MILL STREET, CITY OF ASPEN, COUNTY OF PITKIN, COLORADO. Parcel ID No. 2737-073-38-004 APPLICANT: Black and Veach for Verizon Wireless SUBJECT & SITE OF APPROVAL: 205 S. Mill St, Mill Street Plaza, involving the approval of wireless telecommunication services facilities and equipment. This is an administrative review. SUMMARY: The Applicant has requested approval for the installation of two non-penetrating roof mounted omni antennas with related supporting equipment such as a hybrid cable, non- penetrating cable trays, cable hangars and grounding kits (Exhibit A-2). The equipment is proposed to be located on the south-western edge area of the rooftop. The Mill Street Plaza is within the Commercial Core (CC) zone district that also has a I-listoric Overlay, requiring review by the City's Historic Preservation Planner. The building currently hosts six Verizon Wireless omni antennas, which are attached to the building's western alley side. None of these existing devices are to be removed per this proposal. The Applicant had initially requested the new antennas to be placed alongside the existing antennas, however this request was denied by the City's Historic Preservation Planner on the basis that this western side of the building was becoming increasingly crowded and that such a bulk of equipment was out of character with the building and the district. I he Applicant was instructed to examine alternatives that would reduce the equipment's visibility and provide greater compatibility with the surrounding environment. STAFF EVALUATION: Pursuant to Section 26.575.130, Wireless telecommunications services facilities and equipment must comply with a list of general provisions and review standards. These requirements seek to ensure compatibility with the building and surrounding development. Depending on the type of telecommunication device installed (i.e. monopole, whip antenna, ground tower, etc.), specific requirements apply. This plan includes the installation of two rooftop antennas, therefore many of the criteria are not applicable. The majority of the compliance standards are in the form of screening and aesthetic qualities to limit the visual impact of the equipment. 1 Staff has concluded that the visual impact of the new wireless equipment will be reduced by the Applicant's intention to paint the antennas black, screen them behind the building's parapet wall, and to maximize the setback by placing the equipment at the rear southwestern side of the building (away from the streets and pedestrian ways). The Code recommends the clustering of wireless equipment, and although this new equipment is found on the roof rather than attached to the western wall of the building, it is situated adjacent to the existing equipment. In this way all wireless equipment is found within a predictable area of the building exterior. The antennas reach approximately 7' beyond the parapet wall, and do not require a variance to achieve this height. All support and/or switching devices are either beneath the parapet wall or stored within the building. All conduits (electrical and coax) are on the roof and also beneath the parapet. No lighting or signage (other than the required telephone contact numbers) is proposed through this plan. For Staffs response to the review criteria see "Exhibit B." The plans have been reviewed for a Certificate of No Negative Effect with the City's Historic Preservation Planner, who has found these plans to be in compliance. Staff finds all applicable criteria to be met in regards to the application. DECISION: Staff finds that the wireless telecommunication services and equipment application for the addition of two omni antennas and associated supporting equipment to the roof of 205 S. Mill Street, provided by Verizon Wireless, to meet the requirements of the Code, and APPROVES the applicant's request. The following standards are designed to foster the City's safety and aesthetic interests without imposing unreasonable limitations on wireless telecommunication services facilities and equipment: 1. Setbacks. At a minimum, all wireless telecommunication services facilities and equipment shall comply with the minimum setback requirements of the underlying zone district; if the following requirements are more restrictive than those of the underlying zone district, the more restrictive standard shall apply. a) All facilities shall be located at least fifty (50) feet from any property lines, except when roof-mounted (above the eave line of a building). Flat-roof mounted facilities visible from ground level within one-hundred (100) feet of said property shall be concealed to the extent possible within a compatible architectural element, such as a chimney or ventilation pipe or behind architectural skirting of the type generally used to conceal HVAC equipment. Pitched-roof-mounted facilities shall always be concealed within a compatible architectural element, such as chimneys or ventilation pipes. Staff Response: The proposal involves two omni antennas that will be mounted to the roof of the building. The antennas will be located at the rear of the roof, on the south western side so as to be located near the existing antennas, and will be concealed to the extent possible by the building's parapet from the rear. The antennas will be painted black to match the existing antennas, and to camoujlage their presence. Staff finds this criterion to be met. b) Monopole towers shall be set back from any residentially zoned properties a distance of at least three (3) times the monopole's height (i.e., a sixty (60) foot setback would be required for a twenty (20) foot monopole) and the setback from any public road, as measured from the right-of-way line, shall be at least equal to the height of the monopole. Staff Response: The applicant is proposing two omni-whip style antennas. This development is proposed in the Commercial Core Zone District, which is not a residentially zoned district. The antennas are proposed to be located at the far end of the building, away from both S. Mill St. and E. Hopkins Ave. Staff Jinds this criterion to be met. c) No wireless communication facility may be established within one-hundred (100) feet of any existing, legally established wireless communication facility except when located on the same building or structure. Staff Response: The applicant is proposing to locate the antennas on a structure where at least six other wireless antennas already exist. Staff finds this criterion to be met. 1 d) No portion of any antenna array shall extend beyond the property lines or into any front yard area. Guy wires shall not be anchored within any front yard area, but may be attached to the building. Staff Response: The proposed antenna and supporting structure will not extend beyond the property lines or into the front yard area of the lot. Staff finds this criterion to be met. 2. Height. The following restrictions shall apply: a) Wireless telecommunication services facilities and/or equipment not attached to a building shall not exceed thirty-five (35) feet in height or the maximum permissible height of the given Zone District, whichever is more restrictive. Staff Response: The proposed antennas measure approximately 5.83' in height. Staff finds this criterion to be met. b) Whenever a wireless telecommunication services antenna is attached to a building roof, the antenna and support system for panel antennas shall not exceed five (5) feet above the highest portion of that roof, including parapet walls and the antenna and support system for whip antennas shall not exceed ten (10) feet above the highest portion of that roof, including parapet walls. Staff Response: The proposed antennas are attached to the roof. The antenna and support system will not exceed the 10' of allowable height, as measured above the parapet wall. Stafffinds this criterion to be met. c) The Community Development Director may approve a taller antenna height than stipulated in b. above if it is his or her determination that it is suitably camouflaged, in which case an administrative approval may be granted. Staff Response: The proposed antenna meet the height requirements as outlined above. There is no request for the allowance of a taller antenna height. Staff Jinds this criterion to be not applicable. d) If the Community Development Director determines that an antenna taller than stipulated in b. above cannot be suitably camouflaged, then the additional height of the antenna shall be reviewed pursuant to the process and standards (in addition to the standards of this Section) of Chapter 26.430 (Special review). Staff Response : Staff Jin ds this criterion to be not applicable. e) Support and/or switching equipment shall be located inside the building, unless it can be fully screened from view as provided in the "Screening" standards (26.475.130 and 26.575.130.F.5) below. Staff Response: Proposed support equipment will be fully screened by the building's parapet walls, and located at the rear of the building's rooftop. Staff finds this criterion to be met. 3. Architectural compatibility. Whether manned or unmanned, wireless telecommunication services facilities shall be consistent with the architectural style of the surrounding architectural environment (planned or existing) considering exterior materials, roof form, scale, mass, color, texture and character. In addition: 2 Staff Response: The proposed facilities are consistent with the surrounding architectural environment. They will be located on the roof, painted black, and mimic the style of the existing wireless antennas on the building. Stafffinds this criterion to be met. a) If such facility is accessory to an existing use, the facility shall be constructed out of materials that are equal to or o f better quality than the materials o f the principal use. Sta# Response: The proposed equipment is not accessory to any existing use. The antennas will be free-standing and secured to the roof with non-penetrating mounts. Stafffinds this criterion to be not-applicable. b) Wireless telecommunication services equipment shall be of the same color as the building or structure to which or on which such equipment is mounted or as required by the appropriate decision-making authority (Community Development Director, Historic Preservation Commission, Planning and Zoning Commission or City Council, as applicable). Staff Response: The proposed antennas will be painted black to ensure a low profile as well as to match the existing antennas found on the building. Stajffinds this criterion to be met. c) Whenever wireless telecommunication services equipment is mounted to the wall of a building or structure, the equipment shall be mounted in a configuration designed to blend with and be architecturally integrated into a building or other concealing structure, be as flush to the wall as technically possible and shall not project above the wall on which it is mounted. Staff Response: The antennas are not proposed to be mounted to the walls. Staff finds this criterion to be met. d) Monopole support buildings, which house cellular switching devices and/or other equipment related to the use, operation or maintenance of the subject monopole, must be designed to match the architecture of adjacent buildings. If no recent and/or reasonable architectural theme is present, the Community Development Director may require a particular design that is deemed to be suitable to the subject location. Staff Response: The proposed support equipment located on the roof will be screened to the extent possible by the building's parapet, and will be low profile so that it does not stand outfrom the rest of the building. Stafflinds this criterion to be met. e) All utilities associated with wireless communication facilities or equipment shall be underground (also see "Screening" below) Staff Response: There are no utilities proposed that will require their placement underground. Stafffinds this criterion to be not applicable. 4. Compatibility with the natural environment. Wireless telecommunication services facilities and equipment shall be compatible with the surrounding natural environment considering land forms, topography and other natural features and shall not dominate the landscape or present a dominant silhouette on a ridge line. In addition: 3 a) If a location at or near a mountain ridge line is selected, the applicant shall provide computerized, three-dimensional, visual simulations of the facility or equipment and other appropriate graphics to demonstrate the visual impact on the view of the affected ridges or ridge lines; an 8040 Greenline Review, pursuant to the provisions of Section 26.435.030, may also be required. Staff Response: The antennas are proposed to be located within the City's Commercial Core area. StaJffinds this criterion to not be met. b) Site disturbances shall be minimized and existing vegetation shall be preserved or improved to the extent possible, unless it can be demonstrated that such disturbance to vegetation and topography results in less visual impact to the surrounding area. Staff Response: No disturbance of the site's natural environment is proposed with this application. Staff Jinds this criterion to not be met. c) Surrounding view planes shall be preserved to the extent possible. Staff Response: The proposed antenna have no impact on the designated view planes. Staffjinds this criterion to be met. d) All wireless telecommunication services facilities and equipment shall comply with the Federal Communication Commission's regulations concerning maximum radio frequency and electromagnetic frequency emissions. Sta# Response: The Applicant has indicated that the proposed equipment shall comply with the FCC regulations concerning maximum radio frequency and electromagnetic frequency emissions. Stafffinds this criterion to be met. 5. Screening. Roo f-and-ground-mounted wireless telecommunication services facilities and equipment, including accessory equipment, shall be screened from adjacent and nearby public rights-of-way and public or private properties by paint color selection, parapet walls, screen walls, fencing, landscaping and/or berming in a manner compatible with the building's and/or surrounding environment's design, color, materials, texture, land forms and/or topography, as appropriate or applicable. In addition: Staff Response: The two proposed roof mounted antennas will be screened to the extent possible by the building's parapet, and painted black. They will be placed on the rear of the building's roof, such that they are not visible from the either street. Stafffinds this criterion to be met. a) Whenever possible, if monopoles are necessary for the support of antennas, they shall be located near existing utility poles, trees or other similar objects; consist of colors and materials that best blend with their background; and, have no individual antennas or climbing spikes on the pole other than those approved by the appropriate decision- making authority (Community Development Director, Historic Preservation Commission, Planning and Zoning Commission or City Council, as applicable). Staff Response: Monopoles are not associated with this application. Staff finds this criterion to be met. b) For ground-mounted facilities, landscaping may be required to achieve a total screening effect at the base of such facilities or equipment in order to screen the 4 mechanical characteristics; a heavy emphasis on coniferous plants for year-round screening may be required. Landscaping shall be of a type and variety capable of growing within one (1) year to a landscape screen which satisfactorily obscures the visibility of the facility. Staff Response: The proposal does not include any ground-mounted facilities. Staff Jinds this criterion to be met. c) Unless otherwise expressly approved, all cables for a facility shall be fully concealed from view underground or inside of the screening or monopole structure supporting the antennas; any cables that cannot be buried or otherwise hidden from view shall be painted to match the color of the building or other existing structure. Staff Response: All cables proposed with this application will be on the roof and screened by the rooftop parapet of the building. Stafffinds this criterion to be met. d) Chain link fencing shall be unacceptable to screen facilities, support structures or accessory and related equipment (including HVAC or mechanical equipment present on support buildings); fencing material, if used shall be six (6) feet in height or less and shall consist of wood, masonry, stucco, stone or other acceptable materials that are opaque. Staff Response: There is not fencing associated with this application. Staff finds this criterion to be not applicable. e) Notwithstanding the foregoing, the facility shall comply with all additional measures deemed necessary to mitigate the visual impact of the facility. Also, in lieu of these screening standards, the Community Development Director may allow use of an alternate detailed plan and specifications for landscape and screening, including plantings, fences, walls, sign and structural applications, manufactured devices and other features designed to screen, camouflage and buffer antennas, poles and accessory uses. For example, the antenna and supporting structure or monopole may be of such design and treated with an architectural material so that it is camouflaged to resemble a tree with a single trunk and branches on its upper part. The plan should accomplish the same degree of screening achieved by meeting the standards outlined above. Staff Response: Staff finds no need for additional measures to mitigate the visual impact of the facility. Stafffinds this criterion to be not-applicable. 6. Lighting and signage. In addition to other applicable sections of the code regulating signage or outdoor lighting, the following standards shall apply to wireless telecommunication services facilities and equipment: a) The light source for security lighting shall feature down-directional, sharp cut-off luminaries to direct, control, screen or shade in such a manner as to ensure that there is no spillage of illumination off-site. Staff Response: No lighting is proposed with this application. Stafffinds this criterion to be not-applicable. 5 Staff Response: No lighting is proposed with this application. Stafffinds this criterion to be not-applicable. c) The display of any sign or advertising device other than public safety warnings, certifications or other required seals on any wireless communication device or structure is prohibited. Staff Response: There are no signs or advertising devices associated with this application. Sta#Jinds this criterion to be met. d) The telephone numbers to contact in an emergency shall be posted on each facility in conformance with the provisions of Chapter 26.510, Signs, of this Title. This site remains a critical component to the overall network and carries a high volume of call traffic every day making this an important site to receive these technological upgrades. Given this site is located on a building in the CC District, an administrative Wireless Telecom application shall be required to add antennas and equipment to the existing facility. Modification Design & Details The proposed installation shall consist of adding two (2) new omni/whip antennas on the building rooftop increasing the current total number of antennas from six (6) to eight (8) antennas. The existing antennas measure anywhere from 42" long by 2" in diameter to 79.2" tall by 4.6" in diameter. The two new antennas measure 70" tall by 2.7" in diameter. All new antennas shall be painted to match the existing antennas (black). Two (2) new equipment cabinets are also proposed. The new cabinets will be located inside the existing equipment room inside the building and shall not be seen from outside the building whatsoever. In addition, two (2) new cables linking the new omni/whip antennas to the equipment inside the building is required and will be run inside existing conduit. This site continues to be an important coverage site for Verizon Wireless. Without this site, Verizon Wireless would have a significant gap in coverage in the City of Aspen. E. General provisions and requirements. 1) The existing facility makes use of a building in which the antennas and equipment are mounted to and is an allowed use in the CC Zone District. 2) The building mounted facility complies with the City's highest preference for facility siting. 3) Verizon Wireless operates in a licensed spectrum therefore minimizing the chances for interference. 4) The existing facility and proposed modification shall have no impact in airports or flight paths. 5) This facility is not located on a building of historic significance but is located within the CC Historic District. 6) The existing facility is not located on a public building, structure or public right-of-way. 7) The existing facility is not collocated on a tower. 8) The facility is maintained in a safe and clean manner. 9) The facility shall be removed if the site is no longer needed. F. Review standards. 1) The existing facility has antennas located on a building rooftop with the equipment inside the building and therefore complies with all setback requirements. 2) The proposed antennas shall be approximately 6-inches shorter than the existing antennas. The existing and proposed new antennas shall not be more than 10 feet above highest portion of roof as required by code. 3) The existing and proposed antennas shall be architecturally compatible with the building they are mounted to given their very thin profile. All existing and proposed antennas shall be painted to match the building (a black color was chosen by the City with the original zoning approval as well in in 2011 with a recent modification). Given the use of omni/whip style antennas and painting them a dark color, helps to further minimize their impact. 6) No lighting or signage is proposed with this request unless required by the FAA, FCC or other federal entity. 7) The existing facility has no impact on access ways. Section 26.710.140 Commercial Core (CC) Zone District A. Purpose. The proposed modifications to an existing rooftop mounted wireless facility shall not change the current mixed-use nature of the property. B. Permitted Uses. A flat fee or deposit is collected for land use applications based on the type of application submitted. A flat fee is collected by Community Development for applications which normally take a minimal and predictable amount of staff time to process. Review fees for other City departments reviewing the application (referral departments) will also be collected when necessary. Flat fees are cumulative - meaning an application with multiple flat fees must pay the sum of those flat fees. Flat fees are not refundable. A review fee deposit is collected by Community Development when more extensive staff review is required. Actual staff time spent will be charged against the deposit. Various City staff may also charge their time spent on the case in addition to the case planner. Deposit amounts may be reduced if, in the opinion of the Community Development Director, the project is expected to take significantly less time to process than the deposit indicates. A determination on the deposit amount shall be made during the pre-application conference by the case planner. Hourly billing shall still apply. All applications must include an Agreement to Pay Application Fees. One payment including the deposit for Planning and referral agency fees must be submitted with each land use application, made payable to the City of Aspen.
