020 (the "Policy"), and understanding the limitations, risks and financial burdens
inherent to installing temporary enclosures/structures, the applicant hereby agrees to comply
with all applicable building codes, and historic preservation regulations and shall remove all
temporary enclosures, heaters, signage and lighting, no later than Oct. 31, 2021 or at the
direction of the Community Development Director. Fully enclosed structures in City right-of-way
shall not be permitted after June 1", 2021. Additional code requirements may be applied to the
structure to ensure compliance with all currently adopted City codes. City Staff reserves the
right to enforce the removal of any temporary structures that do not comply with the
requirements set forth in Resolution No. 86, Series of 2020, as well as all applicable Building
Code and Land Use Code provisions.
